I have reviewed the response made by the business in
reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
The invoice number is ***Dated 5/16/For the first engine, we then had to fight with them after they sent a bad engine to send another one After many weeks of fighting and being without the vehicle they agreed to send a replacement engine but would not hold up the warranty on the labor to take out the faulty engine and put in the replacement engine The second engine was delivered 8/10/The delivery receipt I have does reference that same invoice number The second engine has now failed within the first year of the three year warranty Now again the vehicle is un-driveable because of the engine
Regards,
*** ***

The complainant is requesting a billing adjustment as the engine the allege we sent them is not the correct engine for their vehicle and it does not properly fit in all areasPer our Terms and Conditions of our Free Warranty, Line 16: 16.OEM auto parts are interchangeable with multiple years, makes and models which means the same part is an exact fit for multiple makes and models as determined by OEM standardsWe guarantee the part we sell to fit your vehiclehttp://www.gotengines.com/warranty.html The complainant pleased the order on and called in with issues on The complainant never did activate the free warranty so all warranty claims are now void as the warranty was not activated with days after engine was receivedWe disclosed to the complainant that all we guarantee is the long block and the complainant would be able to take off items like the oil pan from his old engine and put them on the new one and see no difference

I was in contact qiththe SW TransmissioCompany August to inquire on a message I received by the company who sent the transmission to me*** from the shop in Fresno CAStated that he was in contact with SW Transmission and informed Niel that the transmission disnt have the torque converter to the transmission that was being sentAccording to this individual NielHe stated to send it anyway*** immediately contacted me to inform me that the transmission was not complete. In additionI was charged for a complete transmission that included thetorque converterThis piece alone is and the transmission is pointless without it. I specified this to *** in the Warranty deprtment of SW Transmissions and he stated it was send out the way it was sentI informed my after weeks of hassle and wrong parts I would like my money backHis words were not until they receive the transmission back WHICH by the way was suppose to be here today August according the the tracking number. This has now left me another day of no work waiting this delivery. FYI on the response to the Business owner comment; NO not all 2001-2005transmissions are the sameThere are different market transmissions. 1- US Market 2- CANADA Market Two completely different sensor fitting and line ups for bolts. Thank you *** ***

Regardless of the alleged statement made by a
"person", we would have no way of knowing the conditions the freight
company would or would not be willing to deliver to We only ever agreed
to help you when dealing with the freight company as we stated this was an
issue with shipping which you are more than aware of and we were completely
honest about not being able to compensate from our end due to the circumstances
from the beginning We also removed the employee from the position who
was rude to you when you called in as this is completely unacceptable
Simply stated, we are not liable for any damages when you were not
available to inspect the engine when being delivered In this case, you
should of demanded the freight company arranged a delivery time/place for you
where you could of inspected the order before accepting This is standard
protocol and we would of more than gladly stepped in at this time if the
freight company would not comply at that time We apologize you did not
make the right choice in this case, but does not make us liable

I am aware that I agreed and signed to the 25% cancellation feeBut that does not justify the fact that I was told by one of there employees that I would not be charged because the motor was never taken outThey are completely lieing about taken the part outThe way I was spoken to over the phone just to cancel an orderI was sworn at and hung up on multiple timesThey have a bad names for themselves as I have read the multiple complaints about there businessWhen is it going to stop! They should not be allowed to talk to people and treat people the way they do! They should not lie about taking a part out to STEAL people's money! I don't agree! I want my 25%! They have failed multiple times, there is an ALERT out of there Business!

Per the Terms and Conditions of our Free Warranty the complaintants engine waranty begins on the 1th days and the 501st mileSince this was not accomplished, the parts and labor warranty claim to cover installation was in fact denied as the Terms and Conditions were not met and the guidlines we have in place do not cover engine installation cost

Have the customer provide both proof of delivery to us and we will issue a full refund

