We apologize for the delay in response and have secured the supplemental documentation in addition to the weight ticket to support the overage charge. However, it has come to our attention that the customer has deemed this a fraudulent charge with its financial institution. Any future communication including the before-mentioned documentation is required to be directed to the financial institution, who will be making a determination on this matter.  Thank you.

The documentation has been resent via email and has been attached. We consider this a closed matter and do not intend on refunding the valid charge.

It is essential to address the continued defamatory statements that the customer continues to utilize. Budget Dumpster is a national, reputable brand that has never participated in lying, threatening or unethical business practices with this or any customer. The customer must consider that the Revdex.com does not have any authoritative powers to enforce Budget Dumpster to provide any financial reimbursement or mandate involvement with your complaint. We actively respond as a benefit to our customers on our own accord, in an effort to resolve issues. The customer’s situation and claims have been completely investigated. There is no evidence of threatening or even inconsistent statements in any of the email correspondence or telephone recordings. The customer is simply being provided the necessary information, if they decide to continue to disregard the mutually agreed upon the Terms of Service. We can offer this or any other documentation at the request of the Revdex.com or the customer. These records also indicate the lack of the customer’s communication and ensure that the weight ticket was sent via email to the customer successfully on 12/21/15 4:49 pm EST. As shown on the weight ticket, the information is automatically generated from a government regulated system to ensure accuracy. It also matches our records of removal on 11/25/15. To further guarantee the correctness and lack of bias, the landfill uses a variety of information such as the Ticket Number, Cr, Date, Times, and other data that when combined indicates the appropriate party to bill. It is of benefit that the name, address or other specific customer information is not displayed on the weight ticket, which in theory could compromise the results. The landfill sent the correct bill to our hauler, then a different amount was incorrectly charged to Budget Dumpster. We have apologized that the customer received the incorrect bill, but took full responsibility and corrected the issue immediately. If the customer does not take responsibility for the materials put inside their dumpster, by not settling the balance due, it will subject them to the collections process. All of the information that we have provided is based upon documentation. We do wish to continue to correspond with the customer to resolve the concerns. However, it will not be at the expense of our online reputation. We hope both the Revdex.com and the customer can take this documented information into consideration and make a determination on the matter.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.I have not admitted to making any mistakes in this matter. I told them exactly what I would be putting in the dumpster, but the materials they listed in the contract were not even close (other than dirt). I told them I was doing a patio paver project at my home. Why would they even list concrete, block, brick and asphalt when I stated that I would be putting sod, dirt, gravel, and sand in the dumpster. With all materials mentioned being of the earth, it shouldn't matter. I find it hard to believe that some how sod and sand contaminates dirt, block, concrete and brick. Also, they still do not admit that no where on their website or their contract do they mention that if the dumpster is deemed mixed material, you forfeit your 10 ton weight limit and are reduced to 2 tons and charged $50 extra per ton. I don't care who's policy this is, theirs or the landfill, it should be mentioned on THEIR website as the customer has no idea what land fill they take the dumpster to or the landfills policies. This is a shady business practice that in my opinion probably effects alot of their customers. As far as being paid in full, the customer has no choice but to pay in full. As part of the terms of service policy on their website, all customers (by agreeing to the contract over the phone) also agree that Budget Dumpster is authorized to retain your debit card/credit card information for up to 120 days for any additional charges. They do, and will, ensure you pay in full. It should never cost anyone $835 dollars to haul away a dumpster with uncontaminated dirt, sod, gravel and sand.

The customer agreed to the 14-day rental multiple times on the telephone at the time of the order. This information regarding our rental periods and weight limits are always available on our website. Additionally, the same, specific information was sent to the customer via email prior to delivery of...

the dumpster. The customer must consider that the affordable price that was paid for the dumpster rental was based upon a 1 ton weight limit and a 14-day rental period. Our business is very competitive compared to our competition in the industry in regards to our rental terms. We apologize to the customer for any inconvenience, but we have found through experience that a high majority of our customers prefer our current billing policy. The customer has paid the additional valid charges in full and we consider this a closed matter.

The weight ticket that has been provided is the official document associated with the weight of the customer materials. Please refer to the excerpt from the mutually agreed upon Terms of Service regarding the authorization of charging the customer’s credit card: Customer hereby expressly authorizes Budget Dumpster to retain your credit card information and charge your credit on a monthly basis for rental fees and all other charges to which Budget Dumpster is entitled hereunder. Customer acknowledges and agrees that such credit card authorization shall remain valid and in full force and effect during the applicable rental period and for a period of time not to exceed 120 days beyond the last day of your Equipment rental. According to our internal records, the customer has filed a charge-back for the fees in question. This matter is now between Budget Dumpster and the customer’s financial institution. If the customer has any questions or concerns, please direct them to the financial institution.

