2) Billing and Services
a) Standard Membership Plans
Instant Checkmate offers three standard Membership Plans. All Membership Plans are billed up front for the entire term selected.
Standard Membership Plan with a 6-Month Term: For a standard 6-month Membership Plan, the debit or credit card or other payment account you provide will be billed $59.16 immediately upon purchase and $59.16 every 6 months thereafter, unless and until you cancel.
Standard Membership Plan with a 3-Month Term: For a standard 3-month Membership Plan, the debit or credit card or other payment account you provide will be billed $44.58 immediately upon purchase and $44.58 every 3 months thereafter, unless and until you cancel.
Standard Membership Plan with a 1-Month Term: For a standard 1-month Membership Plan, the debit or credit card or other payment account you provide will be billed $22.86 immediately upon purchase and $22.86 every month thereafter, unless and until you cancel.
If your payment for a full term is declined due to insufficient funds, Instant Checkmate reserves the right to bill in monthly installments based on the monthly rates associated with the Membership Plan you selected.
b) $1.00 Trial Membership
If you select a trial Membership Plan (“Trial Membership Plan”), you will be able to try a Membership Plan and its accompanying services for five (5) days from the date of purchase for only $1.00. If you select a Trial Membership Plan, the debit or credit card or other payment account you provide will be billed $1.00 immediately upon enrollment, and you will have five (5) days from the time of enrollment to try out Instant Checkmate’s Services under the Membership Plan. If you do not cancel your Trial Membership Plan before the expiration of the 5-day trial period, on the 6th day after you enroll, you will automatically be enrolled in a monthly Membership Plan and the card you provided at the time of enrollment in the Trial Membership Plan will be charged $29.63 immediately and $29.63 approximately every thirty (30) days thereafter, unless and until you cancel.
c) Nonstandard Membership Plans
Instant Checkmate sometimes offers promotional membership offers or the opportunity to purchase a single report or several reports for an identified price with no further obligation. If you enroll in a nonstandard Membership Plan, Instant Checkmate expressly reserves the right to bill you at the identified price and based on the terms disclosed at the time of you enroll.
d) Negative Option
BY SIGNING UP FOR A MEMBERSHIP PLAN, YOU AUTHORIZE INSTANT CHECKMATE (AND ITS PARTNERS, AFFILIATES AND/OR AGENTS) TO CHARGE YOUR DEBIT OR CREDIT CARD OR OTHER PAYMENT ACCOUNT THE FEES ASSOCIATED WITH THE MEMBERSHIP PLAN’S TERM, AND YOU ACKNOWLEDGE AND AGREE THAT INSTANT CHECKMATE WILL NOT OBTAIN ADDITIONAL AUTHORIZATION FROM YOU FOR EACH RECURRING FEE CHARGED TO YOUR DEBIT OR CREDIT CARD OR OTHER PAYMENT ACCOUNT. IN ADDITION, YOU AGREE THAT INSTANT CHECKMATE SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY OVERDRAFT CHARGES OR FEES WHICH YOU MIGHT INCUR AS A RESULT OF YOUR MEMBERSHIP PLAN. Price quotes provided to you prior to any price modification shall be honored.
f) Cancellation Policy
You may cancel any Membership Plan at any time by going to [redacted] or by calling our customer support line at ###-###-#### to speak with one of our Customer Service Representatives. We're open 24/7 (Holiday hours may vary). Any cancellation request will ensure you are not billed further.
g) Refund Policy
Our number one goal at Instant Checkmate is customer satisfaction. If you are ever not satisfied with our Membership Plan and/or Services, feel free to call one of our customer support staff at ###-###-####, and we will work to resolve your issue. We're open 24 hours a day, seven days a week (Holiday hours may vary). Refunds are handled on a case-by-case basis with the ultimate goal of complete customer satisfaction.
h) Taxes
All orders are subject to applicable taxes in the states where the member resides.
i) Discounts and Promotions
Any applicable discounts or promotional prices will be noted at the time of purchase on the checkout page for your order.
j) Billing Errors
If you believe that you have been erroneously billed, please notify our Customer Service Department toll-free at ###-###-#### immediately to notify us of such error.
k) Reversals and Chargebacks
Instant Checkmate considers charge backs and reversals as potential cases of fraudulent use of our Membership Plans and/or theft of Membership Plans and will be treated as such. Instant Checkmate reserves the right of filing a complaint with the appropriate local and federal authorities to investigate. Be advised that all activity and IP address information is being monitored and that this information may be used in a civil and/or criminal case(s) against a customer if there is fraudulent use and or theft of Membership Plans.
We apologize that [redacted] was not satisfied with our services. As a gesture of goodwill, [redacted] has been issued a refund in the amount of $121.51. This refund has been credited back to the card that was used to enroll in our services, and no further charges will be incurred.

