GM Financial Reviews (4045)

Thank you for the correspondence sent to the Revdex.com. I have reviewed your concerns and would like to offer the following information.
On March 29, 2006, you signed a Retail Installment Sales Contract (“Contract”) for the 2006 Honda Accord in the amount of $22,771.30 at an...

interest rate of 16.99%. Within the agreement, you agreed to repay the loan in 65 monthly installments in the amount of $537.01 per month, beginning May13, 2006.
A review of our records reflects on January 27, 2015, GM Financial mailed a settlement offer to your address of record in the amount of $1,417.39. The letter stated the settlement offer was to be payable in 3 payments of $472.46, with each payment due within 30 days of the previous payment, and first payment due within 20 days from the date the letter was received. The offer would be null and void if you failed to pay the initial settlement amount on or before February 27, 2015. However, as requested the account may still be settled for the amount of $1417.39, with the funds being sent in monthly increments not to exceed the 12 months from the agreement date.
GM Financial is required to report truthful and accurate information to the credit bureau reporting agencies. Our research concludes that the account status and payment history of your account have been reported to the credit bureau reporting agencies with accuracy; and as a result, we are unable to make any changes or deletions to the account and credit agencies.
Included for your review are copies of the contract and the settlement letter mentioned above. Should you wish to pay the balance, discuss further options or if you require additional information, please contact our Loss Recovery department at (877) 203-5539.

I am not disputing being late and behind on payments that was mentioned in my complaint. My complaint was that this loan for a car was extremely high interest rate which we did know the interest rate going in but we did not know the compounding daily  and it may have been in the paperwork but you are signing tons of paperwork and I said and will stand by what I said this loan was like a loan shark. Nothing that they said changed my thinking on that and the bigger complaint that was not even addressed was after I paid off the extended loan why I had to call multiple  times to get my title released properly and that is why I filed the other complaint if a title could not be released properly, I questioned the other paperwork being done properly. Thanks [redacted]

Complaint: [redacted]
I am rejecting this response because the point still remains that I requested arbitration and was waiting on a date. $5000 was still unethical and the repossession was still a power move on GM Financial part.  Forcing me to pay without the right to arbitration. And for them to still be able to cause unfair credit reporting should be against the law. At the end of the contract they received more than fair value and I received the title. I am requesting that they be removed.
Regards,

Dear Ms. [redacted],
Thank you for the correspondence sent to the Revdex.com. I have reviewed your concerns and would like to offer the following information.
On April 14, 2014,...

you entered into a Retail Installment Sale Contract (“Contract”) for the 2014 Chevrolet Cruze. Please be advised that in accordance to the terms and conditions of the signed Contract, if defaulted, repossession was a possibility.
On January 22, 2018, the decision was made to repossess the vehicle, at this time the account was 83 days past due. On February 21, 2018, an arrangement was made for payment on March 9, 2018 and GM Financial closed the repossession order.
On February 27, 2018, the vehicle was repossessed in error by an independent contractor, L&K Recovery, and was delivered back to you at no charge. A repossession will not be reported to the credit bureaus and you will not be responsible for any repossession fees. We apologize for any inconvenience you have experience as a result of the repossession company’s error.
While we are unable to accommodate your request for an account credit, we do have an option available that may assist you. If you would like to discuss this option, please contact us at ###-###-####.
Sincerely,
GM Financial

According to your records then we owe $2713.44 that is what I am saying it doesn't add up

On January 23, 2018, the decision was made to place the vehicle out for repossession, as allowed by your contract. The account history was reviewed thoroughly and it has been determined that the handling of the account, including repossession, was in compliance with all state and federal laws. Please be advised numerous efforts were made to contact you with regard to the status of the account prior to the last contact made on December 21, 2017 and after that date. The last payment received prior to the repossession was on November 1, 2017 that was applied towards the October of 2017 payment due date.
Please be advised that to be able to reinstate the vehicle, all past due payments, late charges, impound and repossession fees must be paid in full. Complaint: [redacted]
I am rejecting this response because:One I let you know that I was late but being truthful you are not by any means. I am speaking of the two additional payments that I do not owe that is on my account and now that you see I signed this contract on 06/11/16 then why are there still two payments from April and May that I was not responsible for. So how can that be truthful when those two payments are still tacked on there before the signature of 06/11/16. Which I was told by [redacted] at DARCARS that my new payment was due 07/26/16. What I want you to honor is removing those payments and fixing my date to the 26th not the 7th. Please remove those payments and I have been asking for months now. So there is in no way that your company is providing truthful or accurate information.
Regards,
[redacted]

Complaint: [redacted]
I am rejecting this response because: your response admits violating the terms of the contract. It says you may change the scheduled payments, not you may change the schedule. So the charge for immediate payment of the taxes was improper. Therefore the repossession was unlawful. This means GM Financial broke the terms of the contract when you repossessed the vehicle. My desired solution remains. I want this properly reported to the credit reporting agencies as all payments on time and that GM Financial unlawfully and unilaterally terminated the lease without cause. Additionally, I want reimbursement for the travel I've had to pay for without the vehicle. In exchange, I'll consider this matter resolved to our mutual satisfaction and agree to not seek further damages.
Regards,
[redacted]

On July 18, 2015, you signed a retail installment sales contract for a 2015 Chevrolet Camaro in the amount of $24,004.36 at an...

interest rate of 3.00%. Within the agreement, you agreed to repay the loan in 72 monthly installments in the amount of $365.16 per month, beginning September 1, 2015.
Please note that GM Financial places a high priority on adhering to all state and federal laws. The state of Arkansas does not require cure notices to be sent prior to submitting the account for repossession. On January 21, 2016, the decision was made to place the vehicle out for repossession, as allowed by your contract. At this time the account was over 40 days past due. The account history was reviewed thoroughly and it has been determined that the handling of the account, including repossession, was in compliance with all state and federal laws.
A review of your account reflects that billing statements beginning with the statement dated November 11, 2015 reflected a past due balance owed. Per your telephone conversation with Christine on January 16, 2016, you confirmed all billing statements were received. Please be advised numerous calls were made to all authorized numbers on the account between December 14, 2015 and January 23, 2016, in an attempt to discuss the status of the account prior to the repossession. Our records further reflect that contact was made with [redacted] Jr. on December 14, 2015 and that he was made aware of the status of the account.
GM Financial is required to report truthful and accurate information to the credit bureau reporting agencies.
