To Whom it may concern,
The rule of not dropping and/or slamming weights from overhead has been in place since we opened The only exception to that rule is when a member is under supervision of one of our coaches during an organized class We simply asked
the member to not drop the weights from overhead This is dangerous practice when done unsupervised for the member and for members around them This is a standard rule for all of our locations.Up until this incident we had not witnessed this particular member dropping from overhead, maybe it was being done without the staff being aware When our manager noticed, it was brought to her attention in a very polite way by our staff The member became very irate and began cussing, asked for her membership to be cancelled and stormed out of the gymWe simply complied with her request to cancel her membership which she was paying $19.99/mo Our membership structure is setup for pay as you go, so the member never paid for any gym usage beyond her cancelation request As outlined in her complaint she used the gym regularly and without issue up until this interaction so therefore there is no refund due

As I have stated previously, we do not show any record of your cancellationsThe first contact we had from you was in JulyAt that time your account was past due and we do not cancel accounts that are past dueSince that time we have cancelled your membership and waived any amount that was past due
When I signed up for a month contract I was told that could suspend the contract and make no payment when returned to school

This section is the only area that mentions anything about a change of address or a change in physical capabilitiesHowever, the terms state that I may cancel the contract ALSO for any of the following reasonsThis is not an explicit restriction, and suggests within that there are ALSO other justified reasons for cancellationI would argue that this was not anything that was explained to me to be entirely exclusive reasons for wishing to cancel the contractI would also argue that the procedure for contract agreement paves the way for many types of contract fraudBy signing documents electronically without any information on what I was signing, there is clearly an ulterior motive for Golds Gym in getting their customers to sign contracts while uniformedI would also like to suggest that there were examples of fraudulentinducement between the lack of notification to the consumer about the restrictive agreements within the contract, a verbal agreement of any cancellation for a one hundred dollar fee at any time (by sales agent ***), the procedure to sign an unknown document using their electronic signature, as well as a complete neglect of responsibility in informing the consumerIt is for these reasons I have sought legal council for contract fraud and will be seeking damages for the resulting financial stress this has placed on my aforementioned situationAll information regarding the Revdex.com complaint and attempts to contact Golds Gym has been documented and has been forwarded to my attorney who is in the process of preparing a civil suit. ]

Mr*** has already been refunded due to an error that occurred on his account pursuant to his early cancellation back in June. Mr *** signed up for a person membership back in September of (those membership documents are attached)At that time Ms*** cancellation was not
processed because, 1, she was not listed on the cancellation form under "any other family members that would like to cancel at this time" and, 2, she had a balance on her account and it is our protocol that we can only cancel a membership with $balance. We are more than willing to backdate her cancellation to when Mr*** put in for his, which would leave a refund of $***
Ms*** signed up for a promotion that involved a $*** start up fee and month free. The membership is $***/mo (not over $**/mo) and is clearly displayed on the membership agreement which Ms*** signed when she started her membership with us. Ms*** signed for a
month membership which runs through 12/30/2019. She has been given the proper procedures for cancellation while under contract. Ms*** owes the past due balance on the membership. Once paid, she can then can go forward with cancellation procedures if she qualifies. I have personally reached out to Ms*** for a resolution, but have not heard back from her

I have no records of any of these phone calls until the one made on 8/ I would have paid it earlier if they actually contacted meGolds Gym should make it protocol to get updated information when a customer is discontinuing service with them for future billing For me to consider this resolved, I need clarification from Golds Gym that they never reported this incident to the Credit Agencies If they did, they need to inform the Credit Agencies that the account has been paid and is satisfactory It was unclear how he worded it that "the later payment has not been reported to Credit Agencies"Thank you

Revdex.com spoke with the businessHis contact states that he needs to provide notice of cancellation with days noticeHe canceled on December 5, He was changed for December because he was already into the month of DecemberAs a gesture of goodwill the business did not charge the
customer for January when he canceled January dues, per the contract, were due since it was not a day notice

In June, my fiance was still charged for the membership. It would appear this has not been taken care of, as he is still being charged and has not been refunded. The proper documentation has been provided three times to this Gold's location, starting in January. The people that I have spoke with, both Chris and Wendy said that they would take care of things. It is not my responsibility as a guest at this gym to know who handles what. If Wendy and Chris told me that they would handle the cancellation, then I would believe it is being taken care of. I would have no reason to think otherwise.If the gym is saying that this has been refunded and the cancellation has been processed, I would like a document showing that (the refund processed and cancellation processed). This has been going on too long to assume it has been completed, as I have been told on numerous occasions it had been taken care of

became Gold's GymAll Hour Fitness locations in StLouis were acquired by Gold's last June and as a result the members of these locationsThe initial language in his Hour Fitness agreement provided Hour Fitness the autonomy to ensure his membership moved over to Gold's seamlessly and allowed him to continue using this facility without terminatingPer conversations he had with the former General Manager at his location on January 19th of this year, it appears he froze his membership with Hour Fitness for months in April of until November of which coincided with Gold's Gym acquiring these clubsGold's Gym honored his freeze commitment time frame of months that he originally made with Hour FitnessHis membership was terminated without collecting any dues and we waived any owed balances after hes membership reactivated from FreezePlease let me know if there is anything further we can provideThank you