The $150 fee has not been refunded.

Per the call recording of the initial order on 1/14/16 at 4:32 pm EST, the representative clearly communicated at length the logistical concerns associated with putting a dumpster...

in an alley, as well as the Terms, if service could not be provided. Beyond explaining the Terms of Service directly to the customer on the telephone, we successful sent the Terms via email and this information is always available on our website. Here is an excerpt from our Terms of Service that references the issue in question: Dry Run Charge(s):Budget Dumpster L.L.C. charges a fee for unsuccessful container pick-up or drop-off attempts. When this happens, we call this a "dry run". When a container is unable to be dropped off or picked up due to the following reasons, a fee is charged to the customer. Valid reasons for us to charge a client the dry run fee include but are not limited to; overloaded containers, low laying power lines or tree branches, cars or any items or materials blocking access to pick up or drop off a container, door open on a container, material heaped up or hanging over the sides of the container, containers that are too heavy to be removed, locked gates or fences, inaccessible driveways or parking lots for any reason(s) out of our control. The dry run fee can range anywhere from $150-$200. This fee covers drivers pay, fuel, and time for re-routing the drivers planned schedule which takes an immense amount of work. Delivery and Pick Up of Containers / Acts of God:We make every effort possible to ensure timely and reliable delivery and pick up of containers. However, due to circumstances beyond our control,we cannot and do not guaranteedelivery times or dates. Inclimate weather, hazardous roads and driving conditions, traffic delays, motor vehicle accidents, delays at landfills, equipment failure, etc., happen occasionally and we cannot be responsible for these delays. We provided the customer, as we do all of our customers, every opportunity to avoid additional charges. When the customer called to schedule the pickup of the dumpster on 1/18/16 at 3:42 pm EST, it was communicated that service would be provided on 1/20/16. We arrived at the customer’s location and it was determined that the dumpster was unable to safely be removed due to icy conditions, which results in a $150 fee.   The customer’s complaint is attempting to pass the responsibility for the failed pick-up upon the local municipality, which would infer that Budget Dumpster is not liable. However full responsibility for situation lies with the customer, who disregarded our efforts to avoid this exact issue. Here is a relevant excerpt from an email successful sent to the customer on 1/14/16: 2. We charge a minimum fee of $150 if we cannot deliver or pick-up your dumpster for any reason(s) outside of our control, or to return and relocate your dumpster after it has been delivered. *The area leading up to the requested placement of the dumpster must also be cleared of any ice or snow.  Please consider, due to the customer not providing a clear pathway to the container, we were also negatively impacted. We made every effort to the remove the dumpster on time. Budget Dumpster cannot control the plowing of city streets, any more than the customer. However, what can be controlled is the customer’s ability to provide a clear pathway to the dumpster. As described in our Terms of Service, Budget Dumpster takes responsibility for any failed service within our control. Thus making all other external factors the personal responsibility of the customer. The customer accepted responsibility for all the Terms of Service, including the necessity to clear the pathway to the dumpster, by engaging with Budget Dumpster. This is an excerpt from our Terms of Service: By using or engaging in our service(s), you hereby acknowledge and agree to the terms and conditions below. Budget Dumpster LLC takes all dumpster orders over the phone or via our website. Therefore, we are unable to obtain a written and/or signed service agreement. For all intents and purposes regarding financial and/or legal issues, the terms and conditions found here shall constitute a legally binding service agreement and shall have the same force and effect as a signed service agreement. IF YOU DO NOT AGREE WITH THESE TERMS AND OR CONDITIONS, DO NOT USE OUR SERVICE(S). We apologize for any confusion and are very willing to provide any additional information or documentation at the request of the Revdex.com or the customer. We consider this a closed matter and the customer has paid in full. There will not be any reversal or refund of the valid charge.

We would like to encourage the Revdex.com to make a determination on this matter, since both parties have displayed a clear disagreement. The person who made the complaint has been refunded in full and we had made many additional efforts. We consider this issue resolved.

