As a result of hearing concerns such as Ms*** has been kind enough to share with us, in the past we began to use a third party verification company who interviews (in a recorded phone call with the homeowners permission, which we then archive and can easily access if needed in
the future) every homeowner enrolling into our wonderful program for homeowners, to protect both our company and our valued homeowner members to be sure they know the few simple facts about our program, to confirm they reviewed our simple one page homeowner enrollment agreement and entered into it, and to confirm their identity. Our wonderful homeowner program is free for homeowners to join, free for them to be a member, and if in the future they sell their home using their choice of the more than 5,cooperating broker offices in our national network, or if they never sell their home, they pay us $for the up to $2,or more in major brand gift cards or checks we send to them (their member rewards for being in our program). Our program provides valuable benefits to our homeowner members, for which they pay us $We pay our homeowner members between $and $10,for being a member, depending on the value of their home.Homeowners can only benefit by being in our program, while paying $to be in our program. One of our staff members left a phone message for Ms*** todayWhen she returns the call and we speak with her we will resolve any issues with her to her satisfaction.Thank you

Mrs*** spoke with an independent marketer about our program, for which homeowners pay $0.
Per her request, *** ***'s registration has been canceledWe now use third party verification, with recorded phone calls, to be sure any homeowner in our
program is verified through an independent third party

*** *** spoke with an independent marketerThe marketer she spoke with is NOT an employee of our company, and is not contracted by our company, and has no interaction with our companyThis complaint should have been filed against the company
employing the marketer who spoke with *** ***We cancelled their registration, and emailed them to let them know*** *** thanked us for doing so, and apologized for "the bad feedback on the Revdex.com website"

The marketer Mr*** spoke with is not our employeeHe works for an independent contractor marketerWe have forwarded Mr***'s complaint to that contractor.
Homeowners pay $to join our program, $to be in our program, and $if they never sell their home or sell it
some day in the future using any broker in our program they chooseOur program is beneficial for homeowners, and any suggestion to the contrary is illogicalAny suggestion that the program is a scam is absurdMr*** contacted us on December 18th, and we immediately cancelled his registration, and informed him that we had done so, with no costs, obligations or penalties whatsoeverSo, the desired settlement Mr*** requested was already provided to him on December 18, 2014, which he already knows as a result of his communication with us on December 18th

And they can keep it even if they never sell their home! When the home sells in the future, the cooperating broker pays us an industry standard referral fee. We ALWAYS put our homeowner members, our clients, first, above all else Pursuant to *** wishes, we have cancelled their registration in our program, and as a result, as *** desires, we will not be paying *** and his wife $to $10,(for which they would have paid $0) Thank you

Homeowners pay us $to join our program, $to

No homeowner has ever been asked to pay us one

We pay our members between $and $10,to be

program)
*** or his wife apparently spoke with an independent contractor
marketer employed by a third party marketer (not employed by us) about our wonderful
program for homeownersThe marketer is no longer marketing
our program
Any agent with a broker listed as one of
our cooperating brokers who claims they 'never heard of Exceed' or 'has no dealings with Exceed' is
either honestly ignorant of the facts, or is simply a
fraudulent liar.
We, as a licensed real estate broker, enter into
cooperating broker referral agreements only with other brokers, and never with
agentsWe are in long term agreements with more than 1,real estate
brokerages across the United States, comprising more than 5,000 offices,
and in those offices are more than 250,licensed real estate agentsAmong
our more than 1,000 contracted cooperating brokers are 70% of the
largest brokerages in the United States (almost all of the other 30% are in
states in which we are not active).
Any agent who recommends a homeowner not be
in our program does so to put more of the homeowner's money into
the agent's own pocket (taking it out of the homeowner's pocket)
We give our members cash benefits to spend
on whatever they want to buy themselves, on average years before they sell
their home! And they can keep it even if they never sell their home! When
the home sells in the future, the cooperating broker pays us an industry
standard referral fee. On a home such as ***'s home, he and his wife would have received $from us for being in the
program.
We ALWAYS put our homeowner members, our clients,
first, above all elseApparently, whatever agent *** spoke with does
not do the same, and instead puts his needs above ***'s and ***'s wife's needs
The 'penalty' *** mentionsas mentioned above,
we have never asked a homeowner to pay us one penny, and no homeowner has
ever paid us one penny
To be clear, any agent who makes any statement
about being or not being a part of our program is being dishonest, as no agent
can ever be a part of our programonly the brokers they work
for can be a part of the programAny agent who is affiliated with any of
our cooperating brokers is 'a part of our program' if they want to sell
our member's home, whether they want to be a part or do not want to be a
part.
So, if *** thinks it is better for *** and his wife to NOT receive $from us, then *** indeed should not be a
member of our Smart Homeowners Program (we named the program for our members)
Pursuant to his wishes, we have cancelled ***'s and his wife's registration in our
program, and as a result, as *** desires, we will not be paying *** and
his wife $(for which they would have paid $0)

