I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
I would like to put on the record that it was NOT other groups that have been directing this assault at my phone number.  The contacts have all started with their intro, which is "Google representative Sharon" and the message is identical every time.  Obviously, they are not paying attention to the requests to be removed from their marketing blitz AND robocalls are illegal under FTC guidelines, so I do not consider this closed unless they specify that they are going to discontinue the practice of using robotic phone methods.  I have already filed an FTC complaint as well.

Internet Local Listings would like to start by stating that we take all client issues very seriously and investigate each matter in its' entirety to ensure that we better our client services and provide the best services and products possible. In looking into this issue, we have already attempted to...

resolve the issue with the client via emails that were sent directly to our CFO. In this attempt, the client was still not satisfied with the results as a refund is not warranted because we have provided all of the products and services that were promised to the client. The 59 Day Guarantee is written in the contract to ensure that clients understand how it works and what it means. Once we've received a signed contract back from a client, we assume that the client has taken the time to read the contract and has asked any and all questions that they may have about this contract to ensure that any and all concerns are thoroughly explained and agreed upon. In the account set up process, the client is offered the time to go through the contract on the phone with our Provisioning team to ensure that the contract is understood. The 59 Day Guarantee is not something that we "sneak" into our contract as it is our belief, again, that the client reads over the contract before signing and sending it back to us. These contracts are set in place so that all of our clients have a clear understanding of the products and services that we provide. The contract also states that Internet Local Listings is not an entity of [redacted] as we do not represent ourselves as such. Furthermore, placing a business listing on the front page of any Search Engine within three days is something that cannot be guaranteed as there are several variables that go into this happening. This is why we provide a 59 day guarantee as we are confident that with all of the work provided, we will be able to get the business ranking on the front page. It is possible to set up and activate a [redacted] My Business page in three days but this does not place the business on the front page of [redacted] right away. All of our clients are protected by our 59 Day Guarantee as we do not wish to charge the client for services and products after this allotted time period until the business can be found on the front page. As previously stated, a refund is not warranted to the client at this time because all promised products and services were provided to the client.  The 59 Day Guarantee goes into effect when the [redacted] My Business page is activated, which was on January 12, 2015, so we have not been allotted the full time period as agreed in the contract for billing to be pushed. We are more than willing to work with the client to come to an agreement but cannot assist in phone calls with our representatives being cursed at. At this time, we have attempted to come to an understanding with the client but have not been able to. We hope to be able to work with Ms. [redacted] and come to an agreement and provide successful services for the business.

Internet Local Listings representatives worked closely with Ms. [redacted] in order to keep her in the loop of what was going on with her account and change any information necessary. In getting clients set up for success in business listings, there are only certain categories that are made possible for selection and we cannot type in ones that do not exist. In these cases, we make the best selection available for our clients. This is why AviBee Naturals was showing as a Skin Care Company and not a candle company - because Candle Company is not an available category. While these instances are not ideal, they are out of our control and we work with what we are able to in the best way possible. We also use stock photos that we have available unless a client emails us photos that are approved for us to use which is why the photos were not from AviBee Naturals until Ms. [redacted] sent us the photos that she wanted used. In late April, a Customer Service representative spoke with Ms. [redacted] about her concerns and showed Ms. [redacted] that AviBee Naturals was found on the front page for 12 keywords. In accordance with the package that was purchased by Ms. [redacted], the products and services that we provide and the Contract signed and agreed to by Ms. [redacted] (please see attached), everything has been provided as promised. In accordance with the signed contract, a cancellation fee is required to cancel out an account with Internet Local Listings and this is why Ms. [redacted] continues to receive demand letters for this payment. Unfortunately, at this point, since Ms. [redacted] has refused payment several times, our billing department had no choice but to send the owed payment to a collections company and it is now out of our hands. We will contact the collections company and do our best to note this account for "extreme negotiation" so that the payment owed can be negotiated in an effort to relieve Ms. [redacted] of the total amount of owed fees. This is something that was made aware to Ms. [redacted] upon signing up and signing the attached contract. We ask that you understand our position in this as we provided Ms. [redacted] with everything that was purchased and are only doing our best, as a company, to hold ourselves and our clients to the same agreements.  Thank you.

