vehicle on-site. Per the mutually agreed upon Terms and Conditions, this would incur a $150 Trip Fee. However, in an effort resolve the entire situation for the customer, we did not subject the customer to this valid charge. In regards to the overage charge, attached is the Weight Ticket from the landfill, which certifies that the customer’s materials exceeded the weight limit. Budget Dumpster does not have any influence over the amount of materials the customer put inside the dumpster or the state-regulated weighing process performed at the landfill.We again apologize to the customer, but we will not be refunded the authorized overage charge. The balance due has been paid in full. Upon request, we are willing to provide any additional information or documentation. Thank you.

We would firstly like to address the customer’s claim of fraud. Not only is the claim untrue, it is defamatory and will need to be revised unless it is able to be substantiated. time of the order, multiple times via email and always available on our website. Per the mutually agreed upon Terms of Service the customer is responsible the materials that they decided to dispose in the dumpster. When the customer’s dumpster was removed, it was taken directly to the landfill, where it was weighed multiple times in a highly regulated, governmental process. A state certified Weigh Master determined the customer’s materials 3.61 tons or 1.61 tons over the weight limit. We provided the customer, as we do all of our customers, every opportunity to avoid this additional charge.In regards to the interaction with the driver, the customer is allowed to fill the container as much as possible within the confines of the dumpster. As stated previously, it is the customer responsibility for anything put inside the dumpster. However, it is unreasonable to believe that the customer was able to put an additional 1.61 tons of materials per the direct instruction of the driver thus incurring the additional charge. Also, the customer authorized the charge for the valid fee. Here is a relevant excerpt per the Terms of Service: Credit Card Authorization: Due to the fact that we accept payment via credit card by phone before delivery of the container and due to a certain level of uncertainty, because fees and or charges can apply after the initial dumpster order, you agree and give authorization to Budget Dumpster L.L.C. to retain your credit card information for up to 120 days beyond the last day of your container rental and to charge your credit card for any fees or charges that may apply which are covered in the terms and conditions above.We have provided the customer with the weight ticket from the landfill to further document the exact weight of the materials put inside the customer’s dumpster. Budget Dumpster does not intend on refunding the valid charge. We are willing to provide additional information upon request, but consider this a closed matter and the balance has been paid in full.

There are many aspects of the complaint that the customer is not taking into consideration. When the dumpster is picked up, it is taken directly to the landfill. The landfill, along with the weighing of the materials is a highly regulated, government process conducted by a State Certified Weight...

Master. The dumpster arrives at the landfill, where it is placed on a state certified scale that is routinely checked for accuracy. It is weighed, unloaded, and weighed again. The difference determines the weight of the materials in the customer’s dumpster. The customer’s materials weighed 2.99 tons, which exceeded the 1 ton weight limit by 1.99 tons. We have provided the customer a weight ticket produced directly from the landfill to further document the weight of the materials that the customer put inside the dumpster. Although we appreciate the customer’s efforts to remain under the weight limit, it is not possible that the customer utilized scales that are calibrated with same efficiency or accuracy as the government regulated scales. The customer is arbitrarily providing a weight without any additionally information or documentation. Additionally, the customer has stated that the materials weighed a variety of different amounts, including figures that would have still exceeded the 1 ton weight limit.We have been able to provide exactly how the materials were weighed, how much they weighed and documentation to corroborate the results. If the customer is able to provide any information that contradicts our documentation, we would take it into consideration. The customer referred to our business as a ‘scam,’ which is not only untrue, but also implies criminal wrongdoings. We consider this libel and defamatory to our business and will pursue legal action if the customer continues to portray our business in a fashion that does not accurately reflect our business or the situation.

