This message is in response to your request for Harley-Davidson to provide documentation detailing thecomponents required to convert your Harley-Davidson motorcycle that was built and delivered for anon-US market to meet US safety and emissions requirements. As previously explained, Harley-Davidson...

has provided documentation detailing the configuration ofyour motorcycle (HOI - International) and the number of open US Safety Recalls (zero). This informationis the documentation that Harley-Davidson is required to provide by US regulations. The responsibilityfor the identification and conversion of required components to meet US EPA and Safety requirementsis the responsibility of a Registered Importer (RI). The documentation we have provided is the same setof documentation we provide to all other Rls who collectively assist with the importation of hundreds ofHarley-Davidson motorcycles each year, and is also consistent with the information other manufacturersprovide to Rls.We understand that you have initiated a business transaction with Wallace Environmental Testing &Laboratories in Houston, Texas to assist you with importing your motorcycle. We have communicatedour policy to Wallace Environmental Testing & Laboratories on multiple occasions and believe theyunderstand their role in determining the required components to be changed to meet US regulations. Our position stands that Harley-Davidson Motor Company has provided the appropriate documentation, and any additional documentation would exceed industry standards and H-D policy, and would exceedwhat is required by US laws.We appreciate your passion and loyalty to our brand and value you as cus[redacted]ers and lifetime H.O.G.members.[redacted]Manager, Contact CenterHarley-Davidson

Thank you for notifying me of Mr. [redacted]’ concern regarding
Revdex.com number [redacted].

I investigated this file and found that Mr. [redacted] contacted
Harley-Davidson’s Customer Service Department on May 9, 2016, regarding his
2015 FLHTK, Vehicle...

Identification Number [redacted]. Mr. [redacted] stated
he discovered rub marks in the paint of the rear fender after removing his
tour-pak.

It was determined that Mr. [redacted] motorcycle has many
accessory parts installed, including a Detachable Tour-Pak Luggage Conversation
Kit part number 53000291A, and Boom! Audio Stage II Tour-Pak Speaker Kit part
number 76000526.

The description for the Detachable Tour-Pak Luggage
Conversation Kit part number 53000291A on Page 375 of the 2016 Harley-Davidson
Genuine Motor Parts & Accessories catalog states “Does not fit models
equipped with Boom! Audio Stage II Tour-Pak Speaker Kits.”  This statement is also included in the
fitment information section on www.Harley-Davidson.com.

Because this is not a recommended fitment for Mr. [redacted]’
motorcycle, his request for a new rear fender is denied.

Thank you for allowing me to explain our position.

Sincerely,

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. You claimed:
--We are sorry Mr. [redacted] is not happy with our response. We have tried to explain the brackets are attached to the motorcycle and were obviously removed by a prior owner of the motorcycle prior to his purchase of it.--I want to say:I am sorry HD is not happy with my response. HD knows this is a Recall issue as I have pointed there is no mounting bracket on this motorcycle for the mufflers which is obviously a design error prior to manufacturing this model bike. HD refuses to resolve this issue and I will be filing a legal case with the US court to resolve this issue since HD doesnt care if someone can DIE becasue of this issue on their motorcycles they designed and manufactured.

I do not accept this answer. Harley Davidson corporate is just exploiting more money to the consumer. I cannot even say I will never buy another Harley Davidson or another product, but it disgust me that such a close HD brotherhood among riders you realize that they are just corporate and do not care except for the all mighty dollar. They are completely wrong in this situation as a consumer I feel robbed and held up without a gun. [redacted] [redacted]

Thank you for providing the pictures.  Our Technical Service Department will be in contact with the dealership to authorize a replacement radio.  Thank you again for bringing this matter to our attention.

Please provide the Vehicle Identification Number (VIN) of your motorcycle and the name of the Authorized Harley-Davidson Dealership that has diagnosed the concern.  Thank you.