We apologize that you continue to be dissatisfied. The customer agreed to our Terms and Conditions that did not include weighing the materials on-site nor do we have the ability or give the customer the impression this service was provided. In addition, the customer authorizes Budget Dumpster retains credit card information and charge the credit for rental fees and all other charges. Budget Dumpster is a reputable, national brand that does not engage in any unethical activities as the customer has implied. Unless the customer has some documentation, we would appreciate unsubstantiated accusations to stop. In regards to the weight ticket. This is the official documentation associated the materials disposed in your dumpster. It is not a standard industry practice to provide an itemized list of materials that were disposed. The call recordings from your rental have been made available, please consult these at your earliest convenience.

After I was asked what I was placing in the dumpster I was advised that the smallest dumpster would be appropriate. As a consumer who has no knowledge about dumpsters I should be able to take your employees advice as to which dumpster is the best for my needs. As for the ticket that is a number on the sheet from the weight station not anything on the dumpster. How can this ticket be verified as my dumpster? There is no proof that this dumpster was mine. I will continue to say this because it is the truth of the matter. As for the email with the "ticket #" I wrote your business right back to disputes this charge and have had the same augment every time but your business has nothing to verify that this was my dumpster other than this "ticket #". There was nothing on the dumpster to verify.Just an FYI, I was never told that the dumpster that I rented was able to hold 10 tons, no one ever told me that, shouldn't that be part of the rental process?  I should have been told this so I could make a well informed decision since according to you I went over by 4 tons. Your fees are crazy. If I had a bigger dumpster and put the weight you are claiming I put in this one in the larger one I wouldn't have been charged an additional $90 per ton. 
Your business is a complete sham. You should be embarrassed to rip people off. Poor business skills and leave pertinent information out so you can rip off unsuspecting people. Shame on you!

Although he did admit that they have absolutely no information linking my debris to the landfill ticket he also absolutely did not care plan and simple. Budget got a bill from the landfill and no matter who the bill actually belongs to if anyone, it appears that no matter what precautions you may take to avoid being billed additionally by them because of their completely flawed billing system they can randomly stick anyone with a bill with very little recourse once they have your banking information. This is by far the most helpless and demoralized I have ever felt or dealt with, and even went as far to actually tell me "when we take you to court the judge is just gonna look at the weight ticket without any question and award them the money we are asking for" and that "the Revdex.com is gonna side with us no matter what" I cant put into words how terrible of an experience this has been for me to deal with. I don't normally use companies without looking at the Revdex.com reviews/complaints, have never rented a dumpster before, but a few weeks prior we had just had a Hurricane tear off our roof and there was more rain headed our way and they were the only company in the city that would have dumpster delivered the next day the other companies were booked for at least 2 weeks out, but unknowingly to me at the time there was probably good reason why they had plenty dumpsters available. The salesperson (Robert) and the weight calculator on the website really did their job of putting up the veil and assuring me my debris wouldn't be over weight.    assist us in bringing this matter to a close, we would like to know your view on the matter.]