We would like to first sincerely apologize for the negative experience. On 11/13/17, the customer had 2 dumpsters delivered making the 10 day rental period to end on 11/23/17. The customer contacted us on 11/14/17, setting up the removal of both containers to occur the following day. On 11/15/17, we...

arrived on-site and could only remove one of the containers due to the other being overloaded with materials. A representative contacted the customer and left a voicemail explaining the necessity to off-load the excess materials and to contact us once it is completed to schedule to removal of the container. According to our records, the customer did not contact us to schedule removal until 12/5/17. Unfortunately, the representative made a billing mistake and subjected the customer to extension charges for using the container beyond the rental period for both dumpster. The customer should have only been subjected to extension charges associated with the overloaded container that was not scheduled for removal until 12 days beyond the 10 day rental period. The customer has been refunded for the extension charges associated with the non-overloaded dumpster. This documentation has been attached. We are very sorry for this issue, but will not be refunding the valid extension charge. Please contact us for any additional information or documentation.

I reject the response tiredlessly given by budgetdumpster. Firstly, as stated previously, I called on the 6th initially to find out why the dumpster hadn't been removed (after calling the rolloff company, [redacted] rolloff first) ~ [redacted] roll off stated they would be there to get it within 24 hours after the order from budget dumpster, which she didn't receive that order until the 10th in the am. There is absolutely no reason for the longevity of this process, which in turncoat me 75.00 because the scheduled excavator could not be used that previous weekend. I'm not asking for money from the rental, but the overage ~ primarily because they don't deserve it. Attached, is the phone call I ordered the dumpster on, its lengthy and shows my excitement about this upcoming project, but if you forward to about 1.50 seconds left of the conversation with John, he will state the terms of service in which he never advised to "call in" to have the unit picked up, he advised that it was until the 3rd of July, and that a call in to keep longer would be 10.00 per day after. I did not call in to prolong my rental.  Also, is the invoice from [redacted] roll off, the only invoice I received. I called in the day of delivery before I signed for the roll off to insure instead of 7 days, it was 10 ~ and that it was 10 ton instead of 2. She verified that it was. I have two email addresses ~ my main one is [redacted][email protected], which I had given them and have not to my knowledge had any problems with receiving emails with, but I never received and after searching for it, it's still not there, not in spam, etc. my secondary one is [email protected], used mostly for family related items. I did not receive a hard copy of their invoice, as stated before, my charge on my discover and the roll off as well as the invoice I received from the roll off company seemed to suffice I got what I had paid for.

We are very sorry and understand the delayed service may have incurred additional costs. However, at the time of the order the customer agreed to our Terms of Service. As mentioned previously, here is an excerpt from our Terms of Service: Budget Dumpster will not be liable to Customer under any circumstances for costs, expenses, losses and/or damages incurred by Customer in any manner relating to such delays.This information was also successfully sent to the customer prior to the delivery of the dumpster. We do not feel this situation warrants a refund and hope the customer can take this agreement into consideration.

It was communicated at the time of the order and in the invoice prior to the delivery, that the customer’s dumpster was strictly for concrete, brick, block, dirt and asphalt. The customer decided and has admitted to on multiple occasions that he also disposed of sod and sand. These are not our regulations, we just enforce them for the landfill. When the dumpster was deemed contaminated, the 10 ton weight limit is forfeited to a 2 ton weight limit. We apologize that this fee may have been unexpected, but we provided you with every opportunity to avoid this charge. We hope that the customer and the Revdex.com can consider this matter closed, since the balance has been paid in full and the customer has admitted to his mistake. Attached is the initial invoice.

We are sorry that this fee was incurred. The customer is required and agreed to have the location properly prepared for the pick-up of the dumpster for the entire designated day. This includes keeping the location free of any obstructions and the materials must be within the confines of the dumpster. When we arrived on-site, our records indicate that the location was not properly prepared for pick-up due to the dumpster being overloaded with materials. We make every effort to remove containers, however due to our tight schedule of deliveries and pick-ups it does not provide us the opportunity to remain on-site for an extended period of time to allow customers to prepare the container for removal. As mentioned previously, per the mutually agreed upon Terms of Service, we are able to subject customers to Trip Fees for any reason beyond Budget Dumpster’s control, which includes the overloading of containers. This fee remains unpaid and according to our records, the customer has requested to be subjected to the collections process. We consider this issue a closed matter.

