emailed reply 3/18/15Dear [redacted] ,This email is in response to the complaint you filed with the Revdex.comThank you for your patience in waiting for my replyWe have adjusted your account to the current fixed rate of .1049/kwhThat rate is fixed for monthsYour rate will automatically switch to our variable rate at the end of that 6-month periodYou will need to contact us again if you want to avoid switching back to the variable rateYou should see this new rate after your .1149/kwh rate expires.We are sending you a refund check for the difference in rate from the variable you were charged, to the fixed rate at that timeYou should get your $check in the mail any day now, as it was sent directly from the bank on 3/11/I apologize for any inconvenience.Thank you for being a Verde customer! Their fixed rate actually remained higher than my utility company After the fixed rate expired, the rate per kWh ended up 5x (500%!!!) higher than my utility company After two years of having them as my supplier I calculated that they actually cost my $more than if I had just remained with my power company!!!

We sent the customer the following email today Mr [redacted] , I received a copy of your inquiry In you received via first class mail a letter from Verde Energy which indicated that your account was now on a 100% renewable energy offer, which was not guaranteed to be below the utility rate, and that you could contact Verde at any time to cancel or inquire about an alternative fixed rate offer The mailing also included a $retention rebate which you submitted and cashed the check we then sent you I saw that your account left service with Verde on 11/12/ Even though you cancelled, as a good will gesture we will send you a billing adjustment check for $which effectively lowers your rate to $0.10125/KWH for you last bill cycles You should receive this check in approximately weeks Regards, [redacted] Verde Energy USA

Complaint: [redacted] I am rejecting this response because: I see no reason why I should settle for less than the amount that I expect to receive if I take my complaint to the Small Claims Court The Terms and Conditions Verde sent me with their August letter state:Price: “...the rate may fluctuate with month to month market conditionsEffective rate will not be higher than the comparable rate from your local utility...” Since Verde’s one and only selling point was that they would always charge less than [redacted] I cannot imagine that Verde ever believed that I would be willing to have Verde as my supplier if they charged me more than *** Based on my communications with Verde it is clear to me that it is Verde’s deliberate policy to defraud the public by promising a lower price and, after a while, raising the price above ***’s, with the expectation that the customer will never realize that he is paying more, rather than less than [redacted] charges I Called the local Small Claims Court and was told that I could expect the Court to award me the full amount of the overchargesI was also told that, if I am convinced that it is Verde’s policy to defraud the public, I might consider contacting a law firm that specializes in class actions Sincerely, [redacted]

We sent the customer the following email today MrPietrzykowski, I reviewed your recent Revdex.com inquiry and offer the following: Your account began service with Verde on 12/10/on a variable rate offer which can change with market conditions Your initial supply rate of $0.1075/KWH dropped to $0.1065/KWH in June and stayed at this low rate until June when it began to increase due to increases in Verde's supply costs You received significant savings during this 3+ year period As a goodwill gesture, as you asked, we will send you a billing refund check of $ We dropped your account per your request and your account will leave Verde service on at the end of the current billing period on 4/10/ You will receive your check within weeks Regards, Tony Menchaca

Complaint: I am questioning this response because: While I appreciate that the company has promised to return $to me, and will accept this money when I receive it, in just my last bill alone, my increased fees were $over my local utility company, resulting in a loss of $in the past month, even with the return of $ Despite the verbal contract when the company assured me their fees would not be greater than my local utility company, they have been greater since at least July 2013, resulting in over months of fees over those charged by my local utility company In addition, while I wish to return to my local utility company immediately, I am not able to return until March 1st, resulting in additional costs to me over my local utility company I have also become aware that this company has a contract through August with the city of Evanston, IL, where they are providing utilities at less than 1/the cost they are charging me Please do assure they return the $as promised, and thank you for your consideration of my response enclosed Sincerely, Alexa Asher
