office with the intent of cancelling her membership. Her stated reason was that she moved. Per her report, the club is not convenient to her place of residence or work, and that because of the distance, she does not have time to use the club. We mapped out the distance of her new address, and found that her new residence was within the radius on her initial agreement, making the member ineligible to cancel within the term of the original agreement.At the time, we discussed the option of transferring her membership to another individual (friend, family member.) This is an option that we offer when a member is ineligible to terminate the membership agreement early. We also gave the option of transferring to a new dub, which is opening soon and is actually closer to the member's new residence. Again, though, the member still lives within the assigned radius of her agreement for the original club. Of note, the member appeared disappointed, but not upset, when she left the office.We received an email from Corporate regarding the member reaching out to them. Corporate let us know that the member told them that she could not afford her membership. It was explained to Corporate that the option to transfer the agreement was given to the member, given that inconvenience and time were the reasons given to want to terminate the agreement early. We did tell Corporate that in times of financial hardship, we are willing to freeze a membership for one month, in order to give the member time to catch up, financially. Generally, when we freeze for financial hardship, we ask that the member come back in a month to discuss the financial situation again, to try to get back on track with the membership agreement. If necessary, we continue a billing freeze for financial hardship up to 3 months. The expectation is that the member communicate with us through the process, as the agreement continues to ultimately be their financial responsibility. This practice is above and beyond corporate guidelines for handling member agreements.We called the member in question and left a voice mail regarding her second option. We did not hear back from her.All of our memberships are presented as one year agreements or two year agreements. This is discussed at length with each member when they sign up for the membership. Our price presentation is detailed and clear. Our membership cancellation policy is clearly written on our agreements. Memberships can be cancelled early, due to documented medical or relocation reasons. We always try to work with members for the best solution. In this case, early cancellation is not an option. account. I have attached multiple documents including the signed membership agreement, as you can see Mrs. [redacted] initialed and signed all required fields including opting into the auto renew program. This program ensures the membership will stay at the lowest rate we offer ($29.99). Furthermore as you can see Mrs. [redacted] was made aware of the auto renew program again in April/March of 2017. She was given contact information of our financial institution, ABC Financial to complete the turn off of the auto renew, and to discuss the cancellation of her membership.When Mrs. [redacted] came into our club location in April/March of 2017 to discuss these options she made us aware she was interested in cancelling due to moving out of state. In the agreement terms of our membership if there is a club location less than 25 miles away from the new residence the member is held responsible to the contract. Originally Mrs. [redacted] stated she would be moving to Sunrise Florida, our Club Director looked up the location, and found there were 7 locations less than 25 miles away (4 are less than 10 miles away). This would mean she is held to the contract she signed. Upon receiving the Revdex.com complaint I see Mrs. [redacted] listed a different address. I looked this up, and there are 13 total locations that are less than 25 miles from the current residence (3 are less than 10 miles away).Our Club Director made Mrs. [redacted] aware we do not handle these requests at the club level, she was then given the proper contact to complete her request. Mrs. [redacted] never contacted our financial institution, as you can see in the attached document. I have contacted ABC Financial and turned Mrs. [redacted] auto renew off, so she will not continue on a month to month membership with us come her renew date (8/2018). Unfortunately Mrs. [redacted] must contact ABC Financial to complete her cancel request, this is not anything we can handle for her. All terms she was previously provided still hold true i.e. she must provide a 30 day written intent to cancel (an email will suffice), and the account must be current. We will not be refunding the requested amount of $160.50 as this was not a mistake or neglect on our end.Please let me know if you need any additional information from me. I've been a member since day one at this fitness center, and they truly care about us (their members). I have always been ask or fan of excellent customer service, and I feel I've received top-notch service from this business. Kudos to them and their staff for providing that personal touch that most businesses lack in today's face pace world.

Tell us why here...We refunded the member ([redacted]) his $58 via a credit card refund. This is the way he paid so now it is just a matter of the credit company processing the amount back to his card. We have done everything on our end, he has a copy of the receipt as well as we do stating $58...

