I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
I am seeking a refund as they caused me great inconvenience and additional costs which was unnecessaryIf they were unable to pick up the dumpster on the designated day and time they should have advisedInstead they kept making promises that it would be picked up on the Friday and even on the Monday it was the same but it was not picked up until the Tuesday morningTo add insult to injury they lied about the fact that the dumpster truck supposedly did come on the Friday and couldn't pick up the dumpsterThe decent thing the company can do is refund me for the whole inconvenience and they mess they causedThey must not want any return business and a potential lawsuit as I have incurred charges from contractors who showed up and couldn't do what they had to do because the dumpster was obstructing their pathThey record all their phone calls so it will clearly show that they kept promising the dumpster would be picked up and they didn't deliver on their promisesI am not prepared to let this complaint go until I am provided a refund

On 12/21/15, the weight ticket was successfully sent and responded to by the customerThe weight ticket serves as the standard documentation in the waste removal industry to certify the exact weight of the materials that the customer put inside their dumpster. The weight ticket, which has been attached, is not to be confused with the invoiceThe weight ticket was generated by the landfill, which we do not have any control over. When the customer’s dumpster was pickon 11/25/15, it was taken directly to the landfillThe weighing of the customer’s materials was conducted in a highly regulated, government process by a State Certified Weight MasterIt is weighed multiple times and the government regulated scales are routinely checked to ensure accuracy. We have been able to provide documentation of the weight of the materials and cite credible sourcesThe customer’s opinion of the weight is purely subjective and not based upon any factsIf the customer is able to provide any information that would contradict our findings, we would take into considerationAs of 1/5/2016, the customer still has an open balanceIf the balance due continues to remain unsettled, the customer may be subjected to the collections process

The customer ordered a dumpster that is strictly for construction materials onlyThis was communicated on the telephone at the time of the order, via email prior to delivery and this information is always available on our websiteWhen the dumpster was picked-up, it was taken directly to the
landfill where it was determined that the debris inside the dumpster was not entirely construction materialsThe mixing of construction materials and waste is considered contaminationPer the mutually agreed upon Terms of Service, when contamination occurs, the ton weight limit is forfeitedThe customer is then subjected to a ton weight limitThis determination of contamination was conducted by a state certified weigh master, in a highly regulated governmental processBudget Dumpster does not have any influence over these decisions or regulationsIt is the customer’s responsibility for any materials put inside the dumpster while it is in their possessionThe customer must consider that even the smallest non-construction material will result in contaminationIt is not our responsibility to ensure the customer followed the instructions, we can only provide them with opportunity and information to avoid additional chargesIt is not standard procedure or a legal requirement to photograph or document specific materials that contaminated the loadIn situations such as this, we must side with the government regulated process over the opinion of a customerHowever, if the customer is able to provide documentation that proves that only construction materials were put inside the dumpster, we will refund the additional chargeThe customer has accepted responsibility by paying the balance due in fullWe have provided the customer with the weight ticket from the landfill to further document the weight of the materialsWe do not have any intentions of reversing the valid charge and consider this a closed matter

The customer was provided the necessary information to avoid all of the additional fees associated with the rentalThese fees and regulations are policies determined by the local landfill, which the customer has directly confirmed them with the landfillWe have no influence on these policies and
are simply recuperating the costs to dispose the materials the customer decided to dispose in the dumpsterThe balance due has been paid in full and we have no intentions of reversing any of the valid chargesWe have been in constant communication with the customer and consider this matter closed

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
We have never received anything except an invoice from Budget Dumpster.  I have never seen a weight ticket, unless they think these are one in the same.  Unless they can offer us some actual documentation that is proof of how much the dumpster weighed and that it was in fact the dumpster that was removed from our yard, then we still will not be paying the current invoice due to the fact that we believe it is fraudulent. The dumpster was not that full of heavy items, their weight is ridiculous.I would be happy to provide all correspondence between ourselves and Budget Dumpster if it will be of assistance. They just have not offered us anything except another invoice and as I stated before, they can put whatever they want on an invoice and call it "proof".

