I would like to reject the offer of Mediation for complaint ID [redacted]? The reason for the rejection is very simple? We are not able to negotiate the terms of the escrow as we are simply the holder of the escrow and not the seller? We have been clear that there is a path to resolution for this matter in that [redacted] must either 1) return the title of the unit they have received to the selling party by signing a deed and having it recorded? OR 2) They may accept this title and negotiate a refund or partial refund with the selling party.We only hold escrow so a binding mediation to order the release of escrow that we do not control is not legal? The terms of escrow must be followed for release.We encourage [redacted] to choose one of the two options we have provided to him as he has the power to resolve this issue? He may not request a refund from the seller while still in possession of the product? We believe this is a rather cut and dry case.We look forward to hearing from [redacted] within the next days as to his desired resolution? He may email [redacted] at any time.Thank you

I appreciate them willing to correct the issues My suggestion is to call [redacted] of the Pono Kai resort He is in charge of reviewing/accepting the deeds for completing the transfer His number is [redacted] He can explain the changes needed, which is not my area of expertise I hire and rely on experts to get this done
Both of the deeds supplied to [redacted] completed legal review and were recorded successfully with the County recorder at the bureau of conveyances in HawaiiThey are correct However, as a courtesy we are happy to make any change as requested if specifics are provided [redacted] may send the requested changes to [redacted] so we may review and make the requested changes

I am rejecting this response because: Representives of [redacted] Incof Lexington SC specifically have stated that they have sucessfully executed an exchange of the contract and of the funds from them to Timeshare Transfers.com so they (Timeshare Transfers) could complete the transfer of title of our timeshare to an interested third party namely [redacted] has also stated that ? their former Sales Mgr[redacted] has joined [redacted] Timeshare Transfers.com title transfer agent so that they could complete this title transfer transactionAt this point in time (Febuary 06th 2016), the transfer of title of our timeshare has not taken placeTo resolve this issue all we want is for Timeshare Transfers.com to legally transfer the title of our timeshare to [redacted] (a Colorado limited liability company) or any other interested third party

I will concede that it does appear that the two timeshares in Key West FL are complete, however, he is not showing me any proof positive that the Bermuda (StGeorge's Club) timeshare has been completed

Regarding communications, none of the emails or calls have been proactive on the part of TimeshareTransfersEach response I've received was the result of multiple attempts via email and/or telephone to get information from them.Below is a high level log of the email communications.? Dec - Sent details on Timeshare week, Seller info, and Buyer info to TimeshareTransfers.Jan - Emailed TimeshareTransfers inquiring on status of the transfer.Jan - Received an email response from TimeshareTransfers requesting a copy of the old deed.Jan - Emailed TimeshareTransfers a copy of the "Assignment and Assumption Agreement" with an explanation that this is not a deeded resort, so there is no deed for the timeshare.Feb - Called [redacted] to ask if TimeshareTransfers has been in contact to start the transfer processWas told NO.Feb - Emailed Timeshare Transfers inquiring on status of the transfer.Feb - Received email response from Timeshare Transfer stating that they are "waiting on the buyer details".Feb - Emailed TimeshareTransfers the buyer details AGAIN (already sent on 12/23)Also asked TimeshareTransfers to forward the $transfer fee to [redacted] ASAP.Aside from this Revdex.com complaint, my last communication from TimeshareTransfers was on February 9thOver weeks have passed and they have not acknowledged my last emailI have contacted TimeshareTransfers by phone several times, and every time I was told that the person handling the closing was unavailable and would call me backI have never received a return call from [redacted]When I do get a response it's a reply to an email I sent a several days prior.I am not complaining about the price of the transferThe point I was making in my original complaint is TimeshareTransfers already collected the $resort transfer fee from meIf they simply give that back to me I'll pay [redacted] directly and finish the transfer on ownI have spoken to the Title Change department at [redacted] and have confirmed that they prepare the necessary transfer documents for the $feeThe documents prepared by [redacted] simply need to be signed by buyer and seller and returned, and the transfer is doneAs mentioned above, there is no deed associated with this particular timeshare resort.I understand that transferring a timeshare can take up to days, but since no deed preparation is necessary to transfer this particular ownership, the timeframe should be much shorterI have been 100% cooperative and responsive to requests from Timeshare TransfersOn every single occasion I have replied back in under hours.? The client complaints are two fold:1) ? Client indicated we have not responded to calls and emails.-- ? This is unfounded? Our very detailed records show that [redacted] from our office proactively called the client on February 16, and [redacted] from our office proactively emailed the
client on February 9, ? We keep records of all correspondence and this correspondence is available upon request? It appears that the real reason for the client's complaint is Price? Which brings us to the second piece of the complaint.2) ? Client is under the impression that the resort itself will transfer title for $299.-- This is not a valid reason for a complaint as the Revdex.com website located at? [redacted] indicates that "Issues based solely on dissatisfaction of price" are not a valid basis for complaint.-- [redacted] will in fact NOT transfer the full title for the client including the deed for only $? [redacted] does not conduct deed transfers and refer all clients to outside title companies? The client is mistaken? [redacted] DOES charge $to reflect the title change but this amount does not cover the cost of deeding the timeshare.3) ? Timing of transfer-- The buyer information was only supplied by the client on December 23, and our website and all documentation clearly state that most transfers take days while some transfers can take longer? We are roughly days into the process and fully in compliance with the terms of use the client agreed to when contracting our services.We have submitted the request to [redacted] for the transfer via certified mail? Certified mail number available upon request? The terms of use also require the client to remain cooperative during transfer within days of our request? We request that the client contact our office immediately so we may continue to answer any questions that the client has and continue to cooperate with the process? We will expect a direct email to [redacted] that the client agrees to cooperate within days of the delivery of this response to the client as we are unable to complete our service without requests for signatures and other cooperation from the client.? We are happy to assist [redacted] as a courtesy but there has been no "contract assignment" of [redacted]'s account and no payment has been remitted to us by any entity for the continued servicing of his account? We are not able to reach representatives from [redacted] because the numbers we have for that company have been disconnected for several months? We spoke with [redacted] on the phone today and we have agreed to pay for the finalization of his transfer as a courtesy despite not having any formal agreement with him? The client has filed this complaint in error and has acknowledged that there was a miscommunication concerning the recording and delivery of the deed. The client acknowledges that they should have contacted our office prior to filing a complaint to resolve this issue. This has been resolved and no complaint should have been filed. Thank you.
Yes, I did recently forward invoices (this was the second time I did so, as they did not pay them earlier. It 'appears' (unless it is forged) that the deeds for two timeshares in Key West have been assumed by the company. So I will confirm *unless I hear from the resort again* that this part is complete.
However, they have never proven that the timeshare in Bermuda (St. George's Club) has been transferred and they refuse to 'prove' that they have completed any transaction.
I submitted all information to your office via this website a day ago with copies of the emails between the company and myself to document I am trying to get them to comply, but they are not doing so, therefore, the complaint remains unresolved UNTIL they can prove they have complied.They gave me a deadline so I gave them the same deadline to prove their honesty.