I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to meTo answer their questions:I never spoke to a single representative about this programNo one called me or came to my door and I did not sign up for this on my own so I am very skeptical about this. Reasons Why It Seems Like A Scam:Because of the, above I am VERY skeptical when I am sent information telling me that I have joined a program and even more skeptical when a random company I have never heard of sends me a live check. It is always nice to receive free money, but when I have never heard of the company or received ANY correspondence from them, it seems fishy at best. The letter that I received stated that I joined this program in I have never received any correspondenceIf I joined in 2014, why was I sent a check years after that? For what reason? The letter that I received also indicated that I MUST contact this company before I sell my houseThis seems like a threat - if I do not call this company (which I have no intention of doing) what will happen? Will I be sued? Will I have to pay a fine? Will I have to pay back all this money they have sent me? It doesn't make sense. I fear what will happen to me if I cash this checkI worry if it is some sort of virus that will steal my information or bind me to some unknown contract. In short, I have only ever received one single piece of correspondence from a company I have never heard of (nor had my lender) - a letter stating I signed up, with a live check for $telling me that I have to contact them if I want to sell my houseI do not trust this at all, which is why I went online to do some diggingSeveral sites mentioned this to be a scam and they had over complaints on Revdex.com. I am satisfied with the response because I received an email yesterday from someone stating that my "membership" had been canceled.
Sincerely,
*** ***

All has been resolved with *** We were in the midst of changing over to a new phone systemNoemi has chosen to remain in our wonderful program for homeowners, and is now selling her home.Thank you

Homeowners pay us $to join our program and become a Member, $to
be a Member, $if they sell their home some day using any cooperating broker
they choose among our more than 5,cooperating broker offices across the
USA, $if they never sell their home
No homeowner Member has ever been asked to pay us one
pennyNo homeowner Member has ever paid us one penny
We pay our Members between $and $10,to be
a Member (amount determined by the value of the Member home when they join our
program)
It sounds like Mrs*** spoke with an independent contractor
marketer employed by a third party marketer (not by us) about our wonderful
program for homeowners
We give our Members $to $10,in cash benefits to spend
on whatever they want to buy themselves, on average years before they sell
their home! And they can keep it even if they never sell their home! When
the home sells in the future, the cooperating broker pays us an industry
standard referral feeAnd our homeowner members pay less (by getting
the $to $10,in Member Rewards from us for which they pay $0)
On a home such as Mrand Mrs***'s home, they would have received $2,from us just for being in the
program (starting with the first $check they say they just received from us), for which they would pay $As they state it, an independent marketer 'duped' them into getting $2,for which they would pay $I wish someone would 'dupe' me into getting $2,for which I pay $I wish someone every day could 'dupe' me into getting $2,for which I pay $
So, by not being in the program, Mr*** and his wife voluntarily gave away $2,that they could have otherwise spent onanything they desired.
We ALWAYS put our homeowner Members, our clients,
first, above all else
If Mrand Mrs*** think it is better to NOT receive $2,from us, for which they pay $0, then they indeed should not be a Member of our Smart Homeowners Program (we named the program for our Members)
Pursuant to their wishes, we have cancelled their registration in our program, and as a result, as they desire, we will not be paying them $2,(for which they would have paid $0)
Thank you

Mr***'s registration has been cancelled. Mr*** apparently does not understand the 1.2% he references. The 1.2% is payable to Exceed ONLY if Mr*** were to violate his agreement by using a broker to sell his property that is NOT one of Exceed's cooperating brokers. Now in our
10th year in business, we have never asked a homeowner to pay us 1.2% of anything, and we are not aware of any homeowner that has violated our very simple agreement. Homeowners pay $to join our program, and $to be in our programOur members may choose to never sell their home, or may sell their home if they choose to do so in the future using any broker they select within our network of more than 1,cooperating brokers with their more than 5,participating offices, and in either case, they pay us $0.Our program is wonderful for homeowners, and it is a shame when people make statements about the program. The 1.2% is clearly stated in BOLD CAPITAL LETTERS in our one page homeowner enrollment agreement, which is emailed to every homeowner who joins our program, and is available to homeowners to review when they are registering to join the program. In addition, we are implementing third party verification, which will result in a 3rd party company calling and speaking with every homeowner who registers to join our program, which will provide a 3rd opportunity to be sure that every homeowner joining our program knows 100% of the very few things to know about the program, which ideally will result in zero additional complaints about something that is made abundantly clear to every homeowner who joins our program

