I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my dispute
Per my phone conversation, I accidentally accepted the business response to resolve my complaint. This was done in errorBased on the message from the business, I do not accept that they are being truthful when they state they were reporting to all CRAs MONTHLY on both mine and my spouse's accountsWe repeatedly asked them to show us proof but they would promise to mail the reports showing they were reporting to the credit agencies, which they never did It was only after talking to a supervisor and their manager that both came out in the open and stated they had not been reportingFurthermore it looks suspicious that they contacted the credit bureau reporting agencies on June This was the same week we refinanced the car with another financial institution and had the loan paid off in full All I am requesting is proof that they were reporting to the CRAs on a monthly basisIf no proof, then we still would like the stated desired settlement be met Regards, ***

On February 9, I received a response from GM Financial requesting the account number to further research my initial concern. Then I received a response stating that if I believe this is a fraudulent account I am to taken certain actions. When I made my initial call made to GM Financial, I spoke to one of your company customer service representatives. He searched his data base, placed me on hold, then returned and stated to me that he couldn't my name nor account number in his system. I told him that there is an account reporting to the Credit Bureau's with a $6,balance and how do I get this removed. Then I received a letter in the mail confirming my conversation and instructions of how to file a complaint I also hired a credit repair company trying to have this account removed, and then I started to put in complaints with the credit bureaus myself to investigate this account.
It's a simple question: Do you have an account in your system with the provided account number and my name in your financial/data system? If not, please have the information removed from the Credit Bureau's immediately. the
It's obvious to me that by re-directing me to file out more paperwork to file a fraudulent case, I clearly have my answer that you don't have my name nor an account number. I would suggestion to have one satisfied customer, because of the many complaints I have reviewed, to fix this situation. I don't enjoy the ramifications of having my reputation tarnished especially when it affects my family. This is the only account keeping me from purchasing a home. I had been homeless and leaving with relatives for two years.

Thank you for your additional informationI have read numerous complaints about GM financial and creating situations like mineAll of my attempts to fax my phone records to your company were rejected, because they show no phone callsThis is when Ms*** told me, if they make a call and it doesn't go through it is not their problemI also received to right to cure letter, though you may say you sent them and one to each of us on the loanYour customer service department told me they do not send out repossession lettersYour reinstatement department said they had sent out one?? I'm still patiently waiting to receive either in the mailI feel as though not one person at your company is listeningI feel as thought I am just repeating the same things over and I know I amNow I have been a long standing customer for many yearsThe way I was treated and talked to on the phone by your company was extremely unprofessionalNever have I been treated this poorly companyI also refuse to call your customer service department for this reasonAs I told your supervisor in your reinstatement dept, I have spoken to a lawyerDo I want to hire one no, that will only be more money out of my pocket due to your companyThough the lawyer did try, my assumption would be I had a good caseSuch as the breach of peace law, which was violatedAlso an implied acceptance was violated, in which even a verbal agreement between myself andThe customer service representative about the two different dates that were given to me were agreed uponIf I was not given the second date, why would I have paid the the interest payment for the defermentI was given the dates of August 21st or August 28thWhich I promptly paid the amount agreed on, on the date agreed uponYet, your company is accusing me of lying? I am not gaining anything at this point, I have paid all of your outrageous fees, to retrieve my carI paid $in late fees, $for a reinstatement fee and $to get my car off of a lot where it should not have been taken in the first placeI lost a paycheck, being able to get my children from school, and not being able to go to workThis error was not on my part or why would I still be questioning for some type of answers that make senseI would very much appreciate speaking to someone who actually cares about what their customers are being put throughPlease do not waste any time typing your customer service number down pleaseI will keep searching for my answers and someone to talk to about this matterAs I believe I was treated unfairly and very poorly, this being spoken by a veteran of the army that served your company and families.

