consumer's personal credit report.We are currently investigating the disputed information with which the consumer disagrees. Upon completion of this process, we will provide the results of our investigation directly to the Consumer.Judgments, Tax Liens and Bankruptcies are a matter of public record. Although the court where the disputed public records are filed may not report this type of data, a vendor may collect this data directly from the court's public records and supply that information to Experian. Experian does not divulge the names of our vendors as this is proprietary information and they are not the source of this public record information. Experian's method of verification for public records complies with the requirements of the Fair CreditReporting Act (FCRA).If a bankruptcy was dismissed or withdrawn, it appears on the consumer's personal Credit report because every action that relates to credit may become part of the credit history. So even though the court did not allow the filing of the bankruptcy or the bankruptcy did not go through, the fact that the case was documented allows it to appear on the personal Credit report.According to the Fair CreditReporting Act (FCRA), Section 605(d) (1), if a bankruptcy is withdrawn before a final judgment "the consumer reporting agency shall include in the report that such case was withdrawn". The bankruptcy dismissed/withdrawn status will remain on the consumer's Experian Credit report for seven years from the filing date.When a consumer disputes the accuracy or completeness of information on the personal Credit report and tells us specifically why they believe the information is inaccurate or incomplete, we process the dispute as required by law. We ask the source to check their records to verify all of the information regarding the item questioned, and report back to us within 30 days of the date that we received the consumer's request. Once we receive their response, we send the consumer the results of the investigation. consumer on June 1, 2017 and July 14, 2017.Each national consumer credit reporting agency may interpret the requirements of the Fair Credit Reporting Act differently and each company has their own policies and guidelines for disputing information. Therefore, we cannot update or delete information in our database based on the results of a dispute with another consumer credit reporting agency nor can we dispute information for a consumer with another consumer credit reporting agency.If the consumer disagrees with the results of the reinvestigation, it is the consumer's legal right, under the FCRA, to add a 100-word statement specifying the nature of their dispute. The statement will appear with the item as long as the item remains on the Credit report. Any further concerns regarding the disputed information may need to be directed to the data furnisher reporting this information. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
I am not satisfied with this resolution because I never received written notification of any accounts being re-added to my Experian credit report. I have repeatedly requested proof of VERIFICATION in writing addressed to me from Experian about these accounts and that proof has never been furnished to me by Experian to this day. Instead, I have received hearsay from one company to the next with no verification or validation, which is a willful violation of my consumer rights (FCRA Section 611). My consumer rights have been violated in numerous ways by Experian for over four years and I would like this issue to be resolved expeditiously, as it is hindering my life. Please remove said negative accounts that have still have not been legally verified or validated by way of factual proof in writing addressed to me since my first request in 2013.