After 2 years of asking him what needed to be done, and what I needed to do to get my money back, I was given a choice of either another property or partial payment.. never was I given the choice of signing the supposed "property back" to the sellers name to get my escrow in full.[redacted]: Could you please attach the email indicating where this was mentioned after 2015? since the unit was closed in 2015 right? better yet, please provide the email sent yesterday to me where it indicates I have "15 days" but now its 14? here ill help you out. I'm going to attach today's emails where you sent me the ultimatum only after I had decided enough was enough of your lies and scams. Iv'e also attached the original copy sent by you for the payment amount and what I was supposed to be paying for which was not delivered.. I paid $700 for 84,000 annual points but that's not what I got was it? you still transferred the unit even though you knew beforehand that it was not what I paid for, just to get paid all the while saying nothing to me, didn't you [redacted]?At the end of the day you can give me 5 days for all I care, I wont sign another piece of paper from you until I have my money. you're a liar and a thief to the working people. fortunately, I'm not the only one who feels that way. if the money is given to the owner ([redacted]) I will be coming after you legally. FYI: If I paid for a service and or product and I got something different and or nothing at all... ITS FRAUD!

I have reviewed the response made by the business in reference to...
complaint ID [redacted], and find that this resolution is satisfactory to me.
My first notice that the paperwork had been processed was 2-22. This was apparently done sometime in November. Had the business merely replied to phone calls and emails to give me an updated status this could have been avoided. The initial reason that I was directed to this company by an "unknown" buyer who had to back out of the sale due to a loss of a job, is still questionable and appears to be a recurring issue with this vendor.

[redacted] has received proactive correspondence from our office on the following occasions in 2016 alone:2/29/16, 2/5/16, 2/1/16, 1/22/16, 1/21/16, 1/19/16, 1/4/16We have certified mail tracking numbers demonstrating we have successfully contacted [redacted] on multiple occasions on this account....
We have also informed [redacted] that his agreement specifies that he must demonstrate cooperation during transfer. This response will be our official request for [redacted] to demonstrate cooperation within 15 calendar days or we will administratively close his account as per our agreement.We require his direct correspondence and participation in the process if he is still receiving notices from the resort. This complaint is not appropriate based on our completion of our contractual obligations under the agreement.We ask that [redacted] send an email to us at [redacted] indicating that he wishes to cooperate with us. The combative nature of his emails and phone calls has been well documented and despite being in violation of the "cooperation during transfer" portion of his agreement we will still work with him if he demonstrates a willingness to communicate and remain cooperative by sending an email to [redacted]
