[redacted] *** [redacted] [redacted] [redacted] [redacted] [redacted] Dear Mediator: This letter sets forth Etsy’s position regarding the complaint dated August **, against Etsy, Inc(“Etsy”)Etsy’s service, Etsy.com, is a marketplace where people around the world connect to buy and sell unique goods To use the site, each individual must agree to Etsy’s Terms of Use and other site policies [redacted] (the “Customer”) is an Etsy member and by using the site, the Customer agreed with Etsy’s Terms of Use The Etsy Terms of Use state, “Etsy reserves the right to refuse service to anyone, for any reason, at any time.” The Customer is an Etsy member and agreed with Etsy’s Terms of Use and other site policiesEtsy's policies describe the criteria for having a shop and listing items in the Etsy marketplaceThere are very specific standards for what can be listed as on the siteThe Etsy Terms of Use state, “By listing an item on the Site you warrant that you and all aspects of the item comply with Etsy's published policies.” The policies also clearly state that, "Etsy reserves the right to suspend and/or terminate a person's account or any accounts held by that person by virtue of association, including all usernames under which that person operates on Etsy.” Etsy contacted the Customer as early as to learn more about how the items in her shop were made and to confirm that these items qualified to be sold on EtsyBased on the information provided by the Customer, Etsy’s Integrity team determined that the items listed in the Customer’s Etsy shop did not meet our site policy for what can be soldAs a result, and in accordance with these policies, the Customer’s account was suspended in The Customer then proceeded to open a multitude of shops subsequent to this suspension - in direct violation of this action against herWe take such violations very seriously, and as a result, have revoked all of the Customer’s Etsy account privileges Sincerely, [redacted] ***

Revdex.com: I have reviewed the response made by the business in reference to complaint ID# [redacted] , and have determined that my complaint has NOT been resolved because: [Your Answer Here] Etsy did not even address the concernsWhy did it take TWO MONTHS for them to tell me this information and when are the refunding the fees they took from me? This answer is nothing but ** In order for the Revdex.com to appropriately process your response, you MUST answer the question above Sincerely, [redacted] ***

Revdex.com: I have reviewed the response made by the business in reference to complaint ID# [redacted] , and have determined that my complaint has NOT been resolved because Etsy's unableness to mediate the case any further because "the customer didn't provide proof that the item was "not as described" is incorrectI already submitted 3-sets of photographs depicting the item as not as describedThe Etsy Trust team closed the case abruptly and implusively without communicating to me anythingThey requested photos (that I already sent) then when I stated I was not going to submit the same photographs for the 4/5th timeMy comment was that I wasn't going to submit the photographs because it was ludicrous, because I have already done thatThe next thing that happened was "Etsy closed the case." It seems as if no one looked into this situation between the seller and myselfJust quickly and impulsively responded when I said I wasn't going to submit the 4/set of photos and closed the case and justified it as if I was not providing proof, of which, I already didExtension accent ribbons on a wreath, does not make it 5" larger in diameterThe way the item was describedThe seller offered to credit the $for the wreath, but my issue was the $in shipping I was going to have to incurI don't feel I'm responsible for incurring the $cost when the item was not described correctlyIt says I declined the resolutionThis is inaccurateThese responses from Etsy are unacceptableIf they have/share no responsiblities with their sellers, why do they have return policies stated, where "item not described" is an appropriate catagory? I find Etsy's customer service absolutely horrificOverheard a conversation the other day in the school pickup line where a lady was complaining to another that she ordered tshirts from Etsy, they arrived incorrect and the seller wasn't going to refund her shipping either way eitherAnd she was opening a case, trying to dispute it as wellSeems very familiar to meSeems unjust to customers and a very unacceptable business practicesEtsy gains from these transactions, yet accepts no responsibilities, despite what their webpage appears to offer "returns/solutions/etc." Reguiring customers/buyers to agree to membership terms, in order to purchase anything, unbeknownst to the customer, that they have no protection from this company if the sellers are unjust/unethical/immoralThey claim to offer solutions/help, but absolutely do not do that at all, trying to worm around the issue with agreement terms, inaccurate analysis of the cases, etc., Unfair!!! "As previously stated, our records indicate that the Customer filed a Not as Described Case against the Seller on October **The Case was escalated to an Administrator of the Etsy Trust team for review on October **It was determined by the Administrator that Etsy was unable to mediate this case further, as the Customer did not provide proof that the item was “not as described.” The Case was closed on November *.The Customer may note that our records indicate that the Seller offered a resolution to this matter that is within their own shop policiesAs of today, November **, the Customer has declined this resolutionAlthough this case is closed on Etsy, the Customer is welcome to continue working with the Seller directly using Etsy Conversations, Etsy’s onsite messaging tool, if they would like to pursue a resolution. In the event the Customer has any further questions, she may contact our Trust team for more information at [redacted] In order for the Revdex.com to appropriately process your response, you MUST answer the question above Sincerely, [redacted] ***

