Dear Better Business...
Bureau:
Our office recently received your correspondence of October 13, 2014 regarding the above mentioned
consumer's personal credit report.
We are currently investigating the information with which the consumer disagrees. Upon completion
of this process, we will provide the results of our investigation directly to the consumer.
When a consumer disputes the accuracy or completeness of information on the personal credit report
and tells us specifically why they believe the information is inaccurate or incomplete, we process the
dispute as required by law. We contact the furnisher of the information or the vendor that collected the
information from a public record source such as a court or other government office either
electronically or by US Mail. We ask the furnisher or the vendor to conduct a thorough and complete
investigation to verify all of the information regarding the disputed item, and report back within the time
frame required by law. We review and consider the response to determine whether to accept it, reject
it, or follow up for additional information. If, after processing, we find that the disputed information is
inaccurate, incomplete or cannot be verified, we then delete that information, or modify that
information, as appropriate, based upon the dispute and the results of our processing. If we do not
receive a response from the furnisher or the vendor within the required period, we update the item as
requested or delete the information, In some instances, upon reviewing the credit file and any relevant
information submitted to us, we are able to determine whether the disputed information should be
changed or deleted without having to contact the furnisher or the vendor. Investigations can take as
long as 30 days to reach a conclusion. After we complete our processing, we send the consumer the
results.
In addition to the consumer's right to dispute information in the credit file with the credit reporting
agencies, the consumer also has the right to dispute information in the credit report directly with the
furnisher of the information.
If the consumer questions the results of the dispute process, then they may want to contact the
furnisher of the information directly or review the original information in the public record. Please refer
to the original personal credit report for the furnisher or public records office name, address, and
phone number (if available).

Experian's method of verification for public records complies with the requirements of the Fair CreditReporting Act (FCRA).If a bankruptcy was dismissed or withdrawn, it appears on the consumer's personal Credit report because every action that relates to credit may become part of the credit history. To whom it may concern:I am frustrated with Experians ability to respect the Fair Credit Reporting act. The [redacted] account is one of a few accounts that they allow to show in collections and RECENTLY charged off despite acknowledging to me and the CFPB that this account was charged off in...
6/2011 and out of the statue of limitations in 2014. They allow [redacted] and other creditors to just verify my name, address, and social security number without them verifying that the way they are reporting the debt is the current status. [redacted] and other creditors use this trick to collect on time barred debt they can't sue for. Experian is allowing them to report this way and refuses to require them and other creditors to show the last payment received to verify the age. Chase is another account I was 1099 for in 2013 because it was out of the statue of limitations then and they allowed them to reinsert the balance as collectible. This evidence is being viewed by the CFPB for potential fines and contempt of the Fair Credit Reporting Act.Sincerely,[redacted]

grantors to verify the consumer's identification in case someone is using their information without their consent. We are currently investigating the bankruptcy information with which the consumer disagrees. Upon Completion of this process, we will provide the results of our investigation directly to the consumer. If a bankruptcy was dismissed or withdrawn, it appears on the consumer's personal Credit report because every action that relates to credit may become part of the credit history. So even though the court did not allow the filing of the bankruptcy or the bankruptcy did not go through, the fact that the case was documented allows it to appear on the personal Credit report. According to the Fair Credit Reporting Act (FCRA), Section 605(d) (1), if a bankruptcy is withdrawn before a final judgment "the consumer reporting agency shall include in the report that such case was withdrawn".We have mailed a current credit report directly to the consumer for review. If there is information appearing on a credit report that is believed to be inaccurate or incomplete, we must have a specific dispute. Examples of specific disputes are as follows: "not mine, paid in full, never delinquent or included in bankruptcy" or for public record disputes: "not mine, paid/satisfied, vacated or filed in error". If the status dates, amounts, balances or other specific data is incorrect, the consumer should also indicate what the correct information should be. Please specify the item or account name and number. Please provide the consumer's specific disputes along with their complete identification information (Social Security number, full name, current address, previous addresses in the last two years and date of birth). Also, please include one copy of a government issued identification card, such as a driver's license, state ID card, etc., and one copy of a utility bill, bank or insurance statement, etc. By federal law, your personal Credit report must list all organizations that have requested your Credit history. In accordance with the Fair Credit Reporting Act, entities who have certified to Experian that they have a permissible purpose may inquire about credit information. For example, organizations that have granted you creditor with whom you have applied for Credit, or entities collecting on transactions that you initiated or on judgments rendered against you, are permitted to make inquiries on your credit report. Requests for your credit history remain on the personal Credit report for at least two years.Experian strives to achieve a high level of customer service for all the Consumers they assist.