customers are subjected to a $150 fee for failed delivery for reasons outside of Budget Dumpster’s control. Here is a relevant excerpt from the Terms of Service: Dry Run Charge(s): Budget Dumpster L.L.C. charges a fee for unsuccessful container pick-up or drop-off attempts. When this happens, we call this a "dry run". When a container is unable to be dropped off or picked up due to the following reasons, a fee is charged to the customer. Valid reasons for us to charge a client the dry run fee include but are not limited to; overloaded containers, low laying power lines or tree branches, cars or any items or materials blocking access to pick up or drop off a container, door open on a container, material heaped up or hanging over the sides of the container, containers that are too heavy to be removed, locked gates or fences, inaccessible driveways or parking lots for any reason(s) out of our control. Despite the fact that the customer was deserving of a Trip Fee per our Terms of Service, we decided to act on the best interest of the customer. We did not immediately charge the customer and returned to the location with a smaller truck. Unfortunately even with the smaller truck, the location did not provide enough space to safely deliver the dumpster. This 2nd failed attempt resulted in the $150 fee. The fee was not a result of cars, or even the first attempt, it is a result of the customer not providing enough space to maneuver and safely place the container on the property. We hope that the customer can consider that this is not a punishment fee, but rather a recoupment cost to cover the time and money lost associated with a failed delivery. In addition, the customer is only being subjected to 1 of the 2 failed deliveries. We appreciate the customer’s feedback and business. The customer has paid in full, we consider this a closed matter and will not be providing a refund reversal. However, we are willing to provide the customer and the Revdex.com additional documentation at their request.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Budget Dumpster has insinuated several times that we are lying, and are now stating that I admitted that we were not ready for the dumpster pick-up on our scheduled day, which is a flat out lie from them.  I was totally ready on the SCHEDULED day of pick-up, in fact I got up super early Friday morning and worked all day to clean out our storage.  At the end of the day I was covered in dirt and did not smell very nice at all.  I then opened up our 2 large gates with a smile on my face knowing that I was ready (what BD doesn't know is that I am a stickler about these things)! ALSO, there was never any confusion on my part about anything EXCEPT when I had to get my husband involved because of Micheal's domineering, rude communication with me.  I am not sure if he felt that he could speak to me that way because I am a woman or because I am a minority(when I was trying to explain that I have no reason to lie and that these were facts, he aggressively told me "Stop it, Denise, just stop it"! among other things), but that is the reason I had to get my husband INVOLVED in the first place.  I was trying to get the matter taken care of on my own, but the confusion occurred when my husband thought he had talked to Budget Dumpster but had spoken with Minh at 7 Day Dumpster who Budget Dumpster contracts with.  I sent an email explaining that to Michael the same day he spoke with my husband.  ANOTHER important fact is this:  Because neither company is taking responsibility for the charge (I have had to go back and forth talking to each one), EACH one claims that it is the other company that must waive the fee and when they do the other will waive it, Minh made me aware that Budget Dumpster is charging $150.00 and they only charged them $75.00.  Michael at Budget Dumpster tried 2 times to offer us the option of paying half of what they were charging $75 (unaware that I was aware of his 100% mark up), however we do not owe them any more than the $424.00 that we originally paid because we were ready on the scheduled day, and 7 Day NO-SHOWED.  As stated previously they refused to question their driver because they did not want to OFFEND him.  These companies have done this to others, and the amount disputed of $150 is not a lot of money, but it is the principal of taking advantage of customers that greatly disturbs me.  I have learned a hard lesson through all of this, and I was hesitant about giving my credit card number to an online company in the first place.  I will never make this mistake again!  I am a teacher, I taught Sunday School for many years, and I pray every morning for God's Grace and help to always do the right thing!  I am not saying that I am a perfect person, but I am saying that I do my absolute best to live an ethical life.  I believe that we will reap what we sow, and any company or person that makes a living cheating others will not be in business for very long.

They did NOT send us the actual weight ticket until now, this is the first time we have seen anything from Budget Dupster except repeated copies of their invoices and threatening phone messages about how they are going to "send us to collections" if we don't pay them right now. And, by the way, they lied when they said we stopped communicating with them, because they were informed that we would be taking this situation to the Revdex.com  to be sure that we were not being overcharged, since they had already tried to charge us over $900 incorrectly for our dumpster.  And, if, as they claim, the dumpster had gone directly from our yard to the landfill, then the date on the ticket would be different. It wasnt picked up on Nov. 25th.   And what identifier do they use to show what dumpster comes from where, because I still think they have the wrong one.

We would like to apologize to the customer for this negative experience. At the time of the order the weight limit associated with the customers dumpster was properly communicated and this information was then reiterated via email. We understand that estimating the weight of materials can be...

difficult, however we did not have any control over the amount of materials that the customer decided to dispose of in the container. When the dumpster was picked up, it was taken directly to the disposal site where it was weighed multiple times in a state regulated weighing process. It was determined by a certified Weigh Master that the customer’s materials weighed 3.24 tons. This resulted in a charge of $93.00 as it exceeded the 2 ton weight limit by 1.24 tons. Please consider, this is not a punishment fee. We are simply recuperating the additional disposal costs for the materials beyond 2 tons. To further validate this legitimate charge, we have provided the customer the weight ticket from the landfill. It is the official documentation associated with the weight of the customer’s materials. This documentation, along with the driver’s log has been attached. Currently, the customer has an outstanding balance due. If the customer or the Revdex.com requires any additional information, we are more than willing to provide it in an effort to resolve this situation.

The customer rented a dumpster with a 4 ton weight limit. When the dumpster was removed from the customer’s location, it was taken directly the area landfill. The materials were then weighed multiple times in a highly regulated, governmental process. A state certified Weigh Master determined that...

the customer’s materials weigh 7.6 tons or 3.6 tons over the weight limit. To further document the weight of the customer’s materials, we provided a weight ticket from the landfill. Our records indicate that this documentation was successfully sent to you via email. Please consider, we have zero influence over the landfill, the weighing of your materials or the amount of materials that were put inside your dumpster. We appreciate you taking financial responsibility for this fee and the disposal of your materials. Our representatives have worked extensively with this customer to alleviate the concerns, however the customer has refused communication. We are very willing to provide any additional information, including re-sending the documentation, upon request.