On June 30, 2016, GM Financial provided Midway Chevrolet with the payoff address and a payoff quote good for days for the Chevrolet EquinoxFurther review of your account reflects that on July 7, 2016, a GM Financial representative notified you that no payoff had been received from the dealership and that the account would remain in a delinquent status until the receipt of the payoff
The payoff for your account was received on July 20, 2016, at this time the account was days past due for the June 10, installment paymentPlease note that on the date you provided as the trade in date, the account was already delinquentResponsibility for this contractual obligation remained with you until the payoff had been received for your account; the trade in of the vehicle does not negate the contractual obligation
GM Financial is required to report truthful and accurate information to the credit bureau reporting agenciesOur research concludes that the account status and account payment history of your account have been reported to the credit bureau reporting agencies with accuracy; and as a result, we are unable to make any changes or deletions to the credit bureau reporting at this time

I am rejecting this response because:According to my records and documentation I contacted *** *** *** and GM Financial on March 12th of to provide the information that I was informed of about an inaccurate VIN # by *** *** *** *** did not notify us of the error beforehand. I went to *** *** *** in person after I was told about the error by the insurance company. The insurance company advised that the vin # that I provided belonged to another one of their customers. To no avail, I couldn’t get any assistance over the phone or in person and was quickly dismissedGM Financial was initially updated (in March of not May of 2017) by me via phone, not by *** *** ***When I contacted you, GM Financial, you were also unable to assist meI expressed my concerns about paying for a vehicle that I thought I purchased in good faith with a legal contract which wasn’t the case.As per the insurance company’s explanation, the vehicle I had driven for a year was unknowingly uninsured. I also learned that the contracts I’d signed are null and void (GAP, auto protection etc.), because the vin # was attached to another individual’s truckI made several phone calls to you trying to gain further insight as to how this could happen, but no one could offer an explanation that made senseI didn’t make a payment in March because of the confusion surrounding this contract. I explained that until this issue is resolved, I will not continue to pay on a vehicle that may or may not belong to meEven though the issue was not resolved and I wanted my truck, I made a payment in the amount of $in April of and another payment of $in May of 2018, with both payments being greater than the $You accepted those payments without question or hesitation and still the issue with my contract was not addressedI then received a Notice of Default, Right to Cure, and Intent to Accelerate at the beginning of June requesting I pay over $30,at onceOn June 13th I spoke with a representative to question them about the contract once again as well as the notice receivedI told him I would make my June payment and he acted as if everything was okAccording to you the vehicle was placed out for repossession on that same dayOn June 16th the vehicle was repossessedOn June 18th and 19th I reached out to GM Financial to find out if we can correct the contract issues etc, but as usual, I received rude customer service My wife called and spoke to a representative named Evan for minutes and all he stated was that an unsigned contract was legal and there was nothing he could do to help meShe asked to speak to his manager and he said she was not available, but then transferred her to the managers (*** ***) voicemailWe’re still waiting for the return phone callOn June 22nd my wife called corporate and was transferred to a representative to help with the contract etcAfter a 41-minute conversation and them reviewing the contract they stated it was not legally signed (as I already knew) and stated they would assist in contacting the dealership and getting a legal contractThey also informed my wife that they would not send the truck to auction until we had a chance to get the vehicle back with an amended/legal contract. I was also informed by the GM Financial rep that the dealership will be held liable for the remaining balance of the truck. I contacted GM Financial again today, June 26, and was informed that they sent the vehicle to the auctionAt this point, there is not a valid contract between you and I, there is no signed amended contract by me, and is borderline fraud at best due to changing said vin # on my contract without my knowledge, approval, or signature. With this being said, it is your legal obligation to remove any negative credit reporting from the credit bureaus in regard to my credit.

The service I was given was horribleWhat I was first told was not honored and was not looked intoNOT only that but I was told prior that when the time comes someone would be able to helpThe guy said only a certain number of deferments are allowed if the funds are available. Help!!!! is all I wanted but I got nothingMy account is not past due, that I understand but why can't a company stand behind what they say? Why am I the only one who gets that the way I was treated was wrong? and why did it take me having to file a Revdex.com complain to get a simple apologize? The manager that I spoke should call and apologize for the way he talked to meLike I didn't matter and neither did me being a customerNO CALL! Bottom line, maybe my credit isn't where it should be but I am a hard worker and during a hardship you can not say that you understand and then say I can't help you. I knew of the deferment in JulyThe guy said you are one month from being able to file for another and we would waive thatWhy would I lie? And then you guys keep saying I just came off defermentMy September and October payment was made early and only my Novpayment was late because of my medical complications which no one seems to care aboutI wish that "I can't help you" was told from the start and not days later after I borrowed money that I surely don't have to pay back because of what your employee told meI will go further.
