I believe you've stated exactly what my issue was, the facts of my signing, payment and date of the lease are not in dispute. I did not see a date for the first payment on the agreement which is why I contacted GM Financial on a few occasions. Your statement that the website is only able to reflect the current amount due is my exact point of contention. The web site had a balance of $0.00 until about two days prior to the payment being 30 days late. Payment was sent immediately by my bank. If GM Financial feels I should have paid that balance immediately over the phone (I was driving at the time) I feel if your account information on the website displayed the actual balance due at any point prior, that would not have been required. I do not pay my bills late, GM Financials failure to maintain and implement its web site was the direct cause of my payment being credited 6 days past the 30 day mark. Not the fact that I didn't make that payment by phone. Furthermore GM Financials failure to acknowledge fault or take any steps to correct the error are incredibly poor customer service and are in violation of the Fair Credit Act and I will act outside of the Revdex.com if required. I can assure you that this will be the very last time I conduct any business with GM Financial as well as causing me to reevaluate my long standing loyalty to General Motors cars and trucks.

purchase of the 2005 Chevrolet Corvette. AmeriCredit Financial Services, Inc. (“AmeriCredit”) employees were not present at [redacted] (“Dealer”) during the signing of the contract and AmeriCredit was not an original contracting party in any agreements between the two parties. The contract was subsequently assigned to AmeriCredit. On October 1, 2010, AmeriCredit was purchased by General Motors, and the company name was changed to GM Financial.  Within the contract, you promised to pay the amount financed of $24,036.16 and a finance charge of $12,930.08 which would result in a total of payments of $36,966.24, if all payments are made on the contracted date they are due. It is important to understand that this contract is a “simple interest” contract, meaning that interest is accrued daily on the unpaid portion of the amount financed, as indicated on the face of your contract. Explanation of interest accrual, application of payments, and how late or early payments change what you must pay is explained on page two of your contract under the section titled “Finance Charge and Payments”. By signing the contract, you agreed to abide by these terms, including paying the principal amount plus finance charges accruing on the unpaid balance at the rate of 15.15% in 72 installments of $513.42, and any other charges within this contract.  A review of your account activity and payment history reflects that additional interest accrued over the life of the loan due to payments being made after the scheduled due date, three due date changes, and deferments that were processed at your request. Throughout the time your account has been active, 2 deferments were processed for the months of October and November of 2011. Because of the due date changes and deferments processed at your request, the maturity date of the account moved to September 15, 2016.  A deferment agreement was e-mailed to you at [redacted] on October 17, 2011; and our records reflect that you acknowledged this agreement online on the same date with an Acknowledgement number of 958298. Within this agreement you were advised that interest will continue to accrue during the month(s) deferred on the unpaid balance of the contract at the rate specified in the contract and any deferment fee collected may not be sufficient to pay this accrued interest, and that this would result in a final higher payment due at the end of your contract on the new maturity date. An additional notice regarding interest accrual was reflected on the first billing statement following the deferred installment period. On September 15, 2015, one year prior to the maturity date of your contract, the Simple Interest Maturity Notice was mailed to all parties to the Contract at their last known address. This notice advised you of the balance of your account as of the date of the notice and that based on your payment amount and the balance of your account, it was anticipated that your final payment due at maturity will be more than your regular monthly payment amount. Interest accrual was again explained within this notice.Finance Charges have been assessed as per your contract and within the maximum amounts permitted for this sale by state or federal law. Additional copies of your Contract, Account Payment History, the electronically acknowledged deferment agreement, the billing statement dated November 20, 2011, and the Simple Interest Maturity Notice mailed to you on September 15, 2015, have been mailed to your address of record for your review. Please allow 7-10 business days to receive. At this time the payoff amount for your account is $2,726.53, good for ten days through June 26, 2016. This amount includes the following:PRINCIPAL AMOUNT:             $2,699.71INTEREST DUE:                        $26.82INTEREST PER DAY:                $1.11 Please understand that once your maturity date expires, the remaining balance becomes due in full and the account will continue to report to the credit bureau reporting agencies. If you are unable to pay this balance in full at one time, GM Financial provides assistance in the form of a Final Installment Payment Agreement, where the remaining balance is rescheduled for a specified timeframe at 0% interest. You have indicated that you are disputing the inquiry as unauthorized; and as a result, GM Financial has requested that the appropriate credit reporting agencies remove the GM Financial inquiry from your credit report. In the event that the credit bureau reporting agencies are unable to delete the inquiry, we have asked that at a minimum they convert the hard inquiry to a soft inquiry. Please be advised that it can take the credit reporting agencies four to six weeks to update your credit report.

At this time your account is 109 days past due and currently due for end of term liabilities, including excess mileage. As outlined in your Lease agreement, you are responsible for Excess Wear and Tear and Excess Mileage charges as described within the Lease, excess mileage it is non-negotiable. Total termination charges are calculated after the Lease Termination Inspection is done to the vehicle. Please be advised the mileage exceeded by 3,114 miles at $0.25 per mile, for a total of $778.50 plus tax. A final bill was sent to you October 11, 2016 and October 31, 2016. Our records reflect that numerous efforts have been made to contact you in regard to the remaining balance on the account.
GM Financial is required to report truthful and accurate information to the credit bureau reporting agencies. Our research concludes that the account status and account payment history of your account have been reported to the credit bureau reporting agencies with accuracy; and as a result, we are unable to make any changes or deletions to the credit bureau reporting of your account.

I am rejecting this response because: numerous attempts were not made to reach me. No messages or calls were received. I can pull my phone records and I would like the dates and times these attempts were made to contact me and to what number. Also GM financial is notorious for lying about trying to contact their customers( How was a payment due on 12/14 past due on 12/14? I have not received any letter from GM Financial supposedly mailed on 12/18. I have yet to receive a call or explanation on this matter and per GM Financials own policy reasonable attempts to contact the client has NOT been met and I can pull my phone records to prove it. My home and cellphone are thru Xfinity and they are both connected. I will be contacting Illinois States Attorney Office. This seems to be an ongoing trend for this company indulging in shady business practices.

I have reviewed your concerns and would like to provide the following information.Our records reflect that on December 28, 2009, you obtained a payoff quote in the amount of $720.25, good through January 7, 2010. Later on this same date GM Financial received a payment submitted online through Western Union Speed Pay in the amount of $140.00, leaving a balance of $580.25. Our records further reflect that from December 29, 2009 through January 5, 2010, six automated telephone calls were made to the telephone number of ###-###-####. With regard to the address on file, GM Financial received several returned billing statements in 2004 and also attempted numerous times to reach you by telephone regarding the status of your account and to verify your address between October 29, 2004 and January 5, 2010. During this timeframe, messages were left on your voicemail and with parties who answered the telephone at ###-###-####. Our records do not reflect that any of these calls were returned, nor do they reflect that you contacted GM Financial until March 18, 2016; at which time you updated your address. Please understand that you’ve also had the option to update your address information online at any time. The letters dated December 29, 2009 and January 5, 2010 were mailed to the only address we had on file for you at that time. Our records do not reflect that these letters were returned to GM Financial.Validation of the late fee balance has been provided to you in the form of your account payment history and contract. GM Financial received a payment in the amount of $498.00 on November 22, 2017. An additional payment was made to complete the November payment on December 8, 2017 in the amount of $100.00.
GM Financial is required to report truthful and accurate information to the credit bureau reporting agencies. Our research concludes that the account status and account payment history of your account have been reported to the credit agencies with accuracy; and as a result, we are unable to make any changes or deletions to the credit bureau reporting of your account at this time.
