To whom it may concern:I am frustrated with Experians ability to respect the Fair Credit Reporting act. The [redacted] account is one of a few accounts that they allow to show in collections and RECENTLY charged off despite acknowledging to me and the CFPB that this account was charged off in...
6/2011 and out of the statue of limitations in 2014. They allow [redacted] and other creditors to just verify my name, address, and social security number without them verifying that the way they are reporting the debt is the current status. [redacted] and other creditors use this trick to collect on time barred debt they can't sue for. Experian is allowing them to report this way and refuses to require them and other creditors to show the last payment received to verify the age. Chase is another account I was 1099 for in 2013 because it was out of the statue of limitations then and they allowed them to reinsert the balance as collectible. This evidence is being viewed by the CFPB for potential fines and contempt of the Fair Credit Reporting Act.Sincerely,[redacted]

Upon completionof this process, we will provide the results of our investigation directly to the consumer.When a consumer disputes the accuracy or completeness of information on the personal credit reportand tells us specifically why they believe the information is inaccurate or incomplete, we process thedispute as required by law. We contact the furnisher of the information or the vendor that collected theinformation from a public record source such as a court or other government office eitherelectronically or by US Mail. We ask the furnisher or the vendor to conduct a thorough and completeinvestigation to verify all of the information regarding the disputed item, and report back within the timeframe required by law. We review and consider the response to determine whether to accept it, rejectit, or follow up for additional information. If, after processing, we find that the disputed information isinaccurate, incomplete or cannot be verified, we then delete that information, or modify thatinformation, as appropriate, based upon the dispute and the results of our processing. If we do notreceive a response from the furnisher or the vendor within the required period, we update the item asrequested or delete the information, In some instances, upon reviewing the credit file and any relevantinformation submitted to us, we are able to determine whether the disputed information should bechanged or deleted without having to contact the furnisher or the vendor. I have asked for validation for accounts and this company have ignored my request over and over . This company have asked for a bank statement and a copy of my id . I have sent a certified copy of this information and nothing has happen . No one can answer my questions in regards to why is is taking more than 30/45 days to get a response which is breaking the FCRA law . This is my third written request and final warning that I fully intend to pursue litigation in accordance with the FCRA to enforce my rights . You say you have reinvestigated these accounts but you admitted that all you have done is parroted information given to you by sources and shifted the burden back to me to contact the original creditor to verify these accounts which is clearly in violation of 1681(A)(4) of the FCRA i would like for these accounts to be deleted under section 611 (5) (A) of the

The [redacted] inquiry was a pre-screenoffer that the consumer has since been opted out. We are in the process of sending an updated copyof the credit report via email notification, hence we are unable to forward to overseas address.In accordance with California Civil Code Section 1785.15.3, when requested we provide acomplimentary monitoring service to victims of identity theft who provide a valid police report orDepartment of Motor Vehicles (DMV) investigative report describing the theft. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
You have admitted to parroting information from a third party vendor and not performing your own investigation. If you will not delete the fraudulent information from my credit file I will be forced file suit against Equifax for FCRA violations. I will be naming you in that suit as well. You are REQUIRED to report accurate information not merely copy information provided to you without doing your due diligence when an investigation is requested. This has been decided in several Federal lawsuits.
