Our Ryan Homes warranty team has worked with the consumer and vendor to address the concerns mentioned in the complaint.? While the consumer had reached out to the vendor directly on separate occasions, this is the first time we are becoming aware of the issue the consumer was experiencing.? Our warranty representative met the vendor and the consumer at the home of the consumer on Friday, November 17th.? A new HDMI was installed, however the consumer continued to experience the same issue.? It was determinted that a component hooked to the system the consumer had purchased was scrambling the signal and causing the issue explained in the complaint.? Our warranty manager left a message with the consumer on November 20th to follow up.Ryan Homes appreciates the efforts of the Revdex.com in bringing closure to this concern.? The condition the consumer is referring to is called efflorescence. Efflorescence is a crystalline deposit of salts that can form when water is present in or on brick, concrete, stone, stucco or other building surfaces. Efflorescence is not a condition that [redacted] can prevent and therefore is not covered under our warranty. This information is noted in the [redacted] warranty under section Brick Veneer (please see below)Brick VeneeraService & Maintenance TipsThe brick selected for your home has been professionally color coordinated with your exteriorsiding package to provide a visually pleasing exterior scheme as integrated with yoursurrounding neighborhood.Please refrain from planting ground cover or ivy which could creep up the foundation wall, andas a result, dilute the strength of the mortarWe cannot be held responsible for the appearanceof cracks resulting from vegetation, efflorescence (i.e., a white film which forms on brick iscold weather and disappears as warm weather returns) or other Homeowner maintenance items. I am rejecting this response because:1. The roof/shingle blow off: Yes, we contacted our insurance regarding this because we thought that was the route that had to be taken per Ryan's Homes. However, upon inspection by the insurance adjuster, it was noted that the shingles blown off could be replaced but lacked in quality according to specifications for withstanding high/hurricane force winds. I beg to differ with Ryan's Homes on them meeting the standard in that, yes, they might meet MINIMAL STANDARDS and what is considered acceptable. However, these shingles are of a low-grade quality and should be of a better quality than what has been utilized on our home.2. Shingles not to code per insurance adjuster: *** *** did mail a very large package (of the shingles) to *** and *** contacted *** *** requesting that pictures be taken of the area and the shingles on the roof. MrJustice did just that and mailed it in to ***. *** then told him that they had received the pictures and were working on the issue. We have not heard anything from them since then and both receipts provided for what we paid the adjustor were sent with the materials. I would like to know the name of the person at *** who stated that they did not receive anything from usWindow leaking into morning room ceiling: The rain we just had days ago is what has caused this leak. Work that has a warranty that only last for months is unacceptable since problems will materialize after the warranty period that affect the stability of the home and leads to other problems. Poor workman shipStairwell Separation: It is not trim that is separating it is the entire stairwell separating from the foundation wall. There is almost a finger gap between the wall and the stairwell. The wall, at the bottom of the stairs is, clearly, skewed. The awful putty job the "handy man" Ryan's sent over has separated from this wall due to the entire stairwell separating from the wall. The stairwell is out of alignment and is clearly seen with the visible eye. Again, months is very convenient for a homeowner's warranty to run out since all these issues occur after months. Again, poor workmanshipFront Porch Column: At the outward appearance the "one" column looks like it is done correctly. However, close examination reveals that it is not and that would explain another problem we are having, ceiling of front porch separatingWalls and ceilings cracking: There is a 6" long crack in the wall upstairs between the master bedroom door frame and the hallway bathroom door frame. This crack is running right in-line with the separation taking place with the door frame. I never thought that I would have to buy a hammer and nails and nail all my door frames back together in a brand new home worth a 1/of a million dollars. The separating taking place with the ceilings in other areas of the home are clearly visible with the naked eyeDoor Frames Separating. Again, signs of poor workmanship. The door frame in the master bathroom toilet area is the worst. This door frame has separated to the point that if you take your finger you can stick it in the separation and pull the frame apartSqueaking Floors: Why should we have to address maintenance on a carpeted floor that should have been put together properly from the beginning. It sounds like the floor was not properly installed and that the incorrect method was utilized to do so. For floors to creak like this indicates (per insurance adjuster) that they were not properly installed with the right equipment and flooring tacking methodCracks along shower/tub: This is not caulking - this is masonry work - the grout is cracking and separating from the shower and tub due to the floor movement (per insurance adjuster). We should not be having to do masonry work or a contractor come in to redo our shower caulking at this point in a brand new home. We have been informed that unless this is taken care of properly we will have to continuously keep doing this in our bathroom (caulking and grouting)Baseboards: Yes, all of them are separating at the seams - in the cornersThis should not be happening. I guess you are saying that we need to "caulk" that too!!!Attic Door: Again, it is very convenient that a warranty runs out in months when problems materialize right after that fact. This door is needing and will need to be replaced. I have owned a home before and I never had to replace the attic door. This is poor quality material used for this door and that can been seenExterior Screen Door - back door: The weather should not have affected this door is this manner. The adjuster looked at the door and noted that the way the door was installed has caused the problem. Again, poor workmanshipWater on Patio: Yes, it is for "some" water to settle on a patio and dissipate later. However, in this case, the water settles on the patio and stays for days on end creating a fungus on the concrete which indicates and shows that it is unevenly laid. The water does not settle on the opposite side of the concrete so this shows that one end of this concrete patio is not even. Keep in mind that a fungus is in the mold family and that can be harmful to people who have allergies to mold - like myself.I appreciate the Revdex.com for hearing this complaint and I request a follresponse from Ryan's Homes to my rebuttal and a resolution to the problems. We will be out of touch for the next couple of weeks and look forward to resuming this discussion and resolving this issue when we return.I can only attach four images but I have more images to provide. I would appreciate the opportunity to send those images as well to receive proper consideration in this matter

