July 12, 2016Revdex.com Serving San Diego, Orange and Imperial Counties 4747 Viewridge Ave., #200San Diego, CA 92123[redacted]Dear Revdex.com.Our office recently received your correspondence of July 11, 2016 regarding the above mentioned consumer's rebuttal of our response to his complaint. Our records indicate that we have not previously received this rebuttal. Our records further indicate that investigations of [redacted] were previously initiated on 6/23/13 and 6/27/16. In both instances the information was verified as accurately reported by our vender's review of the bankruptcy documentation on file at the bankruptcy court. Our own review of the public record confirms the consumer's full name, former address and the last 4 digits of his Social Security number. We are in the process of providing this documentation directly to the consumer for review. If a bankruptcy is withdrawn before a final judgment the federal Fair Credit Reporting Act (FCRA), Section 605 (d) (1), states "the consumer reporting agency shall include in the report that such case was withdrawn". The bankruptcy dismissed/withdrawn status remains on the consumer's Experian credit report for seven years from the filing date.According to the federal Fair Credit Reporting Act (FCRA), a national consumer credit reporting agency's role in the dispute process is to review the accuracy and completeness of any disputed item which may include contacting the furnisher of the information or the vendor that collected the information from a public record source, such as a court or other government office, notifying them of the disputed information and disclosing all relevant information regarding the consumer's dispute. In order to help resolve the consumer's dispute, Experian will review all relevant documents submitted by the consumer with the dispute and will forward such documents to the furnisher if Experian is unable to resolve the issue based on those documents. Consumers may also contact creditors or the public records offices directly to dispute reported items. If the issue is not resolved, then the consumer credit reporting agency must offer to include a consumer statement on the personal credit report. If the consumer believes that the bankruptcy was filed in his name without his knowledge, he should contact the Bankruptcy Trustee as outlined on the bankruptcy documents: [redacted]
If the consumer has any additional supporting documentation regarding the disputed information, they may forward that directly to me for review.Thank you for allowing me to assist you. Please contact me directly if you have any questions.Sincerely,[redacted]

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
The right to dispute the debt and receive validation are part of the consumer's rights under the United States Federal Fair Debt Collection Practices Act (FDCPA) and are set out in §809 of that act, which has been codified in Title 15, Section 1692-1692p of the United States Code. According to FCRA 611 (15U.S.C 1681I) Certification of accuracy of information. If any information has been deleted from a consumer's file, the information may not be reinserted by the consumer reporting agency. If any information has been deleted from the consumer's file is reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing not later than 5 business days after the reinsertion or, if authorized by the consumer for that purpose, by any other means available to the agency. This has not been done AT ALL. The credit bureau has not verified any information nor did I receive any documents that Experian or Enhanced recovery company would be placed on my file.I would like this item to be removed and deleted from my file immediate.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
This is a standard response by Experian addresses NONE of my key items in my complaint. Let me repeat:1.) By law, FCRA Section 611, Experian is REQUIRED TO RESPOND TO THE CONSUMER FOR ALL DISPUTES INITIATED BY THE CONSUMER. Disputes received by Experian (per certified mail) on 2/9/2015 and 4/6/2015 went UNANSWERED by Experian. Violating my consumer rights under Section 611 of the Fair Credit Reporting Act.2.) Experian has provided ZERO PROOF they made contact with the data furnisher regarding my dispute received on 6/24/2016 to verify my account information with the data furnisher. IN FACT, I disputed the same account with another credit bureau around the same time, and the dispute was deleted due to NO RESPONSE from the data furnisher. I want proof, that Experian did indeed send an Automated Consumer Dispute Verification (ACDV) to the data furnisher, regarding my dispute received on 6/24/2016.3.) Experian DID NOT ADDRESS my dispute, regarding the account number including my SSN, which is violation of my consumer rights under the [redacted] Safeguards Rule. My SSN is still part of my account number for the account I'm disputing, which is not safeguarding my non-public personal information, and against the law, and again violating my rights. Per their 2015 CRRG manual, if the data furnisher does not mask/scramble my SSN in an account number, and leaves it unscrambled "in whole or in part", they are required to delete the account to safeguard my non-public personal information. They have failed to properly have the data furnisher scramble my SSN in my account number, or have it removed, again, violating my consumers rights under the [redacted].I can provide a copies of the certified mail receipts, the 2015 Credit Reporting Resource Guide (CRRG), as well as Fair Credit Reporting Act and Gramm-Leach-Bliley Act if they are unclear of the law, and/or are unclear of my rights they have violated in not just one, or two, but all three cases cited above.I want:1.) For Experian to acknowledge that all the above is accurate, and my consumer rights have been violated per all the instances cited above. Especially regarding NOT RESPONDING to my disputes in February 2015 and April 2015, which they are required to do, per FCRA Section 611.2.) For Experian to do their job, with regards to respecting my rights under the FCRA and [redacted], by contacting the data furnisher, and having the data furnisher MASK OR SCRAMBLE MY SSN in my account number, to protect my non-public personal information, and comply with the CDIA's guidance in the 2015 CRRG regarding SSN's included in whole or in part in the account number of a disputed account. If no response is received from the data furnisher, they are instructed to delete the account per the 2015 CRRG.It is Experian's job as a credit reporting agency to perform the above. They are not going to pawn this off as the data furnisher whose the problem. Experian is the one not doing their job and respecting consumers rights. That's not me talking, that's the law talking, per the FCRA and [redacted].
Regards,