First of all, I am a Christian and I do not use foul language or speak rudely to anyone. Secondly, we have NOT been refunded our money. Thirdly, we are NOT in possession of either transmission. Both were picked up by R&L Carriers. I contacted R&L Carriers on the second transmission and they don't even have a record of this company name. They put in a number and it came up with three different aliases (and that is exactly what she said, they were aliases). This company blatantly lies. We ordered the first transmission on October 22, and called this company repeatedly only to be lied to. I talked with *** *** *** *** *** at this number ***. I left messages with the "supposedly" manager, ***, and he never returned my calls. This is a scam and makes me sick to my stomach that people like these exist in the world.I have attached the bill of lading for the first transmission where it was picked up. That is proof that we are not in possession of that transmission. They did not send us a bill of lading for the second one. (Isn't that ironic?) I have also attached the email I sent them regarding my displeasure with them and a confirmation email that they received it. I had hoped that this matter could be resolved amicably, but I see that is not the case. We are out $(cost of transmission, shipping, and mechanic fee) for a transmission that never worked and we are no longer in possession of

The complainant is requesting a full refund of all monies paid on invoiceThe complainant is also requesting the engine purchased to be picked up that was shipped to them and returned to usAfter further review, a request to have the engine picked up and returned to the us was approved on 8/4/
and a full refund was approved and will be be given to the complainant

The complainant is requesting a refund of the Refund of the 1st labor costs of removal and replacement of alleged defective merchandise sold as functionalThere has not been any information given back to us showing any defect in the transmissionPer the Terms and Conditions of our Free Warranty
for Transmissions, Parts and labor warranty begins on the 14th day & 501st mile after the part is installedWarranty must be activated within business days of delivery OR ALL WARRANTIES WILL VOIDEDFalsifying information will automatically void your warrantySince the vehicle was not driven more than miles the warranty is currently voidedQUT will reimburse the repairer up to $per hour for the repair of a part or assemblyThese charges shall not exceed (a) 100% of the part price as indicated on your original invoice, and (b) applicable numbers of hours derived from labor allowances from nationally recognized labor time allowance manuals with a maximum allowable time of hoursLimit of liability is $2,(aggregate) or the actual cash value of vehicle whichever is the lesser amount at time of claim as determined by the low book amount in either KBB or the NADA Guide at company’s discretionWe hope this helps address this issue and the case is closed

the complainant received the purchased engine from us on 3/24 and activated their warranty on 4/7. Per the Terms and Conditions of our Free Warranty: "Parts and labor warranty begins on the 14th day & 501st mile after the engine is installed." https://www.engine-transmission.com/warranty.php...

Since the engine was driven over 500 miles the warranty is now void and current or future claims will be voided. Also,  We do not warranty any attached accessory parts, such as switches, sensors, cables, electronics, belts, hoses, water pumps, manifolds, wire harnesses, valve covers, brackets, flywheel etc. We also do not cover installation of our engines so the amount will not be refunded back to the complainant. We hope this closes this matter and any issues going forward.

The complainant placed their order on 10/22/2016 then called in on 10/28/2016 to cancel their order. Per the Terms and Conditions of our Free Warranty: Line 3.All returned parts or cancelled orders are subject to a 25% handling and restocking fees plus customer assumes all shipping costs....

https://www.swtransmissions.com/warranty.html. Since the complainant canceled his order, signed and returned the cancellation email on 11/1/2016, we refuended their money minus the 25% restocking fee.

The complainant ordered their engine on 1/17 and we delivered their engine to them on 2/6/2017. The complainant never registered their warranty. Per line 10 of ther Terms and Conditions of our Free Warranty: "10.Engine or transmission must be installed AND warranty activated within 10 business days...

of delivery OR ALL WARRANTIES WILL BE VOID. Falsifying information will automatically void your warranty."  We do not show any communication from the complainant reaching out to us to communicate alleged engine issues. We would ask that the complainant please email us at [email protected] with their issues and problems and we can look to address them once we recive their email. We hope this closes this matter and any issues going forward.

