CreditReporting Act, entities who have certified to Experian that they have a permissible purpose may inquire about credit information. For example, organizations that have granted you creditor with whom you have applied for credit, or entities collecting on transactions that you initiated or on judgments rendered against you, are permitted to make inquiries on your Credit report. Requests for your Credit history remain on the personal Credit report for at least two years.Inquiries from credit grantors who request your credit information as part of your application for credit will display under the heading "Inquiries shared with others" on your personal credit report. These inquiries display on your credit report when it is accessed by others with a permissible purpose. These inquiries may affect your Credit score.Other inquiries for your credit information are considered "soft" inquiries and do not affect your credit score. Some examples are: your current Creditors to monitor your accounts, other creditors who want to offer you preapproved credit, an employer who wishes to extend an offer of employment, a potential investor assessing the risk of a current Credit obligation; an end user to complete your mortgage loan application, and insurance underwriting (auto or home). These inquiries appear under the heading "Inquiries shared only with you" on your personal credit report and are not seen by anyone but you (except insurance Companies may be able to see other insurance Company inquiries). consumer's personal credit report.We are currently investigating the information with which the Consumer disagrees. Upon Completion of this process, we will provide the results of our investigation directly to the Consumer.Potentially negative payment history is removed seven years from the missed payment. Most public record items, which are obtained from courts and other government offices, remain on the personal Credit report for seven years, except Chapters 7, 11 and 12 bankruptcies, which remain for 10 years. Unpaid tax liens will remain for 10 years from the filing date, and paid tax liens will remain for seven years from the filing date.When a consumer disputes the accuracy or completeness of information on the personal credit report and tells us specifically why they believe the information is inaccurate or incomplete, we process the dispute as required by law. We contact the furnisher of the information or the vendor that Collected the information from a public record source such as a Court or other government office either electronically or by US Mail. We ask the furnisher or the vendor to conduct a thorough and Complete investigation to verify all of the information regarding the disputed item, and report back within the time frame required by law. We review and consider the response to determine whether to accept it, reject it, or follow up for additional information. If, after processing, we find that the disputed information is inaccurate, incomplete or Cannot be verified, we then delete that information, or modify that information, as appropriate, based upon the dispute and the results of our processing. Our records indicate that Experian was contacted by Mr. [redacted] on March 09, 2017, March 15, 2017, March 29, 2017, March 31, 2017, April 4, 2017, April 12, 2017, and April 27, 2017. The results of the investigations were sent to Mr. [redacted] on March 16, 2017, March 22, 2017, March 29, 2017, April 12, 2017, April 19, 2017, April 21, 2017, and May 9, 2017.Our research indicates that on December 13, 2013, [redacted] reported that the HELOC account was discharged in the chapter 13 bankruptcy and the payments on the account had never been late.Please note, any account included in a bankruptcy remains on the personal Credit report for a maximum of seven years from the date the bankruptcy was filed. Because this account had reached the maximum retention time permitted by the Fair CreditReporting Act (FCRA), it was deleted from the consumer's Experian credit report on November 22, 2016.Additionally, my review of the public record documents on file at the US Bankruptcy Court in Seattle, WA indicate that the disputed [redacted] HELOC account was included in the chapter 13 bankruptcy filed on February 28, 2010. Upon request, we will provide a copy of the bankruptcy documentation directly to Mr. [redacted] for review.At this time, [redacted] will not be able to re-report this account to Mr. [redacted]'s credit report under the existing account number since it has reached the maximum retention time permitted by the Fair Credit Reporting Act (FCRA).If Mr. [redacted] has additional documentation indicating that this account was not included in bankruptcy please send it to my attention at P.O. Box 1240, Allen TX, 75013-1240 or fax it to my attention at 1855-829-9953.Further research indicates, the additional [redacted] Mortgage account [redacted]xxxx was previously reported by [redacted] as included in bankruptcy. On January 24, 2014, [redacted] submitted a request to remove the bankruptcy information from this account. At this time, the account is appearing on Mr. [redacted]'s Experian credit report as an open account.Each national consumer credit reporting agency may interpret the requirements of the FairCredit Reporting Act differently and each company has their own policies and guidelines for disputing information. will provide the results of our investigation directly to the Consumer.Judgments, Tax Liens and Bankruptcies are a matter of public record. Although the court where the disputed public records are filed may not report this type of data, a vendor may collect this data directly from the court's public records and supply that information to Experian. Experian does not divulge the names of our vendors as this is proprietary information and they are not the source of this public record information. Experian's method of verification for public records complies with the requirements of the Fair CreditReporting Act (FCRA).When a consumer disputes the accuracy or completeness of information on the personal Credit report and tells us specifically why they believe the information is inaccurate or incomplete, we process the dispute as required by law. We contact the furnisher of the information or the vendor that collected the information from a public record source such as a court or other government office either electronically or by US Mail. We ask the furnisher or the vendor to conduct a thorough and complete investigation to verify all of the information regarding the disputed item, and report back within the time frame required by law. We review and consider the response to determine whether to accept it, reject it, or follow up for additional information. If, after processing, we find that the disputed information is inaccurate, incomplete or cannot be verified, we then delete that information, or modify that information, as appropriate, based upon the dispute and the results of our processing. If we do not receive a response from the furnisher or the vendor within the required period, we update the item as requested or delete the information, in some instances, upon reviewing the credit file and any relevant information submitted to us, we are able to determine whether the disputed information should be changed or deleted without having to contact the furnisher or the vendor. Investigations can take as long as 30 days to reach a conclusion. After we complete our processing, we send the consumer the results.In addition to the consumer's right to dispute information in the credit file with the credit reporting agencies, the consumer also has the right to dispute information in the credit report directly with the furnisher of the information.If the Consumer questions the results of the dispute process, then they may want to contact thefurnisher of the information directly or review the original information in the public record. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.I tried contacting [redacted] after receiving a copy of her letter in the mail. Her voicemail states she is out until August 25th. I then contacted Experian's customer service and spoke to someone in the dispute department. They looked up my information and stated that the collection account in question is still showing on my credit report and that they have not resolved my dispute. I asked what was taking so long as the representative that helped me file the dispute stated it would take 3-5 business days, the gentlemen stated that they just now located the documents I uploaded over a week ago now. I was not happy about this, but there wasn't much that can be done. I do not know who's credit report [redacted] looked up, but this fraudulent collection is still showing up on my credit report and I want it removed immediately! I have disputed this account 3 times already and have asked numerous times proof detailing how Experian has verified this collection account according to the Fair Debt Reporting Act and this company has never provided it thus violating the law. It has been well over 60 days and has hurt me from obtaining credit cards, vehicle & personal loans and further causing me undo stress. If this is not resolved quickly, I will be filing a lawsuit against Experian and the collection company for violating the law.