The $150 charge for not being able to deliver the dumpster is valid and will not be refunded. Additionally, it was authorized by the customer. Please refer to this excerpt, specifically the final portion, from the Terms and Conditions that the customer agreed to by renting the dumpster: 3. Delivery and Pick Up of Equipment. Budget Dumpster will use commercially reasonable efforts to ensure timely delivery and pick up of Equipment; provided that, due to circumstances beyond our control, including, but not limited to, inclement weather, hazardous roads and/or driving conditions, traffic delays, motor vehicle accidents, delays at landfills and equipment failure, we cannot and do not guarantee delivery times or dates. Budget Dumpster will not be liable to Customer under any circumstances for costs, expenses, losses and/or damages incurred by Customer in any manner relating to such delays.   Upon the delivery of the Equipment to the location as designated by Customer, Customer shall not move, transport or attempt to move or transport (either directly or indirectly) the Equipment from the designated site without prior notice to and consent from Budget Dumpster, which may be withheld within the sole discretion of Budget Dumpster.  In the event that Budget Dumpster attempts to deliver or pick-up Equipment and is unable to do so for any reason beyond Budget Dumpster’s control, including, but not limited to, overloaded Equipment, low lying power lines or tree branches, blocked access to the delivery or pick-up location, damaged Equipment, locked gates, fences or parking lots, inaccessible driveways and/or the storage of prohibited items or substances in the Equipment (collectively referred to as “dry run”), then Budget Dumpster shall be entitled to an dry run inconvenience fee.  The standard dry run inconvenience fee is $150.00; provided that, if Budget Dumpster incurs additional charges, fees, fines, penalties costs and/or expenses related to the dry run, then Budget Dumpster may increase the dry run inconvenience fee in order to recoup any such charges, fees, fines, penalties costs and/or expenses.  Customer acknowledges and agrees that Budget Dumpster is authorized and entitled to charge to Customer’s credit card the amount of any such dry run inconvenience fee.  Please consider, this is not a punishment fee, but rather we are recovering our various costs of not being able to deliver the dumpster and to reroute our schedule of service. This fee is an industry standard that was communicated multiple times prior to delivery in an effort to prevent it from occurring. If the customer or Revdex.com has any questions or require any additional documentation, we will provide it upon request. Thank you.

We sincerely apologize for not properly addressing these claims as quickly as the customer would like. The customer ordered a dumpster that was strictly for construction debris and our records indicated that contaminants were identified in the container. Prior to the customer's complaint, our...

representatives had been advocating on behalf of the customer with the disposal site to acquire additional documentation regarding the contamination. We work with these sites directly to ensure that there is documentation with every dropoff, as regulated by the state. Please consider that this process can take some time, but we are working to resolve this matter as soon as possible. We also would like to provide the customer a direct resource for communication moving forward using the email: [redacted] Any additional information, such as other materials that may have been put in the dumpster could help expedite this situation. This feedback is greatly appreciated and we look forward to hearing from the customer.

[redacted]11:56 AM (23 hours ago)to me Hello-The customer has yet to respond to any of our email attempts. If email is the preferred communication method can respond to those or email: [redacted]. Either option will be directed to the Billing Supervisor. Thanks

Per the mutually agreed upon Terms of Service, it is the responsibility of the customer to schedule the removal of the container. This information was successfully sent to the customer on 8/4/16. At this time, we do not have intentions of subjecting the customer to this valid charge.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. Manager Andrew did say, "we are here to make money". Not once. several times. Lie again! The tape should reveal that. Not only that, they lied saying the neighbor was contacted (who's van was blocking the street). I spoke with the neighbor and the neighbor spoke with the manager Andrew himself. Neighbor said, "I work second shift and I was in the house the entire time. Not one single person ever knocked at the door". Tape should reveal that as well. Obviously they are in lying business along with the dumpster and that is what I meant by "unethical business practice". Just to make money they will portrait everyone is liar. Customer is a liar, neighbors are liars, everyone lies and only truthful person is Andrew and Budget Dumpster! That should tell you right there! I have disputed the charges through my bank and Budget dumpster should stop unauthorized means to charge its customers using unethical business practices. My neighbor can be contacted to verify this.

my employee was at the job site and there driver mentioned the trees that had been put illegally put in the dumpster, before my employee could jump down and push trees to the middleof the dumpster the driver left.Budgetbumpster was only looking out for there own interest and did not make sufficent effort to get dumpster removed in good faith.I think they like to get extra charge of $150!THey lost a good customer and I will dispute this charge .I make in my business to go out of my way to make sure jobs get complete, not try to make excuses and try to backcharge my customer.

We would like to first apologize to the customer that he remains dissatisfied with his dumpster rental experience. There are many aspects of this process that we would like the customer and the Revdex.com to take into consideration. The weight limit associated with the dumpster was properly communicated at...

the time of the order, multiple times via email and always available on our website. When the dumpster was removed from the customer’s location, it was taken directly to the landfill. The customer’s materials were weighed multiple times in a highly regulated, governmental process. It was determined by a state certified Weigh Master that the customer’s materials weighed 8.22 tons or 4.22 tons over the maximum weight limit. Budget Dumpster has zero influence over the weighing of the materials or the amount of materials that the customer decided to dispose of into the dumpster. The customer stated “there is no way” that this could be true. However, the customer’s materials weighed more than double the maximum weight limit. This infers the customer does not have a true understanding of the weight of his materials. We are willing to take pictures into consideration, but pictures can only convey volume, not weight. To be clear, it is not the volume of materials, it is the actual weight. In addition, upon request we can provide a weight ticket from the landfill to further document the weight of the customer’s materials. It is true that this not the only complaint regarding overages, however only 20% of Budget Dumpster’s customers exceed the weight limit, with many choosing to do so. The customer has taken financial responsible for the overage fee and we are more than willing to address any additional concerns.