I never opened an account with instant check mate.  I did not even have the card in my possession until April 13 as a new one was mailed toMy home.  The charges were done on the 7 th and I was on California as of the 5 th. They somehow got the number and the lies I. The email are laughable.  Those charges are on my bill so that they don't have a record is a lie.  I can prove it with a copy of the bill.

I ran a check on myself to test the validity of the service. I was definitely disappointed and personally rate the service as a scam.

I would like to say that I had made several attempts to close the account online prior to the phone call in July. In addition, regardless of their policy, what they offer is quite different from what they advertise. They did not even come close to offering the background information they claim to. I could have done a free Google search and come up with more than I PAID them to find. This company is a Bait and Switch scam pure and simple.

The words “100% FREE” do not appear anywhere on our site in regards to the services provided. Ms. [redacted] may have encountered a third party ad with this wording, however, we have very limited control and we monitor third party affiliates as best we can to ensure they comply.
Users are able to search for free, and view basic information such as name, location, and age, but in order to access the full report, users must pay for our service. We would like to assist Ms. [redacted] and refund her payment, but we have been unable to locate this account with InstantCheckmate.com.  In order to further investigate, and ultimately resolve this matter, we will need additional information regarding the account. Until we are able to locate the account, we will be unable to provide assistance.

Or why didn't they state: "When possible we show whether or not a person has a valid SSN and a date or date range of when the SSN was issued"? I don't think they should even be providing dates of issue or approximate dates unless the person or entity inquiring has proven beyond any doubt that they have a legitimate reason to obtain that information (i.e., they are the IRS, the police, or a verified employer who is doing a background check).Instant Checkmate also responded: "xxxxx has already been opted-out of our site meaning her information nolonger appears on our website. Unfortunately, this means we cannot provide Ms. [redacted] with her personal report as requested since the information is no longer available to pull from."This is also duplicitous, as the entire reason I called and talked to [redacted] was to request a copy of all the information that was available to paying customers searching my records through Instant Checkmate so that I could review it for accuracy. [redacted] was adamant that this was not possible and wouldn't even give me the name or address of the company CEO. My data had not been removed when I made this request, yet they told me at that time that they would not allow me to get a free copy of my records; then they offered to remove my data. I also doubt that they can't still give me that report since every business I know keeps backup records of their computer data for longer time periods than this.I simply do not understand how this business can think that all their disclaimers (stating what customers cannot use the information from their reports to do, i.e., to deny credit, employment, tenant screening, etc.) will protect innocent people from being victimized by con artists or dishonest landlords and employers who WILL use the info against the subject of the report. If a potential employer doesn't hire you, you have no way of knowing on what information that decision was based; and the same is true if there are several applicants for an apartment.I further don't understand how they can be allowed to give out personal information about people without notifying the subject of the report who requested the information and giving the subject a copy of the report to be reviewed for accuracy, ESPECIALLY BECAUSE INSTANT CHECKMATE MAKES REPEATED DISCLAIMERS STATING THAT THE INFORMATION IN THEIR REPORTS MAY NOT BE ACCURATE.

Time has passed, however, I can honestly say that a curiosity would lead me to a website like Instant Checkmate, but I also can honestly say I would not spend 15 to 20 minutes providing information, only to be asked to provide credit card information and then pay $30 to get that information? I received an email from IC on 3/19 stating that an account was canceled on 1/24/13 and monies in the amount of approx $30 were credited back to my credit card? I have gone to IC's website and received confirmation that I "opted out" and "unsubscribed", and at this point have not received and phone calls or emails from 3rd party advertisers, which was my primary concern, and I hope that this continues.Thank you.Regards,