Despite the customer’s claim of providing “no proof,” we successfully sent a weigh ticket from the landfill, which further documents the exact weight of the customer’s materials. This is an official document that certifies the weight of the materials. The customer’s attorney has not responded to our communication efforts and it is likely a result of our documentation of the customer’s materials. The customer has not provided Budget Dumpster with any proof that they did not exceed the weight limit. We would be willing to take pictures into consideration, but photographs can only portray volume, not weight. The customer was successfully sent documentation and we consider this a closed matter. We will not be refunding the valid charge and upon Revdex.com request will provide any additional information.

Please refer to this excerpt from the Terms and Conditions: In the event that Budget Dumpster attempts to deliver or pick-up Equipment and is unable to do so for any reason beyond Budget Dumpster’s control, including, but not limited to, overloaded Equipment, low lying power lines or tree branches, blocked access to the delivery or pick-up location, damaged Equipment, locked gates, fences or parking lots, inaccessible driveways and/or the storage of prohibited items or substances in the Equipment (collectively referred to as “dry run”), then Budget Dumpster shall be entitled to an dry run inconvenience fee.  The standard dry run inconvenience fee is $150.00; provided that, if Budget Dumpster incurs additional charges, fees, fines, penalties costs and/or expenses related to the dry run, then Budget Dumpster may increase the dry run inconvenience fee in order to recoup any such charges, fees, fines, penalties costs and/or expenses.  Customer acknowledges and agrees that Budget Dumpster is authorized and entitled to charge to Customer’s credit card the amount of any such dry run inconvenience fee.  We again are very sorry and understand the width of the customer’s street is out of the customer’s control. Please consider, it is not the size of the container, it is the large trucks used to transport the container that could not safely maneuver on the street. Budget Dumpster will not be refunding the valid charge. However as a courtesy to the customer, we offered that if another dumpster company using a roll off dumpster rental truck can successfully deliver a container, we would refund the charge. The complainer allowed a previous customer to use their credit card to order a dumpster. The person using the credit card ordered the dumpster under a Budget Dumpster personal account that has rented a dumpster previously. The account had an unpaid balance and our automated system charged the new...

We do apologize that this was unexpected, but this is a standard procedure that is detailed in the agreed upon Terms of Service. Even though we were authorized to make the valid charge to the complainer’s card, we decided to refund the customer’s money immediately in full. The balance due was eventually paid in full and we consider this a closed matter.

Budget Dumpster has been able to utilize call recordings and other documents that negate the claims by the customers. When we first arrived at the customer’s location, we were unable to deliver the container due to 3 vehicles blocking the driveway. Although we cannot confirm that the vehicles were...

Budget Dumpster made every effort to deliver the dumpster, but we were forced to assess a Trip Fee. The possibility of the Trip Fee and these guidelines, were clearly communicated at the time of the order and multiple times via email.After listening to the call made by the customer when ordering the dumpster, a variety of information was uncovered that directly contradicts the claims made by the customer. According to the call recording, the customer stated that they wanted the dumpster as close to the garage as possible. We delivered and placed the dumpster in accordance to the request made by the customer. When discussing the weight limit with the Budget Dumpster representative, the customer referenced using rather heavy materials and even mentioned the possibility of going over weight. We took additional steps to provide the customer with the weight ticket (attached) from the landfill to further document the weight of his materials. In rare availability issues, Budget Dumpster may provide a larger capacity dumpster at the same price as the lower capacity container. This was communicated to customer prior to ordering and the reply was “that’s perfect.” Due to sensitive billing information, Budget Dumpster will not be releasing the call recording. However it is clear that the customer is deceiving the Revdex.com process in an effort to damage our reputation. The balance has been paid in full and Budget Dumpster considers the matter closed, with no intentions of reversing the charges. At the request of the Revdex.com, we are prepared to provide any additional information.

