The receipt that this former client was sent shows that the refund was, in fact, already completed.  The refund cannot be rescinded because it is already done.  The money will show up in her account as soon as her bank processes the transaction.  There is nothing that UpRight Law can do to make her bank work any faster.  We are disheartened by this former client's refusal to stand by her word even though UpRight Law has done everything in its power to help her.  Still, we wish her the best of luck going forward and hope she is able to find the help she needs elsewhere.

Great company, first law firm scammed me for 1280.00 dollars. I was devastated. They are there to help and don't vanish from the face of the earth. They really saved my life and keep all the is at bay. Don't trust anyone but them or you will be sorry. Thanks Upright!

I am the Managing Attorney for Enhanced Service at UpRight Law.  I received notification of this complaint this morning and I immediately reached out to this client in an attempt to resolve it.  Unfortunately, this former client did not answer the phone when I called and he has not...

responded to our many attempts to reach him.  I sent him this email in an attempt to resolve his concerns:Dear FORMER CLIENT,     I just left you a voicemail and I am writing you now so you have my contact information written down.  Please call me back at your convenience.     I would like to discuss with you the Revdex.com complaint that you filed against our firm.  It seems from your complaint that your biggest concern is that you no longer want to file for bankruptcy and you felt as though we haven't been responsive to your desire to cancel our representation.  However, your cancellation request came in on 2/16/16.  We called you back that same day to discuss that cancellation.  When we didn't reach you, we emailed you the direct number for one of our enhanced services managers to go through the process with you.  From our notes, it appears that you never called that enhanced services manager back.  We called you again on 2/19/16 to take care of this, but we didn't reach you again.  One of the attorneys in our enhanced services department left you a voicemail and emailed his direct contact information to you.  You never called him back.  On 2/25/16, we called you again.  When you didn't answer that phone call, we left you a detailed message explaining that we had closed your case.  We then emailed you a close-out letter explaining that your case was closed and letting you know that you can contact us back directly at the contact information that we provided.  We have no record of the 48 calls you claim to have made to us on 3/2/16.  The only call that we have record of on 3/2/16 was one call at 8:36 a.m.  Your case is closed and it has been closed for more than a week.     You can contact me back directly at my information listed below.     Thank you and have a great day!Managing Attorney for Enhanced Services      This complaint contains numerous factual inaccuracies and a blatant mischaracterization of our firm's many attempts to reach him and comply with his requests.  Like we do for all of our former clients, we have made all reasonable attempts to contact him and close his case.  Failing his response to UpRight Law, we closed his cased and communicated the same to him on at least six different occasions.  Even with all of this, we are still willing to discuss a partial refund of the money that he paid us to do the job that we started and only stopped at his request.

misunderstood by the individuals with whom she spoke.  When people contact our firm in inquire about services and give the representatives their debit card information and go through a full intake, it is common for them to understand the person is hiring this firm to represent them in a bankruptcy matter.  Obviously, that was not the case here and we apologize for any inconvenience or frustrations that she experienced.

any issues that he was experiencing.
When we spoke, he let me know that he had gotten some information about bankruptcy from an attorney outside of the UpRight family. The information that he was given from his outside source was partially correct and partially incorrect. The conflicting information led him to believe that he had been lied to by UpRight Law. This was absolutely not the case. This client and I talked over these conflicts of information and came to an understanding about what the bankruptcy process can do for him.
The resolution of this situation was that he has decided to take some time to think about whether bankruptcy is going to be the right fit for him. I gave him my contact information and he will be giving me a call back once he decides if this is the route he would like to walk down. Should he decide that filing for bankruptcy is not in his immediate interests, we wish him the best of luck with all of his future endeavors and we're happy the we could at least clear up any confusions or misinfortion that he previously received.

I spoke to Mr. [redacted] on 09/30/2015. He explained the proper details and outcome for my situation and apologized for any misconceptions I was led to believe by his subordinate staff including an attorney I spoke with regarding the filing of a Chapter 7 bankruptcy. I decided not to take this route at this time. Mr. [redacted] kindly offered to refund my money and contact him in the future if I wanted any help from the company. I just checked my bank account and the funds just cleared. Mr. [redacted] was true to his word.
I request to cancel my claim against UpRight Law, LLC immediately. I would also request that this does not show up on UpRight Law, LLC's reviews or rating.

This client emailed me today, 10/28/15, and asked if there is anything she can do to help move her case forward. I responded:

There is nothing that you need to do right now, but we do need to speak with you so we can take the next steps together. Is there a time that I can put on my calendar to give you a call?
If you would like to be proactive, you can do a few things in the meantime. First, it looks like you still have a balance of $---.00 Completing those fees is important. It allows us to move your case through the process of filing and pay for the court's fees so your case will not be dismissed after filing. If you would like me to schedule that payment time, please email or call me with a date that you would like the payment to run.
After your fees are paid in full, you will be receiving a telephone call from one of our on-boarding attorneys to go over the next steps and pull a credit report for your case. They will need to have you on the phone when they pull the credit report because there are security questions that the reporting agency will ask to make sure that we are pulling it with your authorization.
There are also some documents that you will need to gather to get your case filed. The list of documents is specific to your jurisdiction and the local attorney will go over the full list with you after your call with your on boarding attorney, but there are some documents that are common to all jurisdictions. It will be helpful for you to gather these documents at your convenience:
1.) An income statement for the Social Security Administration - You can call them and they will mail one to you if you do not have the annual one they sent you already.
2.) 6 months of Bank Statements - From any bank accounts that you have.
3.) Vehicle titles - A copy of all titles to any vehicles or trailers that you own.

I am the Managing Attorney at UpRight Law for Enhanced Service.  When I was notified about this complaint, I immediately tried to contact this client.  I left the first voicemail for this client on 2/18/16 at 12:39 p.m.  I tried again and left another voicemail on 2/19/16 at 4:20...

p.m.  I then sent the following email:Dear [redacted] I am one of the managing attorneys at UpRight Law and I just left you a voicemail. I am writing you now so that you have my contact information written down. I would like to talk with you about the complaint you filed with the Revdex.com. In it, you allege that the fees we withdrew from your account were unauthorized. I had the call pulled and I listened to it. There must have been some confusion, because it appears on the call that our representative asked you about the amount and date you wanted your payments to run. It appears that we ran the payments exactly as you asked. Please call me back at your earliest convenience so we can discuss this. Thank you and have a great day!
I also gave the former client my direct contact information and to this date, I have not received a response.
We consider an allegation of an unauthorized payment to be very serious.  If a member of our firm were to have intentionally processed a payment without consent of the client, such an action would be met with a harsh disciplinary response.  In this case, I pulled the recorded call and our representative very clearly addressed the issue of the dates and amounts this client wanted to pay.  There is nothing on the call that would create any confusion in my mind about what the client had authorized.  Everything appears to have worked exactly as it should have worked.  Since this client has not responded to my numerous attempts at contact to see if he would like to add any detail to his allegation, I have to conclude that there has been a mistake on the part of this client.  If at any point he decides to respond to my inquiries, I will be happy to speak with him.

touched base with him and went through the reasons that we need the tax documentation. In cases like this, the requirement comes from the trustee who is assigned to the case, rather than our firm. Every bankruptcy is empowered to request certain documentation from the client and the client must comply with reasonable requests. Tax documentation are required. While one does not have to settle his or her tax bill before successfully filing for bankruptcy, one usually has to actually file the taxes. The client made the wise choice to file those taxes and he remains a client of UpRight Law today and is now one large step close to getting his fresh start. He is satisfied with the resolution we found.