[redacted] doesn't owe us money, he has never been sent to collections, we canceled his account and refunded his money, he is handy capped and doesn't understand.  His account was canceled do to violations of club rules.

we have no problem honoring his attemt to cancel  when he says he came in  however   our contract month to month states  that we still require  a  30 day notice to cancel  therefore he is still responsible for his last payment of $45  Im surprised [redacted] made a complaint with you guys  and never even called me or brought this to my attention...   He is a very nice guy  our whole staff  got a long with him

I am rejecting this response because:That section of 30 day notice was not explained I did initial but for something else that I was told apparently. if I had known of the 30 day notice I would of sent it in as I knew I was moving the end of March why would I pay for 2 more months knowing I was not going to be in the city?And yes I should of read the whole contract before I signed but like I said many people sit there and listen to salespeople go over contract so we the buyers thinking you are being honest and explaining everything in the contract so we dont have to sit there and read word for word. I know better next time to excuse my self while I read word for word before I sign.

We reviewed the customer’s account
and spoke with the Manager of the gym and found that the customer had
not initially paid the total amount due to cancel. When...

contacted,
the customer agreed to pay the remaining balance of $15.00. The
remaining balance was to be scheduled to be drafted, however this was
overlooked, and according to the customer’s complaint, they assumed
we had waived this remaining balance for customer service reasons. As
the remaining balance was not collected, we drafted a letter to
inform the customer that the remaining balance was still needed in
order to close his account.
When we received a complaint, we contacted the customer in regards to
his concerns and found that he did have correct cancellation
paperwork which indicated that he still owed the $15.00, but since we
had initially scheduled a payment for cancellation that was $15.00
less that required, we waived this final balance. In speaking with
the customer, we apologized for the miscommunication that occurred
and provided him with a written copy of his membership cancellation
from our billing company, as well as email confirmation that he no
longer owed additional fees to cancel his membership, as he had
requested. The customer was happy with this outcome, and we were
happy that we were able to help him resolve this issue.

I am rejecting this response because:
I find it interesting that he says they clean fans every 3 months as when I brought this issue to him, he said they clean them in the summer unless it's brought to their attention that they are dirty. I do not like being called a liar. Especially now that a complaint was made and miraculously things are being cleaned more often. Also, every gym I've been to has signs (for instance the local YMCA) that ask people to limit the use of perfumes and colognes. You can stop by and see for yourself. Im not asking for much, just common courtesy to post a sign asking others to be respectful. I'm not sure when his response was made, but the machine has still not been delivered. Also, when I made my complaint to the Revdex.com, our yearly fees suddenly went from yearly to bi-yearly. Over the past couple weeks I decided to return to the facility as I can only workout on my lunch at work and this is a block a way, no other local gyms; but there have been multiple machines "out of order". I want to be able to workout without issues and again, am not asking for much. The least someone can do when they take your money monthly is try to help you out in every way possible.

You're coverage told me that I would not be charged and if I was it would be fully refunded. I would not make this up as I am CEO of my own business and have had employees make mistakes, but when they do I pay the price. I honor the word my employees gave to my customers as that is how it works in the business world. I have no desire to be at Anytime Fitness anymore, so giving me access to the gym for the next 29 days is not what I want.  As I stated I used the funds to open a new membership 2/4/16 after meeting with your coverage and hearing my membership would be cancelled that day and I wouldn't have to pay. Your gym doesn't compare to my new gym as 1 of the 2 stair steppers was broken for over a month. What are my fees even going to since it clearly isn't maintenance? Maybe your vacation.. Anyways, you should have to pay for your employees mistakes just like any other business would. Sorry that you were gone at the time and came in and she didn't know what she was talking about but that should be on you, not me.

