I am the Vice President of Customer Experience. We apologize for the experience Mr [redacted] brought to our attention. We have refunded the full amount paid. We have also tried to reach him via voice and email to ensure that we answer any additional questions that he may have. We do not agree with this former client's assessment of this situation.  In particular, she agreed to pay for the services she received while she was a client of this firm.  That includes the time for the preparation of a new case file and attorney review of that case file.  These things were done for her case file and these things take time.  Even though her schedule was hectic, the time our firm put into the file was time that we could have spent with another client who chose to devote the time and resources necessary to accomplishing their bankruptcy goals.  Still, the firm has done everything in it's power to resolve this situation for her and we hope that she will accept the resolution that she was provided.

I just want to say upright law is a good place to file bankruptcy they listen and stand by you

This response is merely to preserve our opportunity to resolve the matter within the Revdex.com's guidelines.  Unfortunately, this former client and I have not had an opportunity to touch base.  Her relatively limited availability has not afforded us the opportunity to discuss this matter.  However, I plan to call her again tomorrow to address her concerns.

I was in a tight spot and had to declare bankruptsy. I had no idea what to do so I contacted UpRight Law for help.
Everything was taken care of professionaly and in a short time. All I had to really do was provide the pertinate information and UpRight took care of the rest.
Bankruptsy is not something I ever want to go through again but if it hapened again I would call UpRight Law and recomend them to anyone in my situation.

UpRight Law was very responsive to my needs and helped me in getting my case started and on the way to resolution.
Never once did I feel that I was being judged for being in my financial situation.
They walked me through every step of the process until my local lawyer began my case.
Even then, they have kept in some type of contact with me.
I thank them for all they have done and will surely recommend them to anyone!

The documents required to file a successful bankruptcy are numerous and often confusing. I will continue my efforts to reach this client until her case is filed and all of her questions are answered.

I gave the clerk my number when we talk more than a month ago. I work 9 to 530. I have no more vacation until November. I can't take off and not get paid. It should not take 9 months to take care of this. They want to do Skype. I can't take off to do a SKPE call. They don't work after 530pm or weekends. They won't make any compromises. I don't like the service. When you talk to someone they say they will call back and you hear from them for months. I WANT A REFUND OF MY FEE SO I CAN TAKE MY BUSINESS ELSEWHERE.

I was unaware of your scheduling difficulties prior to this response. I would be happy to call you after 5:30 p.m. I am usually in the office until at least 6:30 or 7:00, often much later. My previous calls were during regular business hours because that is when most people prefer to be called. I will call you today around 6:00.

I am the managing attorney at UpRight Law for Enhanced Service.  Immediately upon receiving this complaint I began attempts to reach this client.  Unfortunately, despite many calls and emails, he has not responded to me.UpRight Law, and all law firms, owe their clients a fiduciary duty....

 This means that we have to do what is in the clients' best interests.  We take this duty very seriously and this former client was given all of his options.  The circumstance that another attorney disagreed with the plan that was put in place for this client does not mean that this client could not benefit by following the plan that we put in place.  It merely means that there is a difference of opinion between two law firms as to how a given client may want to deal with their outstanding debt.  If this former client follows the advice of the other attorney with whom he spoke, he will still be liable for the debt.  He could receive calls, emails and letters multiple times a day until he pays that debt off or files for bankruptcy.  Due to this, UpRight Law put his case file in motion to file a bankruptcy case and that case was prepared.It is also simply untrue that this former client was never presented with a contract.  He was given a contract, read a verbal retainer and he agreed verbally to the retainer and signed the contract.  We have that contract available for his review if he lost his copy.  That contract and the verbal retainer both state very clearly that if you change you mind about filing your case after UpRight Law has completed work on the case, the refund amount will be determined by how much the client has paid minus the value of the work that was completed.  This client paid just over half of his agreed upon fees.  I would be happy to discuss this with him, but he will have to respond to at least one of my attempts to reach him.

process. There are many requirements that must be met and proof of meeting those requirements can become frustrating for many clients. Unfortunately, these clients were not interested in completing the process. We completed an accounting of the file and I personally spoke with the clients at length about everything that goes into filing for a successful bankruptcy. Following that conversation we came to a mutual agreement and this matter has been resolved. We wish them nothing but the best with all of their future endeavors.

My experience in deal with Upright law, was without question; easy and pleasant. The attorney in my area assigned to my case answered all my annoying questions and eased my fears regarding my case. I am a managing attorney at UpRight Law.  Immediately upon receiving this complaint, I contacted this client to address her concerns.  It was obvious from that conversation that there was a miscommunication between this client and the people with whom she spoke.  First, the client set...

up a payment plan and that payment plan was executed in accordance with her authorization.  She believed that by declining to sign her contract, that the firm would understand her silence to mean that she no longer wanted to move forward.  That is not the case.  Just because a person doesn't do everything that we ask them to do exactly when we ask them to do it, does not mean that we should know that they have changed their minds about moving forward.  Accordingly, the payment plan moved forward.  Second, the client was old that she should expect a call from a manager to discuss her refund in the next day or so.  She filed this complaint the same day.  UpRight Law did not refuse her refund request.  We only asked for her patience as we closed her account.  After discussing these things, the client and I were able to quickly resolve the matter and a mutually acceptable refund is currently in process.

case, the amount that was paid was far less than the value of the work that went into the case.  UpRight Law understands that this client experienced a number of financial difficulties and was unable to complete her obligation.  Still, no law firm could exist if it were to spend time preparing cases and then give the money paid back to the clients after the work was done.  UpRight Law did not charge this client for the deficiency of her bill.  UpRight Law did not contact her and ask her to pay the remainder of her contract.  Upright Law waived the fees for the work that was completed and agreed to close the case with no future payments.After talking to this client about the work that went into this case, we came to an understanding about why no refund was offered and we were able to successfully resolve this client's issue.
