I am rejecting this response because:As stated in my initial complaint, the DMV received your package, but there was no title inside. You need to acknowledge that a mistake was made and fix it. This will require either finding the original paper title and sending it to the DMV or requesting a new paper title and sending it to the DMV. Please consider a new job if this is too difficult. Thanks.

I am rejecting this response because: I appreciate that, but is there anything else you can do, that really doesn't make a lot of difference as to when I will get the loan paid off.  At least 1 full payment of late charges waived would be appreciated.  Thanks

Financial received an application for credit submitted at Jake Sweeney Chevrolet. You have indicated that you are disputing the inquiry as unauthorized; and as a result, GM Financial has requested that the appropriate credit reporting agencies remove the GM Financial inquiry from your credit report. In the event that the credit bureau reporting agencies are unable to delete the inquiry, we have asked that at a minimum that they convert the hard inquiry to a soft inquiry. Please be advised that it can take the credit reporting agencies four to six weeks to update your credit report.

July 15, 2016 Complaint ID: [redacted] Dear Ms. [redacted], Thank you for the correspondence sent to the Revdex.com. I have reviewed your concerns and would like to provide the following information. On August 6, 2014, you signed a Closed End Motor Vehicle...

Lease (“Contract”) for a 2014 GMC Terrain. Within the agreement, you agreed to a 48 month lease term with a monthly payment in the amount of $340.58 per month, due on the 6th day of each month. A review of the payment history of your account reflects that no payments were received by GM Financial in the months of November of 2015 or January, February, and June of 2016; and that payments received in the months of October of 2015 and April of 2016 were returned to GM Financial due to non-sufficient funds.  Please note that GM Financial places a high priority on adhering to all state and federal laws. The State of Pennsylvania does not require a cure period or notice of repossession be mailed prior to repossession. On April 8, 2016, the decision was made to place the vehicle out for repossession, as allowed by your contract. At this time the account was 93 days past due for the January 6, 2016 base rent due date. Our records reflect that one payment in the amount of $340.58 was received on April 14, 2016 and was applied towards the past due January of 2016 base rent due date; however, this amount was not sufficient to bring the account current and no GM Financial approved payment arrangements were in place.  On April 21, 2016, the repossession company confirmed the recovery of the 2014 GMC Terrain and the amount required to reinstate the vehicle at that time was $1508.10. These funds were received on April 22, 2016 and were applied to the costs of the repossession as well as the base rent due dates for February of  2016, March of 2016, and April of 2016 to bring the account current. Our records reflect that the vehicle was released back into your possession on April 25, 2016.  On April 26, 2016, the payment originally received on April 14, 2016 was returned to GM Financial due to non-sufficient funds. The reversal of this payment required the reapplication of the payments paid as part of the reinstatement to the base rent due dates for January, February, and March of 2016; causing the April 6, 2016 base rent due date to become delinquent.  You did not remake this payment until May 24, 2016. The next payment was received on May 25, 2016 and was applied towards the May 6, 2016 base rent due date. Payment records reflect that no payments were received within the month of June of 2016. On July 11, 2016, GM Financial received one payment in the amount of $340.58 which has been applied to the past due base rent payment of June 6, 2016. At this time, the July 6, 2016 base rent payment is 9 days past due. Copies of your Contract and Payment History have been mailed to your address of record. Please allow 7-10 business days from today’s date to receive.  Should you have any further questions or require additional assistance, please feel free to contact GM Financial at ###-###-####. Sincerely,GM Financial

Thank you for the additional correspondence sent to the Revdex.com. I have reviewed your concerns and would like to provide the following information. As per your Retail Installment Sale Contract (“Contract”), if payment is not received in full within 10 days after it is due,...

you will pay a late charge of $5.00 or 5% of the part of the payment that is late, whichever is greater.  Your loan matured on November 9, 2013, at which time the remaining balance of $1,624.28 became due in full. Please understand that this is a simple interest contract, meaning that interest accrues daily in the unpaid portion of the Amount Financed. On the maturity date of your account, the late fee balance owed was $411.22. An additional late fee assessed for the final installment due date in the amount of $19.71 on November 20, 2013, bringing the total late fee balance owed to $430.93.  GM Financial received partial payments on December 12, 2013, January 14, 2014, and January 31, 2014. These payments paid the outstanding Amount Financed and Finance Charge balances and paid $1.91 towards your late fee balance. A notice regarding the maturity of the account was mailed on November 9, 2013 and notices regarding the late fee balance were mailed on February 14, 2014 and April 17, 2014. All notices were mailed to your address of record. Our records of your account also reflect that on January 14, 2014, you contacted GM Financial and set up two payments in the amount of $190.00 each dated for January 14, 2014 and January 31, 2014. During this conversation you were advised that a late fee balance would still be owed after the application of these two payments; and that once all balances have been paid, the title would then be released. Our records further reflect that telephone communication was not attempted regarding this balance as both parties to the contract unauthorized communication at the telephone numbers on file via MyAccount online. On November 24, 2015, GM Financial received an email regarding the title. A response was issued advising the e-mailing party to call in to Customer Service. The next communication with GM Financial occurred on April 8, 2016; where you were again advised of the outstanding late fee balance. As of today’s date, a late fee balance still remains on your account in the amount of $429.02. As late fees are part of your contractual obligation, the title to the 2005 Mazda 3 cannot be released until this balance is paid or settled. In an effort to assist you, a member of the leadership team offered the maximum waiver of 50% of the late fee balance owed after the amount $214.51 is received. Copies of your Contract, Account Payment History, Billing Statement dated October 20, 2013, Maturity Notice, and Late Fee Balance Notices have been mailed to the address provided on your Revdex.com complaint. Should you have any further questions or require additional assistance with regard to this matter, please contact Customer Service at 1(800)284-2271. Sincerely, GM Financial

I am rejecting this response because: after the vehicle was sold I entered into an agreement and started making payments of $100 a month. You did not include this into this break down. Will that show on the documentation that is being sent to me?

My position has not changed on this matter either in addition I will be advising my legal counsel if I do not receive my title. Apparently all GM must provide to prove anything is their own creation.  I have proven they did not send any correspondence to the correct address and that they did possess the correct address from the beginning of the loan.  I thus far have received no proof that I was notified of a balance due on a loan I was informed was paid in full 6 years ago.  I therefore think this complain will have to be marked as unsolved by the Revdex.com.  Thank you Revdex.com for your help.
