[redacted] has reported 20 some 90 day lates on my credit - how can this be when I filed for bankruptcy in 2009 and the loan the acquired was discharged - they got the loan in Sept 2011 ,how can they report late on an item that was discharged.Then they turned the loan over to Nationwide Debt ( they can not service this due to they are a debt collector and this was on a mortgage ) 
 
[redacted] is trying to collect on medical - this is a breach of the HEPA Law - how did they obtain my personal information ( on a previous credit report they were stating Dr [redacted] - no they are stating [redacted] . If you review the account number they will trace back to the original collector

Our office recently received your correspondence of October 17, 2017, regarding the above-mentioned consurner's rebuttal of our response to their complaint.Our records indicate that we previously investigated the [redacted] on 04/11/14, 07/05/17, 09/20/17, 10/0417, arri 10/05/17. In each instance our vendor confirmed the accuracy of the inforrnation as reported.Judgrnents, Tax Liens and Bankruptcies are a matter of public record. Although tre court where the disputed public records are filed trey not report this type of data, a vendor may collect this datadirectly from the court's pubic records and supply that information to Experian. Experian's method of verification for pudic records complies with the requirements of the Fair Credit Reportirg Act (FCRA).When a consumer disputes the accuracy or com*teress of inforrnation on the personal credit report and tells us specifically why they believe the information is inaccurate or incomplete, we process the dispute as required by law. I have 15 years of experience testing/supporting software and web applications in both startup companies and established businesses, of which, my main job duty for the past 6 years has been writing database query language ([redacted] both MS & [redacted]) through system migrations requiring data modeling, and troubleshooting data-integration and data-quality issues.  My findings at Experian:I)                Representatives updating incorrect information does have a negative impact to credit reports/scores:a.     Programming logic for credit score calculation might be based on things like account type (e.g. revolving debt, installment debt), amount of debt this month compared to last month, amount of debt yesterday compared to today, etc., was a payment made (account in good standing?).b.     Programming logic might look something like a "case-when" statement or an "if-then" statement that might look like: If "X" and "Y" then "Z". These statements can be paragraphs to pages long. I once received and troubleshot a query that was 67 pages long when pasted into a word doc.c.     Programming logic using if-then statement example as it impacted my credit score: IF my balance yesterday on three installment accounts was $0 AND today the balance of the three installment accounts total $15,000 (I just increased my installment debt by $15,000 overnight which is not supposed to happen with installment debt unless I defaulted and/or have penalties), THEN my credit score decreased by 15 points.d.     YES, EXPERIAN ADDED BACK MY SEPTEMBER BALANCES TO MY OCTOBER CREDIT REPORT THAT WERE PREVIOUSLY $0 BALANCE - HAVING A DIRECT AND NEGATIVE IMPACT TO MY CREDIT SCORE. Why didn’t the Experian representative not see that my accounts had been updated by my debtor to $0 balance, problem solved?!! (FYI – this could be impacted by Experian account IDs don’t match debtor account IDs on statements– see below.)e.     The negative impact to my credit score is not rectified when the balances are corrected back to $0 because the bad data still exists in the database and is used as part of the calculation of my credit score. I received an additional loss of 8 points when the balance was returned to $0. In a matter of 2 weeks I lost 23 points of my credit score for paying off $15,000 in student loans. My score is still bouncing around. II)              Account numbers at Experian do not match account numbers at debtors:a.     If I am disputing information on Experian, and I have 6 student loans, in the dispute the account number lists the beginning "X" amount of numbers and not the ending. The beginning "X" amount of numbers are the exact same for all 6 loans. It’s a crap shoot.b.     Even if I could see the ending numbers instead of the beginning, the accounts on my statements from my lender do not match the account numbers for the same loans at Experian. So any document I submitted in support of my dispute are null/void. I know because I had a call with an Experian rep and a Navient rep, and they could not communicate with each other about the account numbers… they had to go by year/mo of loan and original loan balance. A real hoot!III)             Uploading documents is broken, ineffective and creates duplication of effort:a.     Greater than six times on three separate occasions I tried to upload documents each 523KB to support my disputes, and I received errors that my documents were to large, that they must be under 15MB. I think I successfully loaded 3 times on separate occasions.b.     Experian rep could not locate the documents I loaded stating there was one from 2015. Once he found the document (single) he said there were just 6 blank pages and no information. He could not help me.c.     Dispute cases were created for the document uploads instead of being associated to the existing disputes. Please note that when filing a dispute, one does not receive an email with the report number, and cannot view the dispute until resolved... so someone like me does not have access to the report number to reference when uploading documents. Please email confirmation of the dispute at the time filed with the report ID!IV)            Credit Score Simulator is incredibly accurate until it’s not:a.     If I consistently get the predicted increases to my credit score due to Experian’s Credit Score Simulator calculation, then it creates precedence.b.     The Credit Score Simulator calculated an increase of 15 points for paying off $15,000 in student loans. It would put me over my goal of a greater than 800-credit score. c.     I earned a 23 point decrease, 38 (15+23) points lower than expected. Someone needs to fix something here. Wording maybe? Like if you pay down (not pay off) student loans, you’ll get an increase, and do not file a dispute, it will negatively impact your credit score.d.     I’ve actually paid off $12,000 in credit card debt and $15,000 in student loans and my credit score is lower today than it was before I paid off $27,000 in debt on October 17, 2017. I was at 788 and now I'm currently at 783. I have to say it, all my accounts are in good standing, and my one ding is from 5.4 years ago. If Experian puts bad data in the database from which the credit scores are calculated then, they are actually responsible for the credit score they provide/present.  Who is your data architect and application architect, and who is responsible for writing the code that calculates credit scores? Who is your test engineer? In other words, who's responsible for this stuff?! How do you get feedback? How do you utilize the feedback? What is your quality metrics? KPIs? Who are you accountable to if not the consumer?I've had a run-on of crappy experiences with Experian, and rather than address the issues, Experian provides canned responses and are lacking in accountability for their tracking of consumer credit.