Internet Local Listings would like to, again, apologize for any inconvenience that this issue may have caused Mr. [redacted] and would also like to state that contact was made in order to attempt to resolve these issues with the client. The date that our response was filed, May 7, 2015, we spoke with Mr. [redacted] on the phone to go over the transfer of the domain and hosting so that he could be provided it. During this phone call, we notified Mr. [redacted] that we were not able to purchase the originally selected domain as it had been purchased - at which point he explained that he had purchased it. If a selected domain name is already taken when we attempt to purchase it and set up the website, we make the next best selection for the client and for ranking purposes, which we did at that point. www.fixyourfloorsphoenix.com is up and live as one of the promised services to the client. We have also spoken to him several other times past that in order to reach a resolution in which he spoke with members of our Customer Service team as well as our Accounts Receivable department. The response written to Mr. [redacted] was shared with the Accounts Receivable manager after he told representatives that we promised him a full refund which was not stated in the response. We would also like to address the matter that has been brought to our attention that we charged Mr. [redacted] more than what was agreed to through the contract. The contract has been attached again for review - On page 4, the purchase price is outlined as follows: "Set Up Fee: $50 & Monthly Fee: $199.99 followed by: Total Paid Today (date): 4/29/2015 - $249.99 USD charged to account..." Mr. Dombrowksi signed the bottom of that page, as well as all other pages, to acknowledge understanding of the entirety of the contract. We have only charged the client $250.00 and have refunded the $0.01 that was technically overcharged. We apologize for the inconvenience of charging the extra $0.01 and would like to ensure that Mr. [redacted] understands that we have only charged him what he had agreed to in the contract that he signed that day. In closing, although the contract does make the cancellation fee clear, we have agreed to void out the cancellation fee technically owed to us, and agreed to, by Mr. [redacted] as a courtesy. The account will not be sent to collections and can be considered Cancelled, owing no further money.

Ms. [redacted], we have had several complaints about the message you are speaking about and have had issues with other companies using the same, nearly identical message when calling potential clients. That is why that was brought up in our first response; only to make you aware that you may be receiving phone calls from other companies in the industry as well so that you may place your number on their lists for further prevention from these phone calls. We have manually entered your phone numbered into our Do Not Call list and you will not receive any further phone calls from Internet Local Listings. Thank you.

The information that is used for the website that we created for the client is information that is gathered on our own unless clients provide us with information that they would...

Clients are informed that they can let us know if there is any information that they'd like to send to us so we can write for their business using that - otherwise, we have no choice but to go off of their website or other information we can find online. We also utilize the keywords that are provided to us by the client and did so in this case. When we spoke to Ms. [redacted] about the website, we worked with her to provide her with the changes that she wanted to make and after getting a better understanding of what were able to do with the website, Ms. [redacted] stated that she only need to change one keyword and that was done. Content was updated on the website 3 days after receiving the changes from Ms. [redacted] and changing out the keyword that was requested. When it had been updated, Ms. [redacted] decided to cancel at that time.  A refund is not warranted as the account is in a contract, see attached, and the client has already been sent to our collections department as the client owes an early termination fee that was agreed to in signing the contract. The collections department would be more than happy to workout an affordable payment from Ms. [redacted] in order to cancel out the account in its' entirety and prevent any further action from being taken. All of the information on this can be seen in the billing and cancellation section of the agreed to and signed contract.

Their response shows that they added a number  to their do not  call list,  just not my number. [redacted] is not me, I'm [redacted]. In addition my complaint is that their online system for removing a number as well as asking a live rep, and using their automated phone opt out, simply does not work. I have started to record their incoming calls, and it is them, not competitors who are calling me. if I ask really nice sometimes they will tell me the name of their  company when they call, other times if I ask what company it is, they hang up on me and I have to google the number to find out who it is (although it is pretty obvious with the same recorded bot that keeps calling. If the calls do not stop I will take my recorded phone calls to a lawyer and peruse legal action.

In looking through the issues described by our client, we sincerely apologize for the simple misunderstandings that have led Ms.[redacted] to believe that we were not fulfilling our promise. First and foremost is the issue with the photo email - the actual email is [email protected] - so it is easily understood where the miscommunication about this occurred. Of course, we apologize that our campaign manager, [redacted], did not spell it out to Ms. [redacted] to be more thorough. This issue, along with the issue of being listed at a "Boat Broker" could have easily been resolved had they been brought up in any one of the 3 phone calls that Ms. [redacted] had with our representatives [redacted] and [redacted] on July 17. Ms. [redacted] called in and spoke with [redacted] and was then transferred to [redacted] to take care of customer service requests. After that phone call, she spoke with [redacted] to [redacted]e her payment information for her next due billing date. After these points of contact, we spoke with the client on July 20 after receiving an email request (the only email received from Ms. [redacted] during the business agreement) to cancel services. In speaking with Brooke, it was explained that all of these things could be fixed  and it was advised that Ms. [redacted] not cancel services because she had signed the contract agreeing to the early termination fees if she wished to cancel.  We would never intentionally place our clients into any legal danger and are more than happy to assist in the business being listed as a "Boat Broker" - although we are unsure of where this is being found. The following link: CLICK HERE show the clients Google My Business page that was set up for them and nowhere does it say "Boat Broker". Of course the page is not built out as we are waiting on photos from the client - the correct email address was provided to Ms. [redacted] during the phone call that was made regarding the cancellation request - and content has been written and would be implemented into the listing if Ms. [redacted] was still a client. The Google My Business page can also not be completed until we receive the PIN from the client from a post card that was sent out on the July 6, the day Ms. [redacted] signed up and work began on the account. Attached is the signed contract by Ms. [redacted] that thoroughly explains all of the terms and conditions of the Starter Package that was purchased on July 6. The billing and cancellation policies, found on pages 4 - 6, thoroughly explain the way our clients are billed, the cancellation procedures and the early termination fees. This is all set into place the same for each and every one of our clients so that we can provide consistency and accuracy throughout every account that we take responsibility for. At this time, a refund is not warranted to Ms. [redacted] as work has been done on the account and a contract agreeing to the terms and conditions of our services has been signed. The dollar amount paid to Internet Local Listings already has been secured in order for work to be performed on the account and since the account was 14 days old upon cancellation, work has already begun. We hope that Ms. [redacted] will take advantage of our services instead of cancelling and being held responsible for the early termination fee as we feel the reasons given for cancelling can be reversed and a good business relationship can be maintained.