To whom it may concern, I sent in a prior complaint to Revdex.com. See the information below. [redacted] responded to Revdex.com but lied in saying he refunded my money. He never has even offered that and I have emails to prove this. Furthermore, the voicemail that he left me was completely unprofessional and his displeasement with me and the Revdex.com complaint was clearly expressed. He continues to be unprofessional. He broke his contract and will not see this. Should this not be resolved properly with the Revdex.com, I will have to take further steps in getting this contract cancelled. I believe [redacted] has broken his legal contract with me by taking funds from my account on days not previously agreed upon. Once is a mistake, twice then he needs to be held responsible for his inconveniences to his clients. Please see below information and if you would like to see the email discussions between [redacted] and I, I will be happy to submit them to you. Previously submitted complain to Revdex.com: On April 15, I had contacted via email the owner, [redacted], of my Anytime Fitness Club in [redacted] to inquire if a scheduled payment could be changed from April 20 to April 25. I did not receive a response so I emailed again on April 18 and was told by [redacted] that it would be no problem. I have all of these emails saved as I always prefer to have my financial obligations in writing. Furthermore, I work long hours as a nurse and email seems to be the best form of communication for me. On April 20, my account was charged and I received a 25$ over draft fee. I questioned [redacted] about this and he then told me it was too late of a notice. I am upset that he could not have told me this during our conversation on the 18th. When I explained my frustrations, he offered no refund for the 25$ even after I asked if it could be taken off my next months bill. All he wanted to do was have me come into his office to speak with him because he is "owner and manager and wants his business to grow." He offered free training sessions which I have declined several times as the employees in this gym are very pushy sellers. I explained several times that I am unable to come in during employee business hours as I work long shifts as a nurse, which is why I typically attend the gym late in the evening. [redacted] assured me that my account was changed and my payments would be changed to be taken out on the 25th of every month. I was understanding at this point because mistakes happen. Then on May 20, my account was charged again for my membership fee. I did not account for this money to be taken out on this date and the fee took the remainder of the funds that I had in my account. I got paid on May 23rd in which I budgeted my membership fee to be withdrawn as previous agreed upon with [redacted]. For someone who lives off a budget, having scheduled dates is an important factor. As a result of this early withdraw, I was unable to take my daughter out for her graduation dinner. When I tried to explain all of this to [redacted], he did not offer anything other than free training sessions. I told [redacted] several times that I felt uncomfortable with training sessions and did not feel that it was the best option for me. Every time I or my friends enter his gym, we are bombarded with trainers trying to sell their training. I understand this is a business and selling is what is necessary but constantly questioning, emailing, calling just becomes too much. This overkill pushes my interest in a personal training session and made me not want to come in when I know trainers would be in the office. Due to these concerns I have with the Anytime Fitness club, I have revoked my automatic withdraws with my bank. I have the same request to you that I did for [redacted], I now want my membership cancelled waiving the $199 cancellation fee. I believe [redacted] has broken his legal contract with me by taking funds from my account on days not previously agreed upon. Once is a mistake, twice then he needs to be held responsible for his inconveniences to his clients. I do not feel comfortable going into the gym anymore because this environment is beyond untrustworthy. I have also tried going to the gym in Mesa and selling is the same there. I will not return to this gym and would not refer anyone else to join either. I appreciate your time and consideration in this matter. You’re probably having to struggle paying for a gym membership that you do not use. I do understand that. That’s what you sort of just said to me. SO I do not know how to deal with this but YOU ARE in a yellow member. I just realized that you did cancel your credit card. So WE HAVE to deal with this because you WILL get sent to collections. I actually gave you a chance to take an opportunity for some personal training that I was offering as well. That’s $100 right there so I really don’t understand where you are coming from. Thank you.” My response to this voicemail: I did not call [redacted] because I want everything in writing with this man. He has already shown his dishonesty several times. I would just like to reiterate that I was not charged a late fee from my bank. I was overdrafted. He never has offered to refund my overdraft fee even after several times I asked, I was still declined. I am even more upset and disappointed that he lied to Revdex.com saying that he refunded me the money and that this matter was resolved. It is far from resolved. Unfortunately, if I cannot get my membership cancelled, waiving the $199 cancellation fee, I will have to take further steps to get this resolved.
