The member was contacted because her payment had not been entered into our billing system. She explained that she had made her payment on time. Once the club manager looked into the billing, he found that the member had made the payment on time. We called the member back and explained that it was a...
mistake on the part of our billing company. We also left a voicemail and sent a letter to give the member a free month to use the gym for the inconvenience that was caused. The member did not return our attempts to contact her. We therefore cancelled out the members account with no further payments due. The billing company, ABC Financial, nor Anytime Fitness will not contact the member in the future. We apologize for any inconvenience and hope this resolves the issue. I did speak with [redacted] in regards to his request for cash back for his building card. We do have a $20 charge for the building cards (a fee, not a deposit). He is not entitled to a refund for the card. My employee (being new) was confused by [redacted]s request and...
demand of $20 back, so he made the mistake of offering to put a $20 credit on a credit card for him as we do not have cash on hand. The employee was wrong in how he handled the situation. He should not have offered any type of refund at all, and definitely, not on a credit card. However, [redacted] is still not entitled to a refund. My employee that sold [redacted] the card originally has been with the company for 4 years. He is very aware of informing folks that the key is not refundable. He also explained to me that he could vividly recall the conversation he had with [redacted] at the point of sale. At that time it was very clear that there would be no refund for the card. I requested the following, that [redacted]:
1. Delete my membership card picture and shred my fitness evaluation folder, and provide a clear written statement that he has deleted my Membership card picture and shredded my fitness evaluation folder, without making any additional copies of them, with his legal signatures.
2. Provide proper documentation for the cancellation of my so-called monthly gym membership, and the cancellation of forged private training session contract with his legal signatures.
He provided two documents to my lawyer, one from ABC financial and the page 2 (in regards to personal training sessions) that he had added later to make a 2nd contract. He hand wrote on both pages that my monthly and my personal training sessions are canceled. But the ABC financial document that he provided states that 'my account has been placed into a "pending" cancellation status, and as of now I don't owe any balance.' This document doesn't indicate that my account is in fact canceled. I need the document from ABC financial stating clearly that my account "is canceled."
He also didn't provide with a statement (with his signatures) saying that he has deleted my membership card picture and shredded my fitness evaluation folder, without making any additional copies of them.
His time is not more important than anyone else's, he needs to provide with All the proper documentation, asked above, ASAP!

4/20/16 - but would like to respond to the complaint filed on 4/19/16 by [redacted].
It is the Anytime Fitness corporate policy to allow a member to cancel their agreement should they move more than 30 miles away from an Anytime Fitness location and NOT the location that they originally signed up.
As our assumption of risk and release form indicates "CLUB", this does not mean that if a member uses another club and hurts him / her self that we are liable or that "CLUB" is liable.
CLUB refers to all of our franchise locations. When moving to a new location the local club them will relocate that member and that club has the ability to then collect the dues and contract that was originally signed by that member.

This member's membership was terminated upon the proper cancel obligations by the member as per the signed membership agreement. The member firmly stated that she would contact the Revdex.com and anyone else until she received refund. As a business, we can not deviate from company policy and legal practice to accomade this member's request. This member continues to try escalate this matter by making false statements about the best practices of this business.
The matter was resolved in a professional legal manner as obligated by the business and we do not wish to engage in any further discussions regarding this matter.
This gym has terrible customer service. When I signed up for my membership I was told that I had to pay the first and last months membership fees up front which I did. I used the gym for 6 months when I decided that I no longer needed it. I tried cancelling but I was unfortunately locked into my contract for a year. When my year was up I went in to cancel and they refused to count my initial first months payment towards my cancellation. I have since been billed for two additional months membership and a maintenance fee since I have submitted my cancellation paperwork. I tried calling and e-mailing to find out what is going on and I get no response.

I am rejecting this response because:
During the same meeting I was told by the Woodside rep in my face that the clean up would occur prior to the street being repaired. This explains why nothing has been done to date. I am not waiting until April or May to have the street cleaned up. I understand that Woodside Homes wants to blame the homeowners for over watering and not act upon their word. This has gone on too long, the street needs to be cleaned.

Please see the account notes on the attached file. On February 4th, 2016 the account had been closed with a special cancel reason- As stated on the agreement terms, "You are permitted to cancel this contract until midnight of the 3rd operated day after the date on which you signed the contract. If within this time period you decide you want to cancel this contact, you may do so by notifying the CLUB by any writing mailed or delivered to the CLUB at the address shown on the contract, within the previously described time period."Anytime Fitness waived that clause on the agreement because of the lack of communication of the Personal Training and Club.
The gym did not deceptively tell Mrs. [redacted] she was required to do the cancellation at the gym. The reason we ask for the member to come to the gym is to provide both parties a receipt of cancellation by filling out the form at the gym. The reason for this practice is to avoid any chance that the cancellation letter sent via mail would possibly get lost and the cancellation would not go through. By us asking the member to fill out the form in person provides the assurance it will not get missed and to provide a receipt of cancellation (which I believed she turned down.). Again, we try to go above and beyond to accommodate any member with this policy to prevent any potential miscommunication or potential loss of a mailing. Unfortunately, this has occurred over years with members "claiming" they dropped off a letter or mailed it to us when we know it just wasn't true by means of our security cameras and check in system. We are sorry she feels that we purposely delayed this process with her to gain another payment but it just isn't true. Again, she even could have called us back and told us she couldn't make it in the staffed hours we provide and we could have had someone stay a little later to get the cancellation done sooner if it was going to be such an issue.
I am rejecting this response because:I have an original copy of my agreement with the Folsom Branch attached. I will agree that it does say that if I were to primarily use another branch my membership would transfer to that branch. However, it does not state that I would be bound by a new contract or different terms and conditions upon that transfer. It is also clearly marked that I signed up for a single month a time usage and was Paid in Full for that month and each month thereafter was under those same terms. I do not read anywhere that I gave permission to have my account charged as I did not sign up for a contracted membership or payment plan for any allotted period beyond the single month.