On 9/30/15 at 5:52 pm, the customer contacted us regarding an issue of other people illegally disposing materials in the dumpster rental. In the call recording, the customer expressed a sense of urgency to have the container picked-up and requested removal for as soon as possible. The customer...

service representative clearly communicated the dumpster pick-up would be scheduled for Friday, October 2, 2015, but could occur on Monday, October 5, 2015 at the very latest. Our customer service department made additional efforts to ensure the dumpster would be removed on Friday, October 2, 2015 as requested by the customer. When we arrived on-site to pick-up the dumpster, we were unable because the dumpster was blocked in by a vehicle. As displayed in the complaint, the customer is well aware of the responsibility to keep the location clear and the possibility of the trip fee for a failed pick-up.Despite properly communicating and the customer admitting guilt for the failed pick-up, we decided to reduce the balance due by $50. The balance has been paid in full and we do not have any intentions of reversing the valid charge. We hope that both the Revdex.com and the customer can consider that we made a concerted effort on behalf of the customer and only through the customer’s own actions of blocking in the dumpster did this issue arise. We informed this customer, as we do all of our customers the necessity to provide a clear pathway to the dumpster, multiple times throughout the rental process. We do everything in our power to avoid Trip Fees, because they are very costly in terms of time and money. There is no money made off of Trip Fees, we are simply recuperating costs of paying drivers, wasted time and fuels, and to reschedule the routes.  Attached is the Invoice.

The claims made in the complaint are purely subjective and not based on any facts or documentation. On 8/28/14 at 10:18 am the customer scheduled a pick-up to be performed on 9/2/14. Our records indicate that on 9/2/14, the customer’s dumpster was overfilled and unable to be removed. We may have...

made multiple unsuccessful attempts to pick-up the container, but the customer was only subjected to one additional fee, although it would have been valid to charge for each attempt. Per the mutually agreed upon Terms of Service, it is the customer’s responsibility for any materials put inside the dumpster while it is in the customer’s possession. Here is an excerpt from the Terms of Service, which references the situation that occurred with the customer:Dry Run Charge(s): Budget Dumpster L.L.C. charges a fee for unsuccessful container pick-up or drop-off attempts. When this happens, we call this a "dry run". When a container is unable to be dropped off or picked up due to the following reasons, a fee is charged to the customer. Valid reasons for us to charge a client the dry run fee include but are not limited to; overloaded containers, low laying power lines or tree branches, cars or any items or materials blocking access to pick up or drop off a container, door open on a container, material heaped up or hanging over the sides of the container, containers that are too heavy to be removed, locked gates or fences, inaccessible driveways or parking lots for any reason(s) out of our control. The dry run fee can range anywhere from $150-$200. This fee covers drivers pay, fuel, and time for re-routing the drivers planned schedule which takes an immense amount of work.Although the policies of our competition have no bearing on our business or this complaint, the customer is under the false impression that they are different. The dumpster companies the customer is referring to, are the same companies that we contract to perform our service. Whether the customer used the local service directly or Budget Dumpster, they receive will essentially receive the exact same service. The customer is also mistaken regarding the legality of our services. Dumpsters are in fact legal in the [redacted] area, and we would like the customer to provide any evidence that corroborates the illegality of dumpsters. Budget Dumpster legally operates in [redacted], the services we contract are legally allowed to operate in [redacted] and many other businesses use a similar business model in [redacted]. We have made contact with government officials in the [redacted] and they have been unable to confirm the various claims made in the complaint. In addition the [redacted]/ provides dumpster rental options to area residents in their Department of Public Works section of the website. In regards to the blight violation, it was not a result of the dumpster rental. We were able to access the public court records for case #[redacted], where the customer violated code 22-2-88(b) “Allowing bulk solid waste to lie or accumulate on or about the premises.” The dumpster was not the cause for this violation and we will not be providing any restitution for violation. We made attempts to contact the customer on 9/12/14, 9/19/14, 10/3/14, 10/13/14, 10/20/14, which the customer decided to neglect. This forced us to send the balance due to the collections process. The valid charge cannot be reversed and this is considered a closed matter.

When the customer decided to cancel the order, we issued the customer a full refund and did not subject them to a cancellation fee because of the delayed dumpster delivery. In regards to the refund, the customer is simply mistaken and we have documented proof (attached) that we performed and successfully provided the refund. Please consider, the dumpster was in fact delayed. We would have been able to eventually deliver a dumpster, if the customer did not decide to cancel the order. We realize that, due to your situation that you had every reason for cancellation, but that is why we considered the dumpster delayed. The reason for the delay was a mechanical issue with a truck that has been resolved. Unless the customer has any additional questions or concerns, we consider this matter closed. We would like to apologize again for the major inconvenience.