Revdex.com: I have reviewed the response made by the business in reference to complaint ID# [redacted] , and have determined that my complaint has NOT been resolved because: [redacted] "On 214, a member of Etsy’s Integrity Team reached out to the Customer and informed her that certain of her items did not qualify to be sold on Etsy because they were not made or designed by the Customer, and did not otherwise conform to Etsy’s policies about what may be soldEtsy removed these listings." 1) If my items did not qualify to be sold on Etsy's marketplace, than Etsy Incmust apply its "Terms of Use" to ALL members who have seller account and sell iphone cases that are made by third parties over seesA few examples of such shops are listed below: [redacted] It is unethical and bias to only suspend certain shops while choosing to ignore many other shops who sell the SAME EXACT iphone cases (which according to Etsy, Inc are "not made or designed by the customer, and do not otherwise conform to Etsy’s policies about what may be sold")Many of these shops have been flagged by me on numerous occasions (I have record of each occasion) and Etsy chose not to take any action against these shops in the same manner as they did when my shop was flaggedTherefore, it is safe to conclude what I was selling was in accordance with Etsy's Terms of Use band my shop was wrongfully suspended Moreover, Etsy allows 100's of sellers to continue selling items that are not "handmade" or "vintage" after they are brought to Etsy's a Integrity Team's attention, while suspending certain shops for selling exactly the same itemsThese practices are considered discriminatory, bias, and should be penalized by lawA search on Etsy with the following key words "Chanel Iphone Case" [redacted] brings up 100's of listings that are listed in Etsy's handmade category- Etsy does not remove them and continues to make millions of dollars on listings similar to what I had in my shopMany sellers sell exactly the same phone cases, therefore Etsy's legal team cannot argue that they are "original" or "handmade" and mine were notSee below examples: [redacted] 2) I have cancelled over orders to date and I have $in "transaction fees" that have been credited to my Etsy Bill (see attachment), but Etsy, Increfuses to refund this money back to my credit card ending in [redacted] as was promised to me on February ***, by [redacted] from Etsy's Integrity Team in her email When emailing Etsy about the money due to me (see attachment), Etsy does not even find it necessary to respond to meOnce again I have cancelled over 80% of my orders to date, like I was instructed by ***, but these fees are still sitting in Etsy's bank and have not been returned back to me I am demanding that my "transaction fees" and my "listing fees" be refunded back to my credit card ending in [redacted] because my shop was wrongfully suspended as indicated by the sample shops that I've linked above (all which are still open)If my money will not be refunded to me, I am going to process a chargeback with my credit card for the full amount that Etsy charged me for services that were not rendered to me, but are being rendered to similar shops as mine Finally, I sincerely appreciate your invitation to contact Etsy directly via email about this issue, but unfortunately no one from Etsy responded to the last emails that I sent regarding this matter Regards, [redacted] *** [redacted] In order for the Revdex.com to appropriately process your response, you MUST answer the question above Sincerely, [redacted] ***

Revdex.com: I have reviewed the response made by the business in reference to complaint ID# [redacted] , and have determined that my complaint has NOT been resolved beca What a bunch of lies amazing how esty protects there ownFirst off I never stated [redacted] inspired that was stated from [redacted] and esty employee who was back peddling knowing that these are [redacted] and have listingfs Secondly Esty have over a listings of others selling exactly the same items I sell they are being discriminating to cover themselvesThey had an abussive Buyer who wanted to buy off the website and when I called her cheap she threatened to do this and Etsy moved without doing there researchI protected there policy making sure that they did not mis out on commissionThey have cost me alot of money sales and reputation to cover there none senseIf this is there policy than all listings should be removed of the same [redacted] itemThe mediator should go on the website and search Dust bag to see all the designer dust bags that are exactly the same to know that you discriminate and took my moneyI also have the documentation about the abusive buyer who threaten this state she had nothing to lose In order for the Revdex.com to appropriately process your response, you MUST answer the question above Sincerely, [redacted]