Budget Dumpster has communicated extensively with the customer and at no point been unavailable as described in the complaint. The customer has demonstrated confusion throughout the process and is choosing to omit relevant information. The original invoice for the Trip Fee in question contained the...

wrong information. We took responsibility for the mistake and clearly communicated to the customer the correct information regarding the events, which led to the Trip Fee. On 9/19/15 at 5:33 am the driver was dispatched to the customer’s location and arrived shortly after 6 am and the dumpster could not be removed. The customer admitted in a telephone recording that the location was not prepared for the removal of the dumpster on 9/19/15. Per the Terms of Service, which the customer agreed to by renting the dumpster, we can subject customers to a fee for not having the location ready for service. Here is an excerpt from the Terms of Service: Dry Run Charge(s): Budget Dumpster L.L.C. charges a fee for unsuccessful container pick-up or drop-off attempts. When this happens, we call this a "dry run". When a container is unable to be dropped off or picked up due to the following reasons, a fee is charged to the customer. Valid reasons for us to charge a client the dry run fee include but are not limited to; overloaded containers, low laying power lines or tree branches, cars or any items or materials blocking access to pick up or drop off a container, door open on a container, material heaped up or hanging over the sides of the container, containers that are too heavy to be removed, locked gates or fences, inaccessible driveways or parking lots for any reason(s) out of our control. The dry run fee can range anywhere from $150-$200. This fee covers drivers pay, fuel, and time for re-routing the drivers planned schedule which takes an immense amount of work. The possibility of the fee was communicated to the customer at the time of the order, in emails prior to delivery and always available on the website. This additional charge was valid and authorized. Here is the portion of our Terms of Service regarding credit card authorization: Credit Card Authorization: Due to the fact that we accept payment via credit card by phone before delivery of the container and due to a certain level of uncertainty, because fees and or charges can apply after the initial dumpster order, you agree and give authorization to Budget Dumpster L.L.C. to retain your credit card information for up to 120 days beyond the last day of your container rental and to charge your credit card for any fees or charges that may apply which are covered in the terms and conditions above. We do not have any intentions to reverse the valid charge. To avoid the collections process, the customer must contact us directly to settle the balance due. This is not a threat, it is simply providing the necessary information to the customer, who is choosing not to take financial responsibility for their actions. We hope that the customer and the Revdex.com can take this information into consideration.

We apologize that the illegal actions of others may have resulted in this additional fee for not being able to remove the container. Please refer to this excerpt from our mutually agreed upon Terms of Service: In the event that Budget Dumpster attempts to deliver or pick-up Equipment and is unable...

to do so for any reason beyond Budget Dumpster’s control, including, but not limited to, overloaded Equipment, low lying power lines or tree branches, blocked access to the delivery or pick-up location, damaged Equipment, locked gates, fences or parking lots, inaccessible driveways and/or the storage of prohibited items or substances in the Equipment (collectively referred to as “dry run”), then Budget Dumpster shall be entitled to an dry run inconvenience fee.  The standard dry run inconvenience fee is $150.00;  According to our call records, this information was successfully communicated at the time of order. It was also successfully sent via email. Budget Dumpster makes every effort to remove containers because it is very costly in terms of both time and money to re-route schedules. Again, we are sorry that this fee was incurred, but is the customer’s responsibility for any item put in the dumpster, while it is in their possession and to ensure all of the materials are within the confines of the container. We do not have any intentions of reversing the valid charge.

Budget Dumpster would like to apologize to the customer for his dissatisfaction with our responses. However, we are merely presenting information based upon facts and have documentation to support it. The customer ordered a dumpster for strictly clean concrete, block, brick, dirt, and asphalt. The restrictions on this dumpster were reiterated in the invoice sent and successfully received by the customer prior delivery. We have informed the customer and the landfill has as well, that some of his materials in his dumpster were not acceptable. The customer has taken responsibility for his actions by paying the balance due. Unless the customer has new information, we request that the Revdex.com close this matter. It is clear that the customer true complaint is regarding landfill regulations, which we have zero control over. The customer has already contacted the landfill directly and has the necessary information to continue his complaint directly with them.

Budget Dumpster has provided the Revdex.com and the customer all of the necessary information regarding this situation that is based purely on documentation. Our records are very comprehensive, which allows us to confidently refute these claims. We have given the customer the opportunity to provide evidence that would contradicts our claims, which the customer has been unable to do. Additionally, the customer communicated directly with the dumpster service, who reconfirmed all of our information. The customer was offered a reduced settlement, which remains unresolved. If the customer continues to leave the balance due unsettled, Budget Dumpster’s automated billing system will subject the customer to the collections process for the full amount. Although we do appreciate mediation from the Revdex.com, the customer must consider their determination on the matter will have zero influence over the valid charge.

Due to the complaint Being Submitted in Spanish, please let us know if there are any additional Concerns. A translated version will follow our response.  The customer ordered a ten yard dumpster with a 1 ton weight limit. The materials disposed from the dumpster weighted or 10.16 tons 11.16...