It is in an effort to allow customers to use the container for exactly the amount of time needed, not to incur additional fees. At the time of ordering, our representative properly communicated our policy and how to avoid additional fees. In addition, we successfully sent this information to the customer to the exact email that he directed us to use, informed him that it was being sent and did not notify us of any issues receiving it until after the fact. We have communicated at length with the customer attempting to alleviate these concerns and provided the call recording. The $30 is a valid charge that will remain. In regards to the compensation for the service delay. Please refer to this excerpt from our Terms and Conditions: 3. Delivery and Pick Up of Equipment. Budget Dumpster will use commercially reasonable efforts to ensure timely delivery and pick up of Equipment; provided that, due to circumstances beyond our control, including, but not limited to, inclement weather, hazardous roads and/or driving conditions, traffic delays, motor vehicle accidents, delays at landfills and equipment failure, we cannot and do not guarantee delivery times or dates. Budget Dumpster will not be liable to Customer under any circumstances for costs, expenses, losses and/or damages incurred by Customer in any manner relating to such delays.  As mentioned previously, we have communicated in great detail and willing to take financial responsibility for any issue that is our fault. In essentially the midst of communicating the customer has enlisted the Revdex.com to make a determination on the situation. Upon request, we are willing to provide any additional information or documentation. Attached is the invoice sent to the customer prior to delivery. Thank you.

during the delivery on 9/15/17. On 10/11/17, the customer called in for the removal of the container and informed us of the damage. We instructed the customer to email in photos of the damage. It was not until after the customer was charged for exceeding the weight limit on 11/16/17, that the customer contacted us again via email. Our representatives responded immediately, instructing the customer again to send in pictures, along with other information to learn more about the specific damage. The customer emailed the necessary information on 11/27/2017 and we called the customer back that day, leaving a voicemail. We did not receive any communication back from the customer until he emailed us on 1/12/17. Please refer to this portion of the mutually agreed upon Terms and Conditions regarding damage: 10. Waiver; Limitation of Liability and Disclaimer of Warranties. EXCEPT IN THE EVENT OF THE GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT OF BUDGET DUMPSTER, CUSTOMER HEREBY WAIVES ANY AND ALL CLAIMS AND LOSSES AGAINST BUDGET DUMPSTER RELATING TO OR ARISING FROM CUSTOMER’S RENTAL OF THE EQUIPMENT AND/OR BUDGET DUMPSTER’S PERFORMANCE UNDER THE RENTAL DOCUMENTS, INCLUDING, BUT NOT LIMITED TO, ANY DAMAGE TO CUSTOMER’S PROPERTY, PAVEMENT, CURBING, DRIVEWAYS, WALKWAYS, LANDSCAPING, LAWN, WELLS, IRRIGATION SYSTEMS, SEPTIC SYTEMS AND/OR UNDERGROUND UTILITIES RELATED TO OR ARISING FROM THE STORAGE OR TRANSPORT OF THE EQUIPMENT IN OR ON CUSTOMER’S PROPERTY, INCLUDING, WITHOUT LIMITATION, ANY DAMAGE TO CUSTOMER’S PROPERTY FROM LEAKS OR STAINS RELATING TO CUSTOMER’S USE OF THE RENTAL EQUIPMENT. Although we are not liable for the damage in question, when minor cosmetic lawn damage happens, we make every effort to have work with our local hauler to rectify the issue. However, fixing damage is time sensitive as our local hauler may need to make an insurance claim in order to finance and possible contract out the repair. Primarily due to the lapse in communication by the customer, we are no longer able to coordinate with our local hauler and now have difficulty validating this damage was a result of our truck over 4 months ago. As a customer service credit, we did offer compensation for a negative experience. We again do apologize and are willing to provide any additional information to help resolve this complaint.
