Hi [redacted]... Thank you for bringing this to our attention - I have notified the collection agency again and informed them that we need to remove your account from collections as you have resigned with us under our forgive and forget policy. We have let them know this morning and this should be resolved...

this week. I am sorry for the delay ... I do not know why it was not pulled earlier but we are following up on it to resolve the issue as soon as possible. Thank you again. We will make sure that this is listed as Account error so that it has no affect on your credit.  [redacted]

We sent the responses to [redacted] Offices, both [redacted] and [redacted], they were identical, we explained in the letter that she was not in collections she had the option cancelling per the terms of the agreement, she didn't agree with them, and we gave them the option of cancelling. She agreed...

to pay the amount we stipulated for settlement, she paid the amount via credit card next day. Then I emailed the entire chain of emails, forwarded to representative of [redacted] name was [redacted] and let them know that the same situation was resolved through mediation with the [redacted] Office in [redacted].

[redacted]Per the contract, [redacted] must provide to us written proof of her new address - such as a utility bill or a driver's license.  We can then determine if there is a CLUB within 30 miles. Should there be a club within 30 miles, her membership will then be transferred to that club in accordance to her agreement. If there is no club within the 30 miles of her new address, we can then charge her a $** fee and terminate her agreement. Thank you,Anytime FitnessClub Manager

Ms. [redacted] joined our Anytime Fitness club Aug 23 2016. The agreement was an 18-month agreement with all the standard membership requirements. As a courtesy to this member, on October 5, 2017 we canceled the membership early without any of the agreed upon early termination fees. This action taken on...

our part was at a cost to the business exceeding $200. The $29.99 July fee referenced in your letter was a Club Enhancement fee Ms. [redacted] agreed upon in the application process.

Revdex.com:
I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # [redacted].
The sad truth that your members can be treated this way because of feedback and opinions is alarming and is something the Anytime Fitness Corporate and others should be made aware of. Please be advised that I have made  suggestions to the club manager and owner in the past stemming about a half rack, 2 times to [redacted] and once to [redacted] in person and they both happened in April 2017. Neither the manager or owner ever responded directly to my suggestions or at the very least give me a reason for not being able to add weight lifting equipment.  Member are allowed to speak to one another about whatever they please. Anytime Fitness allegedly welcomes feedback, but when an the feedback is critical the owner decides to retaliate against their playing customer. For the owner to call me "self entitled" and indicate that I behave childish is disappointing to there is no need to name call, but I guess that is the type of business man that [redacted] is. I wanted to settle this dispute in a professional manner which is the owner is not willing to do. The owner had the power to allow me present my case before terminating my contract or at the very least bar me from his business and allow me to continue my member at AF another location. The inevitable truth is that [redacted]/[redacted] cornered me and indicated that they would reactivate my card if I took down my [redacted] review. Knowing that this is inappropriate behavior, they have decided to backpedal and conclude that I was "not happy" at the location and I was not a "good fit". [redacted] will argue that my reviews and feedback from September 5 have nothing to do with his decision, but why would he terminate my contract 2 days after receiving the review, which was sent from the corporate level. If [redacted] has been supposedly dealing with my disgruntled mood for over a year, why didn't his manager [redacted] advise not to sign an extension with the club, or at least sway me to join another  location? I continue to contest [redacted]'s decision because it is baseless and without moral merit. Should [redacted] prefer to settle this dispute, he should at least consider reactivating my account and transferring me to another home gym and allowing me to continue working out at the same rate which I signed. This way I would be able to continue working out without having to pay a initiation fee at another AF location.  Regards
[redacted]

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
The responses do not address my complaint nor the emails that were sent regarding canceling for half the dues owed- please see attachment of email from [redacted] stating I could pay half my dues and terminate my contract early. The gym has failed to terminate my membership and have continued to charge me monthly despite asking to terminate over one month ago.
Regards,

I am rejecting this response because:
There is no resolution, I don't see a point of where I have to pay for services that I do not use, I don't mind paying for the amount that I owe which is up to the date 6/13/16 including a cancellation fee, but I will not continue the membership.

[redacted]   I have attached the notes from this member. He was an acquaintance of the manager and tried to...

illegally transfer his membership from another club and cancel it. His transfer went through on 9/30 and with the 30 day notice he was charged for September and October. He tried to not pay those. The September dues went to his original account and October were per the 30 day notice he agreed to. We were not the original location he signed the agreement at.      11/28/17 12:51:53 PCS PENDING CANCEL STATUS WEBAPP 11/28/17 12:51:53 [redacted] CANCEL CODE: AAA WEBAPP 11/28/17 12:51:53 [redacted] PCA:.00 WEBAPP 11/28/17 12:51:53 [redacted] CANX FEE: N AMT:.00 DATE: 00/00/00 WEBAPP 11/28/17 12:51:53 [redacted] PCD: 11/29/17 WEBAPP 11/28/17 12:51:53 [redacted] TEXT: WEBAPP 11/17/17 17:01:21 CR1 First Customer Call LR1 11/17/17 17:01:21 CNX CALLING REGARDING A CANCELLATION LR1 11/17/17 17:01:21 [redacted] MEM CI STATED HE CANCELLED AT THE CLUB A LR1 11/17/17 17:01:21 [redacted] DV MEM NO RECORD OF CNX LR1 09/25/17 09:25:11 RCD C/S/Z-CHERRY VALLEY /IL/61016- CASS 09/22/17 12:43:13 CHG Member transfer email sent. RE: Case # [redacted]
Dear...