The complainant purchased an engine but not the correct engine for his vehicle. After purchasing the correct engine the complainant was charged a shipping charge. The complainant was not happy with state of the second engine purchased and requested a refund. Due to the terms and conditions of the...

warranty his warranty claim was denied. Terms and conditions of the Free Warranty clearly state on line 1: Engine warranties are limited to manufacturing defects in the block, heads, pistons, crankshafts, camshafts, rockers, and oil pumps. We do not warranty any attached accessory parts, such as switches, sensors, cables, electronics, belts, hoses, water pumps, manifolds, wire harnesses, valve covers, brackets, flywheel etc.  Additionally, on line 15: We do not warranty oil leaks/damage on engines or transmissions due to non-replaced seals, gaskets or filters. The Terms and Conditions of the Free Warranty must be read and agreed upon before placing the order and is indicated by selecting the text box as confirmation before moving forward and purchasing the part. http://www.engineandtransmissionworld.com/warranty.php  Therefore, the claim was denied based on these Terms and Conditions. We often see many automotive shops not doing their due diligence before installing a used engine.  The yellow tag which we have attached to the engine and have attached here clearly states all gaskets should be inspected and replaced, if needed, and specifically states the Rear Main Seal has to be replaced.  We do suggest the complainant pursue this matter with the shop and would be more than happy to assist with this matter if the information provided above does not suffice.

We believe this customer is mistaken on the Terms and Conditions of the Free Warranty.  The T&Cs of the warranty explicitly state: "Parts and labor warranty  begins on the 14th day & 501st mile after the part is installed." We replaced the defective engine as a good faith...

measure as can be seen the Free Warranty T&Cs stated above.  Furthermore, initial and any subsequent installation(s) charges are not covered by the Free Warranty. This is an implied risk of ordering a used engine as is the policy with even global suppliers of Used Engines or Components. Our representative did not misrepresent and simply let the customer know that any issue after the above Terms and conditions are met, will be covered by the warranty as long as the customer has successfully followed all the required criteria to receive a valid warranty claim.  Therefore, this customer does not have a valid warranty claim and has not been mislead in anyway as the Terms and Conditions of the Free warranty must be agreed to before the purchase and is clearly and explicitly detailed on our website and during the ordering process the customer has several opportunities to review before making a purchase. The Terms and Conditions of the warranty our listed clearly on the website and may be reviewed by visiting: http://www.engineandtransmissionworld.com/warranty.php.

showing engines being shipped   order#  [redacted]·         No one at SW engines will return my call or E-mails·         I also included invoice for installation of engineAgain Thank you for your help, Much appreciated

As clearly and prominently stated on the website and on the Terms and Conditions all customers must agree to when purchasing "Warranty must be activated within 10 business days of delivery OR ALL WARRANTIES WILL VOIDED. Falsifying information will automatically void your warranty."  The customer simply did not follow the Terms and Conditions as agreed upon and has forfeited all future warranty claims.

The complainant purchased a used engine from us on 02/07/2018 and it was shipped out to them on 02/12/2018. The complainant did agree to the Terms and Conditions of our Free Warranty with their initial purchase of the used engine. The complainant is requesting a refund for compensation due to labor...

charges from the complainant’s mechanic. The complainant allegedly states that we had sent the complainant the incorrect engine when we had shipped the engine out on 02/12/2018. The complainant called us on 02/22/2018 and informed us that we did not ship them the correct engine. The complainant did not provide us with the VIN number to verify the engine during the initial purchase. We did as a show of good faith, send out a second engine to the complainant on 03/06/2018. The complainant also stated that their mechanic needed to be compensated for work done on the original engine. We did request the complainant to please send us their mechanics invoice and we would review. Once we did review the mechanics invoice, we did issue a refund, again as a good faith response, in the amount of $505.00 to help the complainant out as they had originally ordered the incorrect engine. The specific sections of the Terms and Conditions state as follows: Line 5: Mis-ordered or mis- diagnosed parts are non-refundable. SWE will reimburse the repairer up to $50.00 per hour for the repair of a part or assembly. All the Terms and Conditions of the Free Warranty are prominently listed here: http://www.swengines.com/warranty.php.  We did calculate that the $505.00 refund consisted of 10.1 hours of labor charged at $50.00 an hour. The complainant did not ever activate their Free Warranty nor did they ever file a warranty claim. We in good faith resent out an additional engine and did refund the complainant with a partial refund for their mechanics labor. We do feel that no additional compensation is needed due to the above information provided. We do hope this closes the matter and please let us know if you need any further information from us.
