I am rejecting this response because: When I decided to do a deferment I was NOT informed that the amount due at that time will accrued interest daily.  I do not feel I owe GM Financial the US$4896.19. I do believe I ONLY owe US$2,588.19.  I have reviewed the account history of my payments made to GM Financial and I have paid over an approx. US$41,544.00 and an exception can’t be made? I was never informed from any associate that my loan will accrued interest daily, when I decided to do a deferment. I never received any writing explanation on the processes works. If I would have been educated by the associate at the time of agreeing to the deferment, I might have reconsider the option at that moment.

I am rejecting this response because: I have not received lien release or title to my car in the mail yet. Once they both are received I will accept response. I still believe an investigation into GM/Americredit's practice of not sending proper releases and clear titles to consumers in the first place is still warranted. I believe they have set up & run the website www.getmycartitle.com to extract extra unnecessary & illegal fees from consumers. It was their first response to me when I called & told them I was paying vehicle off a few months early back in 2015 & made sure they had my correct current mailing address (is same now still) to mail clear title to. They told me I was going to have to go through www.getmycartitle.com & pay extra fees before even receiving final payment. Is their ownership & use of that website to gain extra fees legal?

entered into a Motor Vehicle Lease Agreement for a 2017 Cadillac ATS with Silver Star Motor Company. Within the agreement, you agreed to a 36 month lease term with a payment of $439.99 per month. GM Financial was not present at Silver Star Motor Company during the signing of the contract and was not privileged to any agreements between the two parties. The contract was subsequently assigned to GM Financial.

I am rejecting this response because: I am already aware of everything you responded with. Your response didnt even touch on most of my stated issues. If I make a payment May 5th, you should not take more money on the 22nd without letting me know. Customers should be advised against paying if you know that procedure is to take money regardless. Customers should be advised they cannot choose due dates. If a service rep is going to cancel anything on the account, they should advise the customer, not go ahead without permission. I received poor service a series of times throughout my less than 2 years with my lease, not just once. That should be addressed better. Not to mention that I already learned your refund process - 30 days by mail! A month to retrieve money that you took despite me owing nothing.. And I have to provide documentation even though you're aware it happened without a doubt. Ridiculous excuse for customer service.

that a payoff in the amount of $10,380.76 was quoted on October 11, 2017 good through October 21, 2017. Please be advised a 10 day payoff is provided each time a payoff is requested.
It is important to understand that this contract is a “simple interest” contract, meaning that interest is accrued daily on the unpaid portion of the amount financed, as indicated on the face of your contract. Explanation of interest accrual, application of payments, and how late or early payments change what you must pay is explained on page two of your contract under the section titled “Finance Charge and Payments”. By signing the contract, you agreed to abide by these terms, including paying the principal amount plus finance charges accruing on the unpaid balance at the rate of 10.95% in 72 installments of $433.66, and any other charges within this contract.

In order to ensure that the account history is reflected accurately, GM Financial has submitted a manual update and forwarded the proper documentation to all three major credit bureaus. The bureaus generally reflect the updated information within 30-45 days, if an update was required.
Please note the vehicle is currently pending sale, once complete a final bill will be sent to your address of record if a balance exists.

Our records reflect that on January 1, 2015, you filed a Chapter 13 Bankruptcy. According to your Chapter 13 plan, the trustee was to disburse...

payments totaling $19,230.68 at 5% interest to GM Financial. According to our records and the Trustee’s Final Report and Account, no disbursements were paid to GM Financial.
Our records reflect that your monthly installment payments were due on the 1st day of each month and that GM Financial spoke with you on numerous occasions regarding the status of the account; and our records further reflect that there were either no GM Financial approved payment arrangements in place or the approved arrangements were not upheld.
After the dismissal of your Chapter 13 Bankruptcy on May 19, 2015, GM Financial did not receive the required payment of the past due amount in order to be able to cease repossession efforts. As allowed by your contract, on June 1, 2015, the decision was made to place the vehicle out for repossession. At this time, the account was more than 150 days past due. The repossession order was closed June 11, 2015 after the receipt of a payment for the January 1, 2015 installment due date. On July 7, 2015, the account was again reviewed by management and the decision was made to place the vehicle out for repossession. At this time the account was over 90 days past due. The account history has been reviewed thoroughly and it has been determined that the handling of the account, including repossession, was in compliance with all state and federal laws.
The “Notice of Right to Redeem or Reinstate” and the “Notice of Our Plan to Sell Property” were mailed to your address of record on August 13, 2015. These notices explained that you would be required to pay the difference between the amount you owed to GM Financial and the amount the vehicle sold for, plus expenses if you opted not to redeem/reinstate the vehicle. After the sale of the vehicle at auction, a “Deficiency Calculation” letter was mailed to your address of record on September 15, 2015 to inform you of the remaining balance owed.

Please be advised that a cease and desist of telephone communication has been documented to the account. While you may no longer receive telephone calls regarding the status of your account, GM Financial will continue to communicate with you to the extent allowed by law.
Please be advised that the repossession company that you referenced is an independent contractor and is licensed as such. Any claims against their company will need to be addressed directly with their company and/or licensing authority.