Yet they still answer the same way. Either verify the accounts or delete them and you have done neither. I've also opened a complaint with the (CFPB) Consumer Financial Protection Bureau and still waiting on an investigation to be reported there. If you claim you have verified these accounts, then provide the documents you used to verify them as the companies are definitely not providing any verified documents.Under the Fair Credit Reporting Act, 15 U.S.C. § 1681g I have the right to demand that you disclose to me all the documents that you have recorded and retained in your file at the time of this request concerning the accounts that you are reporting in my credit report.  Please don’t respond to my request by saying that these accounts have been verified.  Send me copies of the documents that you have in your files that were used to verify them. If you do not have any documentation in your files to verify the accuracy of these disputed accounts, then please delete them immediately as required under Section 611(a)(5)(A)(i).  By publishing these inaccurate and unverified items on my credit report and distributing them to 3rd parties you are damaging my reputation and credit worthiness. Under the FCRA 15 U.S.C. § 1681i, all unverified accounts must be promptly deleted.

We ask the source to check their records to verify all of the information regarding the item questioned, and report back to us within 30 days of the date that we received the consumer's request. Once we receive their response, we send the consumer the results of the investigation. If we do not receive a response within 30 days we update the item as requested or delete the information, and send the consumer these results.According to the Fair Credit Reporting Act (FCRA), a consumer reporting agency's role in the dispute process is to investigate the information to determine the accuracy and completeness of any disputed item by contacting the source of the disputed information and informing them of all relevant information regarding the consumer's dispute. If the issue is not resolved, then the consumer reporting agency must offer to include a consumer statement on the personal credit report. The FCRA does not require that the consumer reporting agency obtain documentation such as the actual signed sales slips, signature cards, contracts, etc., nor does it require that consumer reporting agencies act as mediators or negotiators in account disputes. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Written information from [redacted] dated 11/04/14 was provided to Experian by myself. The letter makes it clear with the following statement," A review of our records indicates that your loan was paid in full effective June 18, 2014". Experian refuses to accept the letter and continuesto report the loan was sold to another lender. My contention is if a loan is paid in full how can it be sold to another lender.Experian must remove the "sold to another lender" statement from my credit file.

Upon completionof this process, we will provide the results of our investigation directly to the consumer.When a consumer disputes the accuracy or completeness of information on the personal credit reportand tells us specifically why they believe the information is inaccurate or incomplete, we process thedispute as required by law. We contact the furnisher of the information or the vendor that collected theinformation from a public record source such as a court or other government office eitherelectronically or by US Mail. We ask the furnisher or the vendor to conduct a thorough and completeinvestigation to verify all of the information regarding the disputed item, and report back within the timeframe required by law. We review and consider the response to determine whether to accept it, rejectit, or follow up for additional information. If, after processing, we find that the disputed information isinaccurate, incomplete or cannot be verified, we then delete that information, or modify thatinformation, as appropriate, based upon the dispute and the results of our processing.
