I write in regards to the above referenced complaint submitted to your office by [redacted] We regret any confusion or inconvenience she experienced when doing business with our company and trust that this letter will address her concerns.    Our records show that on November...

14th, 2016, after making an online purchase on [redacted], [redacted] was presented with an ad banner promoting our [redacted]. Ms. [redacted] clicked on the banner and arrived on our order registration page, which provided full details about our money saving membership program and how she can try the program at no cost for 7 days.  The terms on that page, titled “Offer Details,” explained that if she did not cancel her subscription by the end of the trial, her subscription would automatically continue and the monthly subscription fee would be charged to the credit card account that she provided.    Our records show that she completed the registration process by providing her full contact and account information and checking a box that states “I agree to the Offer Details and the Terms of Use & Service” just below the offer terms. Shortly thereafter we sent [redacted] a welcome e-mail to the e-mail address she provided upon enrollment that included full information on how she can access and enjoy her program benefits and reiterating the program billing terms.    Ms. [redacted] contacted us on 11/21/2016 to cancel her account and we did issue a full refund of $9.97 back to her at that time.  That should have posted to her account, if not please let me know.    Again, we regret any inconvenience this may have caused [redacted]

Hi and thank you again for allowing us to respond to this complaint. I did check into [redacted] account and again confirmed that these were the purchases of gift cards.  When [redacted] sent us his documentation we did see that there were [redacted] gift cards, [redacted] gift cards, [redacted] gift cards and [redacted] gift cards.  While the [redacted] card is a prepaid card it is also listed on the order confirmation as [redacted]  This is signifying that this is, in fact a gift card. Please let us know if you have any questions on this and I'd be happy to explain more. Thanks!

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me., but would like further action from the website to make it  more clear to its customers that high volume. There's no way for them to easily know that high volume orders are prohibited from wholesale websites like [redacted] and other smilar websites. It should have some kind of clear notice when it's customers chose to use those wholesale websites. Some items on these websites can only be ordered in large amounts and still find the marketing very misleading when you have to go read through the all the pages in the terms of use. I ask that you take steps and make this clear to future customers.

Hi – thanks again for allowing us to respond to this complaint. Your account was cancelled as soon as it was located.  We apologize we did not find this account sooner, however once we had it was cancelled immediately and you should have received an email explaining why this was cancelled.  We do try to let our members know who are misusing our program as soon as possible, however some accounts are not found right away.  It does state in our terms which you must agree to that there is only one account allowed per household, whether cancelled or active.  If you would like to sign up again you must contact us so we can reinstate your account for you. I hope this has answered your 3 questions and we apologize for the inconvenience that this has caused you.  As a courtesy, I will process up to $1000 of the cash back that you had gotten in your account.  I hope this will rectify the situation and we can resolve this complaint. I am rejecting this response because:First, purchases were not for commercial purposes. Second, it is not the consumer's responsibility to determine what the portal tracks and what does not. The business is basically collecting commissions from the retailers, terminating the member account and then pocketing the left over commission.  Lastly, the account had an annual limitation of $1000 payout. There is no way to exceed or abuse this limitation. The only abuse here is Clarus Commerce abuse of their customers by flimsy terms and conditions.

I am rejecting this response because: It's a ploy to get people to respond to the pop up ad thinking they are getting a deal or a benefit from responding. They call it a rebate program, but you have to pay monthly for it. Deceptive advertising is what it is plain and simple.

A review of our records shows that [redacted] registered for at
least 8 different [redacted] memberships from 2012 through 2014. She
registered for four separate memberships in 2014 where she submitted and...

payment for numerous claims totaling $462.53
 
Our Terms of Use clearly state that there is only one membership
allowed per household. I have enclosed a copy of those terms for you and Ms.
Bowers review. Because these terms were violated [redacted]s account was
cancelled and is not eligible to be reinstated.
 
[redacted] may go ahead and cash the check for $24.50 that she
received.
 
We respectfully believe that based on the violation of our Terms, that
[redacted] is not eligible to receive any additional compensation.

Ms. [redacted] joined our membership for a 30 day free trial.  When filling
out the registration form, full details were provided about the membership
program and how she can try the program at no cost for 30 days.  The terms
on that page explained that if she did not cancel her membership by the end of
the trial, her membership would automatically continue and the monthly
membership fee would be charged to the credit card account that she
provided. 
 
Ms.
[redacted] submitted a rebate for her purchase from [redacted], that
check was sent out on 1/21/2015. 
 
I
do see that Ms. [redacted]’s account has been cancelled and issued one monthly
refund.  As a courtesy, I have issued a full refund to the account. 
Please allow 2-5 business days for that to post to your account.