Homeowners pay us $to join our program, $to be a member, $of they sell their home some day using any cooperating broker they choose among our more than 5,cooperating broker offices across the USA, $if they never sell their home.No homeowner has ever been asked to pay us one pennyNo
homeowner has ever paid us one penny. We pay our members between $and $10,to be a member (amount determined by the value of the member home when they join our program).*** spoke with an independent contractor marketer employed by a third party marketer (not by us) about our wonderful program for homeownersAccording to ***, the third party marketer failed to accurately explain the program to himThe marketer is no longer marketing our program.Any agent with a broker listed as one of our cooperating brokers who claims they 'never heard of Exceed' is either honestly ignorant of the facts, or is simply a fraudulent liar. Any agent who says 'only very inexperienced agents would ever agree to this deal and thus you are putting the sale of your most important asset into the hands of someone I would never choose to sell my house' is again either honestly ignorant of the facts, or is simply a fraudulent liar. We, as a licensed real estate broker, enter into cooperating broker referral agreements only with other brokers, and never with agentsWe are in long term agreements with more than 1,real estate brokerages across the United States, comprising more than 5,000 offices, and in those offices are more than 250,licensed real estate agentsAmong our more than 1,000 contracted cooperating brokers are 70% of the largest brokerages in the United States (almost all of the other 30% are in states in which we are not active). Any agent who recommends a homeowner not be in our program does so to put more of the homeowner's money into the agent's own pocket (taking it out of the homeowner's pocket). We give our members cash benefits to spend on whatever they want to buy themselves, on average years before they sell their home! And they can keep it even if they never sell their home! When the home sells in the future, the cooperating broker pays us an industry standard referral feeAnd yes, while the homeowner pays less (by getting the member rewards from us), the agent will be paid a lower commission. On a home such as ***'s home, the agent selling the home would earn approximately $13,if *** was not in our wonderful program for homeownersIf *** was in our wonderful program for homeowners, the agent would earn approximately $8,540, while *** and his wife would have received $2,from us for being in the program. So, in this example, by an agent scaring *** out of the program, *** will cause the agent to be paid $4,more, and *** and his wife will get $2,less. Question: Who wins and who loses if *** is NOT in the program? Answer: The agent wins*** and his wife lose! Also, contrary to ***'s assertion, our homeowner members themselves choose which of our many outstanding cooperating brokers they would like to work with when selling their homeThey may change their selection any time at no cost, as often as they like, until they enter into a listing agreement with their chosen broker to sell their home.We ALWAYS put our homeowner members, our clients, first, above all elseApparently, whatever agent *** spoke with does not do the same, and instead puts his needs above ***'s and ***'s wife's needs. The only 'gotcha' our members experience is getting $to $10,from us and paying us $Seems to be a really great 'gotcha' for our members. The 'penalty' *** mentionsas mentioned, we have never asked a homeowner to pay us one penny, and no homeowner has ever paid us one penny. To be clear, any agent who makes any statement about being or not being a part of our program is being dishonest, as no agent can ever be a part of our programonly the brokers they work for can be a part of the programAny agent who is affiliated with any of our cooperating brokers is 'a part of our program' if they want to sell our member's home, whether they want to be a part or do not want to be a part. Seems pretty obvious why an agent who puts their needs above the client's needs may not like our programThe agent gets less, the homeowner gets more.If the agent selling ***'s home were to earn a commission for selling ***'s home of $8,instead of $13,139, so that *** and his wife could receive $2,from us in Member Benefits:If the agent put in hours of time to sell the home, the agent would earn $an hour (instead of $an hour if *** and his wife were not in the program). If the agent put in hours to sell ***'s home, the agent would earn $1,an hour (instead of $an hour if *** and his wife were not in the program). So, if *** thinks it is better for *** and his wife to NOT receive $2,from us, and instead *** thinks his chosen agent should earn $an hour instead of $an hour, or $1,an hour instead of $an hour, then *** indeed should not be a member of our Smart Homeowners Program (we named the program for our members).Pursuant to his wishes, despite *** seeming to acknowledge in his complaint that he gave his information and 'consented' to be in the program, we have cancelled his and his wife's registration in our program, and as a result, as *** desires, we will not be paying *** and his wife $2,(for which they would have paid $0).Thank you