Ms. [redacted]
Former gym member Gio [redacted] signed up for a membership at Anytime Fitness, Riverwalk on April, 23 2014. At the time, Mr. [redacted] was not yet eighteen, so his mother [redacted] signed the twelve month contract on his behalf.
On February 28, 2015, Mr. [redacted] came in to freeze his membership, which allows him to temporarily put his membership on hold and not make monthly payments, for six months, free of charge. Mr. [redacted] failed to mention to his mother that he had frozen his account and told her instead that he had cancelled his membership. We do not provide reminders to our members when their memberships are no longer frozen, so starting from August 28, 2015, Mr. [redacted] was billed monthly for his membership again. He was billed for a total of four months ($120.00) until Mrs. [redacted] took action to ask for an unjust refund of the money.
On December 14, 2015, Mrs. [redacted] came in to cancel her son's membership, even though Mr. [redacted] is now eighteen and per our company policy is supposed to cancel his membership in person himself. She demanded a refund for the $120.00 owed on her son's membership even though I explained to her that the membership was never cancelled and she was therefore responsible for the fees for the remaining two months of the 12-month contract that she had signed, as well as the additional two months that have passed before she cancelled. I told her that I have no problem refunding her $30 for the last month since she came in before our monthly cancellation deadline, but I cannot refund her the remaining $90.
Thank you for your attention.
Sincerely,
[redacted] Gym Manager

Initial Consumer Rebuttal /* (3000, 11, 2016/01/11) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Just like any other young adults, my son is truly not responsible enough with his own actions but he's not a liar like what you're trying to imply. I am fully aware his membership is frozen not cancelled. I reviewed the contract once again and found nothing about the six month account freezing policy. Anytime fitness can keep the payments for two months to complete the one year contract. I need $60.00 refund and I'll get over the rudeness that I had experienced dealing with Anytime. Thank you

Final Business Response /* (4000, 13, 2016/01/22) */
Mrs. [redacted], we are in no way implying that your son is a liar. You are right freezing a membership is not part of the contract or its policies because we offer our members this option as a courtesy service. We will gladly refund you the $60.00 and sincerely apologize for the inconvenience. You are more than welcome to stop by for the refund.

I completed a tour. It seems like a nice gym. However a red flag went off when I did the obligatory sit-with-the-manager to learn of the "special promotions" only available if I signed up right then. I asked for a copy of the lengthy contract so that I could take it home and review it. The manager refused to let me take one. Instead, he promised me I would get a copy when I signed up.

I still might join, but only if I can get a copy ahead of time. I fundamentally distrust any company that won't let me read and study a contract before signing up.

On the date of 3/19/2015 I visited Anytime fitness to enroll in membership, the gentleman that was assisting me( Brad s[redacted]) was very rude and not helpful at all. His attitude towards any questions I had was unpleasant and rude. My experience with him was so horrible that I lost sleep at night. What really shocked me is that he is the owner of the establishment so I couldn't even speak to someone else to rectify the situation.

This particular member has been an ongoing problem for 2 years I have owned this club. He has constantly harassed other members even going out of his way to disrupt them. He also has not been re-racking his weights or equipment used. We have approached on multiple occasions about both problems,...

especially the harassment of other members. We have him on video also because being a 24/7 facility everything is recorded for security reasons. When we talk with this individual about these occurrences he will change his behavior but only for a short amount of time then he falls back to his old ways. We, the staff, have been warning him that his membership will be canceled and this last occurrence was the one that made us good on our promise to cancel. Anytime corporate also received a complaint from this ex-member, I explained the situation, and it is well within our rights  to cancel his membership it is also included in every contract. We have reviewed the letter concerning the member’s son. Both members have the ability to cancel their membership, as we havecommunicated this multiple times. your reference, details of the offer I reviewed appear below.I cancelled my membership on 1/21/2016. For them to say they cancelled me out is a complete lie. For their many attempts, they called once after I dropped off my key fobs and cancellation letter.

The member ([redacted]) was in a 36 month contract that would not expire until 3/17/2018. She sent an email on 4/29/16 asking to cancel her membership sating she was no longer interested. She did not indicate any other reason, such as medical. Per the cancellation policy all request are subject to...

approval & are processed within 30 days with receiving of proper documentation of medical or relocation paperwork or 1/2 the balance is paid. Proper documentation in this case was a doctor's note and was not received until 6/18/16 at 5:25 pm, after office hours. The account was cancelled immediately on 6/19/16. All monies that were charged were prior to receipt of proper documentation.