We would like to take this opportunity to address the rejection of the initial response that we submitted to Ms. [redacted]. As quoted in the initial response, the first young lady who sold the SEO services  to Ms.[redacted] did not state that the business listing would be ranking on the front pages of Google undoubtedly (please refer to the attached recording from that phone call). Yes, it was implied that the listing could be found on the front page within two, 2, weeks but also stated that it could take longer for the listing to be completely successful and find front page placement. Our goal is to provide front page placement as soon as possible for each of our clients but because of competition, saturation, location and the always changing Google Algorithms, it may take longer which is why we have the fifty-nine, 59, day guarantee in place. All of this was explained to Ms. [redacted] when she was transferred to our provisioning department and although it might sound like convincing language, Google does change their search algorithms between 500 and 600 times a year according to Moz.com, a leading SEO blog. (Refer specifically to http://moz.com/google-algorithm-change.) We would like to take the moment to explain that because we take pride in the customer care that is provided to all of our clients and do not want Ms.[redacted] or anyone to think that we provide inaccurate or false information. 
 
We have several departments and each has their own function; the sales staff is here to explain the services and products and the ultimate goal of first page placement on Google, the provisioning department is responsible for further explaining the process of these products and services and must send the client the Terms and Conditions as well as get the Google Business page active and live so that Google can begin to add the business to its' search results, the customer service department is available to process any requests that the client may have to change information, photos, etc. and assists clients with any questions or concerns they may have. After Ms. [redacted] spoke with Marissa, the call was transferred to Marcos in pinning and the account set up began. It was at this time that Ms.[redacted] found out about our fifty-nine, 59, day guarantee and could have cancelled services right away if the fact that the business listing possibly not being on the front pages of Google within two, 2, weeks was the issue. Had that happened, the payment would have been voided and services and products would not have been rendered for "Sea Interior Design", however, the Terms and Conditions were signed and returned and the account setup process was completed. In receiving the Terms and Conditions and finalizing the account set up process by making the Google Business page live, Internet Local Listings assumed that Ms.[redacted] wanted to do business with us and the rest of  the products and services were carried out and worked on each month to provide the desired results. 
 
Clients are sent directly to the provisioning department so that if there is an issue and the client decides that they do not want to enter a business relationship with Internet Local Listings, the payment can be voided as it would not have been processed yet: therefor, Ms.[redacted] didn't pay for services until the Terms and Conditions were signed. The main reason that payment is given when speaking with the sales representative is to ensure that only select people have access to billing information. Internet Local Listings has special forms and contracts for all employees with access to payment information and we take the safety of our clients very seriously. 
 
In closing, all of the attachments in Internet Local Listings' initial response, as well as the Google Business listing are all reflections of the services and products that were rendered to Ms.[redacted] and this is why a full refund is not warranted.