The consumer closed on her home constructed by *** Homes, Incin April On December 31, 2012, NVR, Incpurchased certain assets of *** Homes, Inc., including the trade name “*** Homes”However, NVR is not a successor to *** Homes, Incnor did NVR assume any of the liabilities to the closed customers of *** Homes, Inc
The consumer does have a warranty on her homeIf any items fall within the warranty timeframe, the previous owner would handle the warranty claimThis information has been provided to the consumer on numerous occasions and all future rejections to this complaint will be responded to in the same way

Further, Customer Care explained that if there was a structural defect identified by a licensed structural engineer, it would be addressed under the year Limited structural warranty We received no further correspondence on this matter from the consumer
While this home is now outside of the year Limited structural warranty, Ryan Homes would be happy to review any supporting documentation from a licensed structural engineer as advised in March Ryan Homes appreciates the efforts of the Revdex.com in bringing closure to this matter Please do not hesitate to contact us if you have any questions

Dear Ms*** * Thank you for the opportunity to look into the Revdex.com ID complaint. Prior to you purchasing the home, the consumer was afforded the opportunity to review *** *** “Limited Warranty” and agreed to accept it as the sole warranty in lieu of all other warranties,
expressed or impliedWhile inspecting the consumers driveway, our *** *** warranty team reviewed the performance standards covering concrete driveways found in SECTION CONCRETE of *** *** Warranty(see below) Concrete surfaces should not disintegrate to the extend that the aggregate is exposed and loosened under condition or weathering and use. However, surface spalling may occur during exceptionally cold conditions due to moisture saturation and freezing. *** *** is not responsible for deterioration caused by salt, chemicals, implements used, and other factors beyond our control, including moisture saturation and freezing due to exceptional cold weather. The inspection of the consumers driveway was performed on 4/11/by representatives of *** *** *** ***, *** *** ***, and *** ***. Through this inspection, we observed a few cosmetic coarse aggregate pop outs as well as some isolated areas of surface scaling. The numerous freeze-thaw cycles experienced this past winter, combatted with the use of deicers, such as Magnesium Chloride, used by local municipalities were determined to be major contributing factors to the cosmetic issues observed. There was no evidence/indications of any structural or long-term durability issues and *** *** does not feel that this claim is warrantied. In summary, this driveway has only minor surface imperfections that are not indications of substandard concrete or workmanship and are not indications of any suspected long-term deterioration of the driveway and is still fully capable of servicing its intended purpose of transporting passenger vehiclesAlthough surface mortar scaling may not be desired, it is generally a cosmetic issue not affecting the integrity and application of the driveway. As such, the long-term serviceability of this driveway should not be affected by its current condition. However, considering the importance of maintaining the concrete and aggregates in a dry as possible condition, we would strongly recommend that this driveway be cleaned and sealed with a good penetrating silane or siloxane based concrete sealer. This will greatly reduce the potential of any additional surface deterioration while helping provide long-term protection from the deterioration caused by the exposure to the numerous freeze thaw cycles experienced during the winter months in North East Ohio. *** *** appreciates the efforts of the Revdex.com in bringing closure to this concern. I am rejecting this response because:Whether the statements made are true or not, monies were not collected and they were not listed on the Closing Disclosure This error made by Ryan Homes, NVR Settlement, and *** *** is causing undue hardship on all of the new condo homeowners that were the victims of this monumental error This is why the corporation should do more than admit their mistake but to set it right by paying the three-month assessment to the condo association on behalf of me and all the new condo owners The letter Ryan Homes mailed to us was lacking in responsibility, offered no assistance what-so-ever, and didn't consist of contact information in case we had questions or concerns. I am rejecting this response because: They did not act in a timely mannerWe had days to void the contract and did not disclose the actual price we would be paying until a month laterYou can see in the contract I have attached this stipulation as well as the date signed was 8/15/Then the date they sent out a mortgage paperwork was 9/21/over a month later with my wife attachedAlso they said I was not approved by myself for the mortgage, doesn't that make the stipulation in the contract of not being approved for the mortgage kick in?
