[redacted] enrolled into a Personal Training membership on 5/**/17. There is a 3 month commitment period. [redacted] requested to cancel on 6/**/17. There is a 30 day notice of cancellation, therefore the effective date for cancellation was 7/**/17. [redacted] paid $380.00 for four sessions on 6/**/17. [redacted]...

was also charged a $150.00 early termination fee for cancelling within the commitment period. We reviewed this matter and as a goodwill gesture, we provided a refund for the $150.00 cancel fee. All terms are valid and we would not provide any further refund.

 I have NEVER stepped foot into this facility to provide ANY information. This is Fraudulent, which is why THEY cancelled the membership ON THEIR OWN IN MAY while I only got the collections call in AUGUST.  I've immediately called the gym, who has no idea who I am because I've never been in the gym. I've never even received a single piece of mail from this place. I also have recorded conversations with Patrick Hagerdy, who supposedly SIGNED ME UP IN PERSON, and he states he did not do this and HIS LOGIN was used by someone else at the gym to sign up my information because he does not deal with sign-ups. He further stated that he sees a fake credit card was used to create my account (i've never actually been charged so im NOT asking for a refund) and that he would remove the charges from collections and call me back. He never called back and I called back myself and spoke with Laurence S[redacted], who explained to me that Patrick is "miraculously" no longer working with NYSC (!!!) and that he sees this account is NOT REAL becauseI've never been there. He then emailed me confirmation of removing me from collections. (this conversation is also recorded). what I WANT is to protect OTHERS from this fraudulent activity and DEMAND that they clear my issues with collections immediately.

On November [redacted] a $120.00 credit was applied to [redacted]'s membership for future billing. On November [redacted], the additional $60 in usage fee billed to his credit card. On December [redacted], his dues were not collected by credit card but were paid via the credit posted on the [redacted] of November, reducing the original credit to $83. The on December [redacted], we replied to this Revdex.com inquiry and another $60 credit was applied in response to the November [redacted] usage fee billing. The member currently has $143.00  in credits on his account, which will cover his monthly dues billing in full for January, February, and March, as well as a reduced amount in April 2018.

We apologize for any inconvenience. Shawn enrolled on 5/**/15 with a Premier membership. The membership cancellation terms are as states: Your cancellation will be effective on the first day of the next billing cycle and you will continue to have services provided under this agreement until the end...

of the billing cycle in which notice is given. You understand that if you cancel your membership, you will be charged a cancellation fee of $29.95". Our billing cycle begins on the first of every month. The member placed a request to cancel on 5/**/16, therefore the cancellation was effective 6/**/16. The member was billed on 5/**/16 for $19.95 for access for the month of May. Since the Annual fee bills every year on May [redacted], the member was billed the $49.95 Annual fee on 5/**/16. The $29.95 cancellation fee was billed on 6/**/16. All fees are valid and there is no refund warranted. If the member wanted to avoid the Annual fee, the cancellation would have needed to be requested in April.

I sincerely apologize for any frustration regarding resolving this matter. To clarify, members are contacted by email from the first month of defaulted payment. The email we had on file was a hotmail and not the gmail enclosed in this complaint. Members are provided a notice that payment was not...

received, a second email- that we require payment and finally an email that the membership will be cancelled if the balance is rectified. After cancellation we wait another 30-45 days to allow members to resolve their balance directly with our organization prior to providing their data to collections agencies. Our records indicate that the issue has been resolved and no further money is owed at this time.
