I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Whenever Colony American Homes (CAH) want to add something to my account they apply it to rent in which the rent has been paid.  They do not notify as a professional entity would by mail but instead once my rent has been paid I see a negative amount on my account.  So each time this happens there is a threat of eviction.  As I informed CAH when I first moved in I informed them that there was a lot of water running in the back and front yards.  It was placed in writing to them and I constantly told them about it they finally had someone come out 6 months later to address the water issue, so I told them my concern was if the water was running in puddles outside as I had previously been informing them how can they compute that I owe as much for a water bill.  So began the water issue dance.  Also, they did not give me a signed lease to get the water in my name when I initially went to get it done once I moved I was informed that I needed a signed lease; as of today I STILL DO NOT HAVE A SIGNED LEASE even after I had requested it.This is why I do not agree with the matter because they are not and have not accepted responsibility for the water bill.  They claimed that they gave me credit but they did not.  The first bill was December 2013-February 2014 I moved in mid-January 2014 so of course the bill was not fully mine then for the other bills they charged me the actual amounts due on the bills and never did account for the water wasted in the front and back yards.  I went to pay my rent this month and once again it showed a negative $300 once again for the water bill.  When I went down to the office it was for water and I told them the water bill is now in my name despite the fact that I did not have a lease the water company allowed me to show them bills that I had in my name for the residence.  When we discussed it the bill was for $70 and not $300 and then the next bill that the water company stated that I would receive would be $60.  These are the things that CAH does which is not professional and violate business ethics.  I am not sure if they have it stated anywhere (ie. credit report) there an eviction was posted on me.  There practices are unethical and not professional they do not provide proper notification and if they sent me something (as they state) it is always sent to the wrong address but they never take the time to resend it but instead use their power to do unethical things.Regards,[redacted]

Prior eviction(s), felony(s), and bankruptcy(s) are immediate disqualifications, which we share with prospective tenants  so they do not go forward with the application process as we know they are automatic disqualifiers.  We are not aware of credit complications until a credit report is run, and that can only happen after a prospect applies.  The following information is provided prior to moving forward with the application process:
Credit History – To determine satisfactory credit, we run a report through a credit report agency. Credit history from the past two years will be evaluated.
We regret that the outcome of the application was not favorable our goal is to be as transparent as possible.  However, some things we are not aware of in full until after the application is submitted.

I live in the State of Georgia. I rented with Colony American Homes for two (2) years under two (2) different property management teams before they merged with Waypoint Homes. Once they merged my lease with Colony ended and began with Waypoint. My lease was for 12-months, so I thought. I signed a contract on June 1, 2015, which was supposed to end June 1, 2016, but according to Waypoint Homes, it ended on June 6, 2016. Before signing the contract, I spoke to the Renewal Coordinator at the time which was Shanell Hanson, who informed me that the extra time was "if" I needed time in which to move out. I agreed to those terms, so I signed the contract. I submitted my first notice to vacate by email on April 8, 2016 (late evening) they again on April 11, 2016, after receiving a phone call from Shanell Hanson to be in writing and on their form letter. I stated I would vacating the premises by May 31, 2016. My lease was to end legally June 1, but Waypoint was June 6, 2016.

I paid May's rent and had my exit inspection on May 9, 2016, at which time keys and garage remotes was turned over to their Field Project Manager, Dennis Moore. I received a letter (the fastest ever) on April 12, 2016 informing me that I would be charged $200 for violating the lease by not staying until June 6, 2016 as well as not giving them 60-day notice I was being charged $100.

I called and spoke to the Property Manager, who was Kelly Eubanks, and asked why am I being charged $200. At first she states that the extra time is for if my lease expired on the weekend, I would have to that following Monday in which to move out. I stated to her that 12 months is 12 months, not 12 months plus six (6) days. She became irritated and stated that I signed and legal document and it is binding and that is how Waypoint Homes writes their contract. I also inquiry about the $100, which she states that I did not give them enough notice according to my agreement. I stated that their agreement asked for notice of 60-days, not required 60-days and that their own agreement states that if you do not give notice, you will have to leave the premises immediately at the end of the lease term (14.2 Notice to Vacate).

This company should not be able to conduct business in any state or jurisdication. They are very deceitful and train their employees to behave in that manner. Renting a property that you called home for three years should not end up with you taking that company to court to have your security deposit refunded in full, after the walk-thru was signed off by their own inspector as "no resident damage charges" to the renter should result in litigation proceeds.

Waypoint is just another corporation that treats its tenants with absolutely no regard. I will never again rent a home from a corporation. They are refusing to fix their washing machine because it is not under warranty. They threatened to evict us and left the notice on a Sunday taped to our door over a $95 late fee in the same month. We payed the rent one day late after coming home from a long holiday weekend. It's enough to have to deal with this kind of bureaucracy in day to day business dealings than to have to put up with these corporate practices in my rental is way too much.

Waypoint homes is not a good company to rent a property from. They are overpriced and have awful maintenance and office support. I'm a DOD civilian and rented a house with them for 2 years in [redacted]. Before the lease was up, I sent them a email a few months before the end of the lease letting them know that I would not renew the lease and that I was going overseas for employment. They never replied back or sent any information about closing out the lease and moving out inspection. I called the office about 30 times and no one ever picked up. Finally I went to the office and talked to them explaining my situation and asking them to to not renew the lease. The manager made it seem like everything was going to be ok and for me to not worry. I gave them my orders saying where I was going, how long I would be overseas and who I was coming with. First of all, they did not even know who the Department of Defense was or how to read orders. I left the office after being assured that everything would be ok and with the promise of a phone call from management with move-out information. A week passed and they never called me back. I attempted to call them from overseas and was told that they were not aware of my situation and that the manager I had spoken to and exchanged several emails had quit and did not pass any information along to the next group. Now that I'm overseas, my old neighbor called me and told me that there is a piece of paper taped to the front door of the house I rented and it seems to be from [redacted]. The letter appears to be an eviction notice and they are taking legal actions against me even though I'm deployed with the Department of Defense and went through all the right steps to not renew the lease. I am not sure what to do now since I am currently deployed and have attempted to contact them at nauseum. I hope no one rents from this company until they get their act together and uphold tenants rights.