Revdex.com: I have reviewed the response made by the business in reference to complaint ID# [redacted] , and have determined that my complaint has NOT been resolved because: Etsy, again, did not address the fact that I appealed my shop through Etsy’s appeal process, and received resolutions from both parties with copyright infringement (CI) complaints against my shop and my shops were still not open Both parties said they didn’t have a problem with Etsy opening my shop I find it contradictory that they continue to collect listing fee revenue from listings on Etsy with CI and from sales of items that have CI At the time of this writing Etsy has over 7,Oscar listings, over 13,Lego listings, over 42,Harry Potter listings, over 185,Disney listings, over 4,Hunger Games listings, 28,Hello Kitty listings, and the list goes on and on Each listing fee is $ Do you see what I’m getting at? In addition, when shops are terminated, Etsy keeps all listing fees I have never asked for any refund of listing fees, so I’m not sure what Etsy is talking about Another point that should be mentioned here is that I have always paid all Etsy fees and had 100% positive customer reviews I did agree to Etsy’s terms and policies, I absolutely did, all the while thinking I was joining a community that cared about its sellers I was disappointed to experience those policies being used against me instead of helping me They are well aware of rampant CI and their position is that those stores have to be turned in Etsy can do anything they want, it’s their site and they can change their policy to whatever and whenever they need to They hide behind their “policy” It’s a crutch, Etsy made these policies, they can change them Their policies work perfectly in Etsy’s profitable favor CI is a known problem and they never sent anything in their weekly Etsy Success emails regarding avoiding CI A simple paragraph explanation of CI would help many shops avoid CI Etsy promotes themselves as loving their sellers, but their words don't match their actions They are aware of CI and they don't warn us adequately A simple web search for “Etsy closed my shop” will show story after story of shops that have been closed for CI These stories go back years! They want us to be shut down! The emphasis in their last response would be more effective in their emails and their wording, “may” should be “will” shut down your shop permanently A paragraph explanation of CI is not legal advice and I am not asking for legal advice, nor did I ever ask Etsy for legal advice The Etsy form letter email dated would be an excellent place for CI explanation Of all the weekly Etsy Success emails to Enlarge Your Shop, Get More Hits, Get More Reviews, Coupons to Increase Business, How to Write Better Descriptions, Quit Your Job, etc There has never been anything about CI A definition of CI is not legal advice Now that I understand CI, I'm not surprised I didn't get turned in sooner I had Disney, Star Wars, Big Bird, Sponge Bob Square pants, Cookie Monster, Hello Kitty, Little Nemo, Lion King, etc It appears that Etsy does not want large shops on their website Once my monthly sales started really growing, all of a sudden I had complaints regarding CI Make the punishment match the crime We're not allowed to open a shop ever? A 30, 60, day suspension would be more effective and appropriate especially if they showed any interest in really helping their sellers And not for nothing, now that I understand CI, I for sure, will never have CI since I don't want my shops closed I am still beyond disappointed with Etsy I hope other shop owners will be able to learn from this situation so they do not go through what many Etsy sellers have experienced In order for the Revdex.com to appropriately process your response, you MUST answer the question above Sincerely, [redacted]

I left a truthful review on this seller, [redacted] (of which I have evidences to prove) and she responded at my review in a very dishonest way by defaming my character as a buyerAccording to her, I filed a dispute within days of my purchase, then she said that "once the package arrived, she claimed it was empty", and she said that I was determined to get the charms for freeAll of these are a lie! I bought the item on Jan [redacted] and didn't receive anything, I contacted the seller, and she didn't respond at allSo, then I filed a case on January *** And so where did she get that I "claimed that the box was empty" if she didn't respond to my emails and didn't even talk to meShe closed the case by saying the merchandise was lost in the mailYou need to get at the bottom of this, If this seller will not Be honest on her response Regarding my review, then this is a clear case of Libel This seller represents ETSY and she is not doing a very good job on it! this is the link of my review and the seller's ( [redacted] ) response [redacted] I just started buying [redacted] charms at ETSY and not all of the sellers are like this seller, [redacted] who is rude, liar and doesn't have proper business etiquette I hope this seller ( [redacted] ) will be reprimandedAnd I want her response against me will be removed The rate "0" below is for the [redacted] seller alone

Why is that this business has a high rating by the Revdex.com but there is no contact information for this company for buyers to call and resolve any issuesI have tried to find a working number with a actual person to answer and I can't find anyoneI have paid for an item on Etsy and it has been months and I never received the itemThe seller won't respond and Etsy has not responded back as wellHow Does the Revdex.com actually know this company is located where they claim it is? How can a legitimate company not have a phone number to call in
