Dear [redacted] - Thank you for the opportunity to review the additional comments from the consumer on the Revdex.com ID [redacted] .? The consumer signed the Maryland Purchase Agreement for her Ryan Home on December 31, which includes information on the? limited warranty in Section 6.? The consumer’s contract and signature are attached, acknowledging receipt of the warranty information.? All homeowners are given additional warranty information when they move in to their home via a USB drive.? In addition, the warranty information is is available at myryanhom.com under the? Warranty, Single Family Home: Maryland Residents pdf? (also attached herein for reference).? The specific language in the warranty is included under ‘Section V ?" AOne Year Warranty Items, Section Roof, Gutter, and Downspouts’ on page 23.? This clearly states the warranty coverage is year only and also includes instructions on properly maintaining the roof.? In addition, on page of the aforementioned warranty, ‘Appendix B Exclusions From Warranty Coverage’ item number 7.mnotes “Any loss or damage caused by acts of God or natural occurrences” is excluded.? The damage referred to by the consumer clearly falls under this provision as well.? ? In summary, Ryan Homes has performed in compliance with our contractual obligations.? The repairs requested by the consumer as outlined in the contract and warranty clearly occurred after the warranty expired and were also technically excluded from warranty coverage as this was a natural occurrence.? IT WAS NEVER A MIX UP? ON AN ADDRESS THE GUY CAME TO MY HOUSE AND HAMMERED A COUPLE TIMES AND SAID THIS IS ALL I CAN DO SO AFTER I FILED A COMPLAINT WITH Revdex.com ,,, THE GUY COMES BACK TO REPLACE THE SIDING,, RYAN HOMES IS VERY RUDE, AND LEAVES YOU GUESSING WEATHER OR NOT RYAN HOMES WANTS TO FIX IT, THE SIDE OF MY HOME WITH THE SIDING IS ALSO BUCKLEING AS WELLRYAN HOMES IS SO QUICK TO BUILD HOMES BUT NEVER WANTS TO COME BACK AND FIX THE ISSUEI HAVE REACHED OUT SO MANY TIMES BUT LIKE I SAID BEFORE RYAN HOMES DOES NOT DOCUMENT THINGS,,? In regards to the odor smell within the home, unfortunately while at the residence, our service staff did not smell or observe any moldy/mildew smell or staining.? Complaint: [redacted] I am rejecting this response because: I respectfully reject NV Homes response to our complaint regarding our master bathroom heating vent leak? First, I am pleased to hear that there are no structural issues concerning the integrity of the roof according to their assessment? The larger issue at hand is that this is a design flaw with how the vent is designed and placed? Representatives from both NV Homes and their sub contractor who performed the installation during the original construction of our home said as much to this issue.My desired resolution to the issue would be for NV Homes to correct the design flaw immediately along with replacing the damaged ceiling dry wall around the vent caused by the water that came through? I also find it hard to believe that this is acceptable, when none of our neighbors are having a similar issue? And if our neighbors were have a similar issue how this could be accepted as standard practice for a home builder of their reputationWhere is their pride in workmanship and quality? I find it rather disingenuous that in speaking with NV Homes representatives they shift blame for the current design to the that it is Frederick Country Building Code, rather than finding or developing a plausible solution for the problem at hand? They chose not to do anything because of the fact by doing so would set a precedent and would require NV Homes to act in the best interest of the customer rather then the shareholder Regards, [redacted]

Heartland Homes service manager agreed to meet with the consumer to review the concerns outlined in this complaint.? We have agreed to remove the soil at the foundation (about 3’ deep) at the front of the consumers unit from the gas meter to the porch and replace with gravel and a drainWe will also be installing a landscape burm on the high side unit next to the consumers to direct run off from the neighboring unit to a drain at the low point of the mulch bed.? Complaint: [redacted] I am rejecting this response because: We are going to need a few more weeks before we accept a specific response as there are items that remain outstanding We are allowing Ryan Homes the opportunity to fix these issues out of respect for the efforts of the people directly involved in bringing closure to these issues.? We do not suspect that those involved in trying to fix the problems have contributed directly to the issues we have experienced, but the efforts have been genuine in making it right.? As a result, any legal actions that would have been pursued have been placed on hold.? In addition, we will be holding off on posting or submitting any corresponding photos/videos online and hold off on passing out any associated flyers in hopes the efforts of a few can change our hearts and minds Ryan Homes has, since the complaint was opened, conducted another survey of the home and finished some work as indicated in their feedback to our complaint.? The structural engineer came back out to survey the previous work and pointed out a few minor things that needed to be done to complete that associated work.? The engineer also took a look at some of the issues we had concerning the floor joists and the corresponding bulges we had in the lower level floor directly above the main supporting beam and corresponding support pillars in the crawl.? In addition, we discussed with the engineer our concerns with the drainage fix, the cracks in the drywall, the issues with the doors getting stuck and the soil samples report where it indicates in the report and specifically the concern with unstable soils and the statement “...not recommended to build on this site due to organic fill present...”? We also provided the Ryan Homes? team that arrived on Wednesday? with the photos associated with our concerns as well as highlighted some areas on the initial engineering report and the soils report for discussion.Ryan Homes is awaiting the engineers written report on the findings? by the structural engineer concerning the issues identified with the floor joists and the corresponding bulges in the lower level floor along with the other items that needed to be done with the framing supports under the morning room and corresponding knee wall.? Drywall contractors will be notified to come in and repair the associated cracks, nail pops, seam separations along with the associated caulking.? Upon receipt of the engineers report, Ryan Homes has assured us they will come in and conduct the necessary tie-ins/bolting of the main supporting beams under the home and will conduct the corresponding repairs to the lower level floors above along with the doors and/or moldings associated Wednesday, May 2016, was a good day towards resolving our major concerns about the structural integrity of the home and the long term integrity of our investment.? This has, since day one, been our primary concern.? While it does not completely erase some of the concerns we have addressed in this note with regards to the initial craftsmanship of our home, those photos or those videos, we do believe that the resulting issues are being addressed It is estimated that the engineering report will be submitted within two weeks and repairs conducted the following week and we would like this complaint to remain open until such repairs are completed.? We are awaiting a call from the drywall contractor to schedule in those repairs and have been told by Ryan Homes to expect that call to come in sometime? this week.Regards, [redacted] ?

Dear [redacted] - Thank you for forwarding the additional comments by the consumer on the Revdex.com ID [redacted] The bath exhaust fan was installed according to manufacturer specifications and meets all applicable building codes The consumer settled on his home on 3/18/and has not had any issues during weather patterns During the all-day rain on 2/3/the home did not leak any water into the vent It is NVHomes position that this occurred due to the extreme weather associated with the Storm Jonas NVHomes stands by our previous response and will take no further action on this matter NVHomes appreciates the efforts of the Revdex.com in bringing closure to this matter If you have any questions, please do not hesitate to contact us Regards, Corporate Customer Relations
