I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below.I have not admitted to making any mistakes in this matterI told them exactly what I would be putting in the dumpster, but the materials they listed in the contract were not even close (other than dirt)I told them I was doing a patio paver project at my homeWhy would they even list concrete, block, brick and asphalt when I stated that I would be putting sod, dirt, gravel, and sand in the dumpsterWith all materials mentioned being of the earth, it shouldn't matterI find it hard to believe that some how sod and sand contaminates dirt, block, concrete and brickAlso, they still do not admit that no where on their website or their contract do they mention that if the dumpster is deemed mixed material, you forfeit your ton weight limit and are reduced to tons and charged $extra per tonI don't care who's policy this is, theirs or the landfill, it should be mentioned on THEIR website as the customer has no idea what land fill they take the dumpster to or the landfills policiesThis is a shady business practice that in my opinion probably effects alot of their customersAs far as being paid in full, the customer has no choice but to pay in fullAs part of the terms of service policy on their website, all customers (by agreeing to the contract over the phone) also agree that Budget Dumpster is authorized to retain your debit card/credit card information for up to days for any additional chargesThey do, and will, ensure you pay in fullIt should never cost anyone $dollars to haul away a dumpster with uncontaminated dirt, sod, gravel and sand Regards, [redacted]

The claims made in the complaint are purely subjective and not based on any facts or documentationOn 8/28/at 10:am the customer scheduled a pito be performed on 9/2/Our records indicate that on 9/2/14, the customer’s dumpster was overfilled and unable to be removedWe may have made multiple unsuccessful attempts to pithe container, but the customer was only subjected to one additional fee, although it would have been valid to charge for each attemptPer the mutually agreed upon Terms of Service, it is the customer’s responsibility for any materials put inside the dumpster while it is in the customer’s possessionHere is an excerpt from the Terms of Service, which references the situation that occurred with the customer:Dry Run Charge(s): Budget Dumpster L.L.Ccharges a fee for unsuccessful container pior drop-off attemptsWhen this happens, we call this a "dry run"When a container is unable to be dropped off or picked up due to the following reasons, a fee is charged to the customerValid reasons for us to charge a client the dry run fee include but are not limited to; overloaded containers, low laying power lines or tree branches, cars or any items or materials blocking access to pick up or drop off a container, door open on a container, material heaped up or hanging over the sides of the container, containers that are too heavy to be removed, locked gates or fences, inaccessible driveways or parking lots for any reason(s) out of our controlThe dry run fee can range anywhere from $150-$This fee covers drivers pay, fuel, and time for re-routing the drivers planned schedule which takes an immense amount of work.Although the policies of our competition have no bearing on our business or this complaint, the customer is under the impression that they are differentThe dumpster companies the customer is referring to, are the same companies that we contract to perform our serviceWhether the customer used the local service directly or Budget Dumpster, they receive will essentially receive the exact same serviceThe customer is also mistaken regarding the legality of our servicesDumpsters are in fact legal in the [redacted] area, and we would like the customer to provide any evidence that corroborates the illegality of dumpstersBudget Dumpster legally operates in [redacted] , the services we contract are legally allowed to operate in [redacted] and many other businesses use a similar business model in [redacted] We have made contact with government officials in the [redacted] and they have been unable to confirm the various claims made in the complaintIn addition the [redacted] / provides dumpster rental options to area residents in their Department of Public Works section of the websiteIn regards to the blight violation, it was not a result of the dumpster rentalWe were able to access the public court records for case # [redacted] , where the customer violated code 22-2-88(b) “Allowing bulk solid waste to lie or accumulate on or about the premises.” The dumpster was not the cause for this violation and we will not be providing any restitution for violationWe made attempts to contact the customer on 9/12/14, 9/19/14, 10/3/14, 10/13/14, 10/20/14, which the customer decided to neglectThis forced us to send the balance due to the collections processThe valid charge cannot be reversed and this is considered a closed matter

There is no proof that this dumpster was mineI will continue to say this because it is the truth of the matterAs for the email with the "ticket #" I wrote your business right back to disputes this charge and have had the same augment every time but your business has nothing to verify that this was my dumpster other than this "ticket #"There was nothing on the dumpster to verify.Just an FYI, I was never told that the dumpster that I rented was able to hold tons, no one ever told me that, shouldn't that be part of the rental process? I should have been told this so I could make a well informed decision since according to you I went over by tonsYour fees are crazyIf I had a bigger dumpster and put the weight you are claiming I put in this one in the larger one I wouldn't have been charged an additional $per ton Your business is a complete shamYou should be embarrassed to rip people offPoor business skills and leave pertinent information out so you can rip off unsuspecting peopleShame on you!

We would like to apologize to the customer for this negative experienceAt the time of the order the weight limit associated with the customers dumpster was properly communicated and this information was then reiterated via emailWe understand that estimating the weight of materials can be difficult, however we did not have any control over the amount of materials that the customer decided to dispose of in the containerWhen the dumpster was picked up, it was taken directly to the disposal site where it was weighed multiple times in a state regulated weighing processIt was determined by a certified Weigh Master that the customer’s materials weighed tonsThis resulted in a charge of $as it exceeded the ton weight limit by tonsPlease consider, this is not a punishment feeWe are simply recuperating the additional disposal costs for the materials beyond tonsTo further validate this legitimate charge, we have provided the customer the weight ticket from the landfillIt is the official documentation associated with the weight of the customer’s materialsThis documentation, along with the driver’s log has been attachedCurrently, the customer has an outstanding balance dueIf the customer or the Revdex.com requires any additional information, we are more than willing to provide it in an effort to resolve this situation

There are many aspects of the complaint that the customer is not taking into considerationWhen the dumpster is picked up, it is taken directly to the landfillThe landfill, along with the weighing of the materials is a highly regulated, government process conducted by a State Certified Weight MasterThe dumpster arrives at the landfill, where it is placed on a state certified scale that is routinely checked for accuracyIt is weighed, unloaded, and weighed againThe difference determines the weight of the materials in the customer’s dumpsterThe customer’s materials weighed tons, which exceeded the ton weight limit by tonsWe have provided the customer a weight ticket produced directly from the landfill to further document the weight of the materials that the customer put inside the dumpsterAlthough we appreciate the customer’s efforts to remain under the weight limit, it is not possible that the customer utilized scales that are calibrated with same efficiency or accuracy as the government regulated scalesThe customer is arbitrarily providing a weight without any additionally information or documentationAdditionally, the customer has stated that the materials weighed a variety of different amounts, including figures that would have still exceeded the ton weight limit.We have been able to provide exactly how the materials were weighed, how much they weighed and documentation to corroborate the resultsIf the customer is able to provide any information that contradicts our documentation, we would take it into considerationThe customer referred to our business as a ‘scam,’ which is not only untrue, but also implies criminal wrongdoingsWe consider this libel and defamatory to our business and will pursue legal action if the customer continues to portray our business in a fashion that does not accurately reflect our business or the situation
