Our records show that Ms. [redacted] signed up for an Instant Checkmate membership by entering her personal information and credit card information. In order to complete the enrollment process, Ms. [redacted] had to check a box to agree to Instant Checkmate’s Terms and Conditions. Instant Checkmate’s Terms of Use, like the Billing Details and Frequently Asked Questions also prominently displayed on the website, fully and conspicuously explain Instant Checkmate’s billing terms. Specifically, the Terms of Use describe:

1) Billing and Services
a) Standard Membership Plans
Instant Checkmate offers three basic membership plans. All membership plans are billed up front for the entire term selected.
For a standard 6-month membership, You will be billed $59.16 immediately upon purchase and $59.16 every 6 months thereafter, unless you cancel.


For a standard 3-month membership, You will be billed $44.58 immediately upon purchase and $44.58 every 3 months thereafter, unless you cancel.


For a standard 1-month membership, You will be billed $22.86 immediately upon purchase and $22.86 every month thereafter, unless you cancel.

If your payment for a full term is declined due to insufficient funds, Instant Checkmate reserves the right to bill in monthly installments at the rate You selected.
b) $1.00 Trial Membership
If You selected a trial membership, You will be billed $1.00 immediately upon enrollment of the trial. Your 5-day, $1.00 trial will expire in 5 days. Upon the expiration of the 5-day trial period, You will be automatically enrolled in a monthly membership and billed $29.63 immediately and $29.63 every month thereafter, unless you cancel. You may cancel at any time including during the trial period. See Section 1(d) below.
c) Nonstandard Membership Plans
Instant Checkmate sometimes offers promotional membership offers. If You enroll in a nonstandard membership, Instant Checkmate expressly reserves the right to bill You, at the rate and frequency disclosed at the time of You enroll.
d) Cancellation Policy
You may cancel your membership, including any trial or nonstandard membership at any time by calling our customer support line at ###-###-#### between 5am - 10pm Pacific Standard Time (7 days a week) to speak with one of our Customer Service Representatives. Any cancellation request will cancel Your upcoming bill.
e) Refund Policy
Our number one goal at Instant Checkmate is customer satisfaction. If you are ever not satisfied with our services, feel free to call one of our excellent customer support staff at ###-###-#### between the hours of 5am and 10pm PST (7 days a week), or between 6am and 2pm PST on holidays, and we will work to resolve your issue. Refunds are handled on a case by case basis with the ultimate goal of complete customer satisfaction.
We sincerely apologize that Ms. [redacted] was not satisfied with our services. As a gesture of goodwill, she has been issued a refund in the amount of $45.72, as per the request in the original complaint. This refund has been credited back to the card that was used to enroll in our services, and no further charges will be incurred.

available in our Terms of Use, which is made accessible through a link on the
bottom of each page of the website. Instant Checkmate does not make the claim
that our services are free on any page of our website.
 Billing
and Services
a) Standard Membership Plans
Instant Checkmate offers three
basic membership plans. All membership plans are billed up front for the entire
term selected.

For a standard 6-month membership, You will be billed $59.16
immediately upon purchase and $59.16 every 6 months thereafter, unless you
cancel.

For a standard 3-month membership, You will be billed $44.58
immediately upon purchase and $44.58 every 3 months thereafter, unless you
cancel.

For a standard 1-month membership, You will be billed $22.86
immediately upon purchase and $22.86 every month thereafter, unless you cancel.
If your payment for a full term
is declined due to insufficient funds, Instant Checkmate reserves the right to
bill in monthly installments at the rate You selected.
b) $1.00 Trial Membership
If You selected a trial
membership, You will be billed $1.00 immediately upon enrollment of the trial.
Your 5-day, $1.00 trial will expire in 5 days. Upon the expiration of the 5-day
trial period, You will be automatically enrolled in a monthly membership and
billed $29.63 immediately and $29.63 every month thereafter, unless you cancel.
You may cancel at any time including during the trial period. See Section 1(d)
below.
c) Nonstandard Membership Plans
Instant Checkmate sometimes
offers promotional membership offers. If You enroll in a nonstandard
membership, Instant Checkmate expressly reserves the right to bill You, at the
rate and frequency disclosed at the time of You enroll.
d) Cancellation Policy
You may cancel your membership,
including any trial or nonstandard membership at any time by calling our

Any cancellation request will cancel Your upcoming bill.

records show that, on January 25, 2014, Mr. [redacted] accessed Instant Checkmate’s website, www.instantcheckmate.com, and enrolled in Instant Checkmate’s monthly membership program by
entering his personal information, entering his credit card information, and
agreeing to Instant Checkmate’s Terms of Use.  Instant Checkmate’s Terms
of Use, like the Billing Details and Frequently Asked Questions also
prominently displayed on the website, fully and conspicuously explain Instant
Checkmate’s billing terms.  Specifically,
the Terms of Use describe: Standard Membership PlansInstant Checkmate offers three basic membership plans. All
membership plans are billed up front for the entire term selected.For a standard 1-month membership, you
will be billed $22.86 immediately upon purchase and $22.86 every month
thereafter, unless you cancel. You may cancel your membership, including
any trial or nonstandard membership at any time by calling our customer support
line at ###-###-#### twenty-four hours a day (holiday
hours vary) to speak with one of our Customer Service Representatives. Any
cancellation request will cancel your upcoming bill.  Our number one goal
at Instant Checkmate is customer satisfaction. If you are ever not satisfied
with our services, feel free to call one of our excellent customer support
staff twenty-four hours a day (holiday hours vary), and we will work to resolve
your issue. Refunds are handled on a case by case basis with the ultimate goal

to our records, as of July 7, 2014, Mr. Philip’s account with Instant Checkmate is in
dispute.  Because his account is
currently in chargeback status, we are unable to issue any additional refunds
at this time.
