I am rejecting this response because:the merchant made false representations which induced me to use their service. They told me I would not have to pay for any equipment to use their service but then stated I had to buy a terminal from them. I immediately told them that this was not what was represented and did not want to use their service. They have charged my account each month for services I was not provided

Merchant's neglect to read terms provided are being acknowledged by releasing them from financial responsibility of 36 month contract and waiving the $645.00 termination fee as courtesy to their misunderstanding of the services they requested. Please call ###-###-#### for copies of the merchant agreement. As advised, in order to proceed with closure please return equipment provided to the address below. Please retain a copy of the tracking information for you records. In order to address this merchant concerns we have reviewed their account notations, communications and agreements. On 8/25/2015 at 1:24 PM PST merchant called in regarding our Mobile Application Credit Card Reader, downloaded and applied for the services in question. Mobile App requests pertinent information to be entered in prior to application submission, these steps include but are not limited to:       Business Name Principal Owner Name Federal Tax ID # Social Security Number Expected Processing Volume Checking Account Number Bank Routing Number Our application process is very clear, concise and requires acceptance by the applicant in each step of the process, the final step is a set of terms, this section provides all important details in regard to the terms, conditions, pricing and structures for each respective application. All items listed in question via the complaint detail are available at that point and view-able prior to acceptance of the terms listed in our agreements. There is full and complete disclosure included with all of our applications. Application was signed with digital signature that has the following IP address embedded 100.6.###.#1 Installation of EPN Mobile App with a test transaction ran was completed on August 27, 2015. In addition, credit card processing occurred on this account during August of 2015. Services were requested, provided, installed and used. In closing, the account closed with no early termination fees. Merchant Account Solutions stands by its services, products and terms listed in our fully disclosed and completely transparent contracts at all times and while we feel that we have delivered the services requested to the best of our ability, we waived the termination fee due to their misunderstanding of the terms provided while any and all fees leading up to account closure are valid as services were requested, provided, installed and used. No refunds will be processed for monthly services during active state of account as it was in use. I am rejecting this response because:I can not be billed for never using this service it needs to be processed and shut off with no more monthly charges the company has already stole money from me when I have never used there services or even opened the box the equipment was in and I can not be charged for not even using the equipment the first complaint was sent before June 1st and the recent complaint states if my equipment was returned it would then be deactivated

agreement has already been emailed to the merchant on March 28, 2015. As previously advised, No refunds will be completed as service were rendered and used.  Merchant downloaded our mobile application Smartswipe on July 7, 2014 and proceeded to complete Merchant Processing Application. Merchant completed all information requested such business information, business owner information and as well as how much and how they process credit cards. On the last pages the terms and conditions are available for the merchant to read through, retain a copy and agree to. Merchant agreed to all terms which had any and all fees listed for the services requested, they signed the agreement via digital signature embedded with their IP address [redacted]. Merchant acccount has been closed since March 11, 2015, termination fees have been assessed and no other fees have been billed after closure. Any and all fees are valid as service were requested, provided and installed. Merchant has submitted another complaint with the processor Ipayment that completes our billing and was advised the same, no refunds for services rendered.

I am rejecting this response because:The sales rep for the business told me before I decided to use their service that my existing "card swiper" would work with their service and I would not have to buy any additional equipment. After the "test" transaction was completed (no card swipe necessary) I was informed that my card swiper would not work and would need to pay $75 for a new swiper. At that time I told them I was not interested in using their service since they had made mis-representations to induce me. I want all money put back in my account that this business has taken illegally

I am rejecting this response because: A physical contract was claimed and allegedly sent.  It is was never sent. The address was verified was 3 times.  In addition, the representative stated that should the matter be taken to court, we would lose, this is de facto...

legal advice witnessed by 3 people under the knowledge of the representative.   The representative repeatedly refuse to allow any supervisory consultation stating the supervisor would say exactly what he said (despite refusing to attempting to understand what would be discussed. The Fir Debt Collection practices act guarantees a clear chain of command.  His exact words ere that he was the top, despite research through public records revealing this untrue.   Intentional deception is also against the FDCPA.  No bill was provided until after withdrawal, again against FCPA. He has made slanderous accusations and admitted the same himself but claimed his a truth.  He threatened to withdraw from my account regardless of my ability to pay and with the knowledge he was withdrawing from an incorrect account which I offered to correct.  I ultimately had to correct on my own.  He encouraged bankruptcy asa solution.  I informed him of dire situations and multiple disabilities which he ignored.  H was informed and agreed to a few others verifying his information and repeatedly informed me that no call on his end was ever recorded.  I was repeatedly accused of lying, then told he never said that.  I was told I was an attorney and that he shared the same education then told he was a high school graduate.  I was mislead that Federal law required both parties to consent to call recording, even overhearing despite Federal law requiring only one party's consent and as he called a state number only requiring the same, he communicated deceptively.Ultimately he caused a great deal of trauma, but has not to this date even acknowledged the possibility of it. As, which he clearly and repeatedly stated, he was the head supervisor (no other number was offered or given) of the company, I realize that there is little I can do.  I accepted his offer under duress and am bound by it $20 approx a monh.

Merchant applied
for services on July 14, 2015 at 10:21 am and spoke with one of our senior
account executives and was provided with a quote for 2 accounts for the
different equipment programs the merchant requested for their business. Merchant
was advised to submit Merchant Processing Application for both accounts. During the application process, it requires pertinent
information such the business information, owner’s information and banking
information. Each and every page of the application process requires
confirmation and submission, lastly on the last page it list ALL terms which
includes any and all fees pertaining to the services requested. The agreement
was digitally signed with the following IP address embedded [redacted].
To
accommodate the merchant’s misunderstanding as a courtesy the following was completed
in November.
                - one of two cancelled with
no termnation fees($645)
                - courtesy refund for 1
month of service fees on cancelled account ($55.85)
                - on opened account reduce
36 month contract to 12 months.
                - reduced the monthly
service fees on open account by 50%.
Merchant’s desired
settlement cannot be granted because the merchant failed to read the terms
provided. This mistake costs our company application fees, licensing fees and
activation fees. All information pertaining to the services requested were
available to read. Merchant Account Solutions have already addressed this case
outside of the Revdex.com. No refunds will be issued as the account was requested,
services rendered, installed and is actively being used. Merchant must complete
12 month contract on remaining account. Merchant also needs to return equipment
provided for the mobile processing account that has been closed

We have received the equipment in good and working condition as a courtesy the account is now closed June 16, 2016 and termination fees of $645 dollars were waived and they were released of 94.44% of the financial responsibility of the 3 year agreement the merchant agreed to via digital signature which was embedded with their IP address [redacted]. Merchant was also mailed a welcome packet with all the programs guides and terms. No refunds will be processed as service were requested, provided, installed and actively used. Merchant Account
Solutions would like to advise business owner for the future to always read all
terms and conditions provided to them and have full understanding before
signing anything in order to avoid any misunderstandings for their business.