Review: I hired internet local listings to do advertising On [redacted] I was promised front page listing monthly tracking reportsSEO scrubs for my website and many other services none of which were provided. When I try and contact them they do not return my phone calls or my emails when I finally get somebody on the phone I asked to speak with a manager and they tell me they are far too busy to talk to me when they first received payment they told me they could not do anything until they had informationon how to access my websiteI told them I would have to get that information and get back to them. during the process of trying to get this information from them I was contacted by my credit card company informing me that someone was trying to change the passwords on my credit cards at this point I contacted internet local listings and they told me that the person representing himself as the ad manager had been fired his email account was closed and they had no record of any of my emails theY Asured me that I would be contacted by the somebody I have never heard back from anybody but the billing department and they will not let me talk to anybody else .they still never received that information 3 months later yet are still trying to bill me for a service they're not providingDesired Settlement: refund

Review: This Company has repeatedly called me. I ask the first girl on the phone if this was Google, she said yes! She patched me through to a [redacted], [redacted] took all my Credit Card info and again I asked if this was Google, He said no, the name of the company is Internet local Listings. I proceeded to tell [redacted], I'm not interested. I deal with Google directly, that I don't trust anyone else. He hung up on me, than his supervisor calls, he wants to know why I hung up on [redacted] and explain a few things to me. I told him that either he is lying or [redacted] is lying about the hang up and I am not interested in dealing/working with such a deceptive company. Again, I told them, I will only work with Google! He Stated I was being rude. At which point I hung up. They have now called me 3 more time this afternoon. Of course they are stating they are Google calling, so when the representative asks my Business name, I ask them what their business name is at which time they hang up. My advise to everyone stay clear of all Companies claiming they are Google and can put you on the first page of a search engine.Desired Settlement: I would like to be taking off this companies Call list and hope I won't have to file a fraudulent charge on my Credit Card.

Attached are three, 3, recorded phone calls that we have from Ms. [redacted]. We are aware of one other phone call that was made to the phone number in question but, unfortunately, these are the only recorded phone calls that we have from Ms. [redacted] as our systems do not automatically record outgoing calls. The first one is attached in reference to the first person that Ms. [redacted] spoke with. The second and third are the same phone call (in reference to the second person Ms. [redacted] spoke with) but have been split into two, 2, in order to omit the credit card information provided to our sales agent as we have strict policies in protecting all aspects of our client's personal information. Internet Local Listings would also like to make it extremely clear that only our Quality Control team has access to these recorded files as there is sensitive information in them.

Review: This company calls me multiple times per week using robocall telemarketing for many months.

I hung up on it many times and it would not stop so I finally starting pressing "1" to speak to a representative. The second I tell them I want to be put on their do-not-call list or that I no longer own the business, they hang up on me just to call back later. Every effort I made quickly ended in this same action.

I finally decided to pretend to listed to their sales pitch long enough to get their company information since they call from fake phone numbers each time and now am filing a complaint.Desired Settlement: This company is listed with a B- Revdex.com rating which needs to be reviewed and adjusted. A simple internet search shows the hundreds of people they harass and will not stop calling.

We are currently investigating the phone calls to ensure that any representative that did not process Mr. [redacted]'s request to be added to the Do Not Call List will be reprimanded as we have a no tolerance approach for this issue. Review: On July 6, I received a recorded marketing call asking me to confirm my google account, so I took the call, and was offered guaranteed to be first listing on google searches looking for my line of services (yacht management, cleaning, concierge, provisioning, film vessel locations), and was told my phone would be ringing with prospective clients. I talked to [redacted], campaign manager, who assured me my business would increase, and they would provide full website design, and all I had to do was send pictures to [email protected], and that he would be constantly in touch to help me through the setup process, and gave me the phone to contact him anytime [redacted], extension 3. I asked if I did not get what they were promising if I could cancel, he said yes. They emailed a contract, which I just signed, without reading the fine print. Turns out, the email I sent all the pictures to does not exist, and then I was listed as a "BOAT BROKER" which I am not, and could represent legal trouble for me for false advertising, or running a business I am not licensed for. I have called the number several times, both for [redacted]'s extension and customer service, I have emailed to [email protected], emailed via the google page I was given "Dicastel yacht concierge services.com" and did not get a response until today, when I got a call from customer service saying, I could not cancel, and I am forced to pay 3 months at $199.99 per month, as stated in the contract. I said I do not want to pay for a service that has not been given, in a category that could create legal problems, and that I do not want the service. She said I signed a contract, and could not cancel. I find this company, has taken advantage of promising a service that has not been provided, and gives me no room to protect my business and myself. Also the only calls received were solicitors, not potential clients.Desired Settlement: I paid $199.99 for the first month, and want full reimbursement and cancellation of a service I have not received as promised. Need to make any contract null and void, and want to do no business with this company, and my name, and business name completely detached for any association with this company.

Review: Back on 7/17/2014 my company ([redacted]) paid Internet Local Listings $1695.00 to advertise our company on the front page of Google. To this date 3/19/2015 we have not made it to the front page of Google. The contract we signed states that it could happen in as a little as 2-4 weeks but may take up to 60 days. Once our 60 days were up we started calling to find out how much longer it would take. Two months after our 60 days we were told that we would receive compensation for the time over our 60 days. To this day we haven't received anything from Internet Local Listings. After countless phone calls and emails to Internet local listings,finally realizing that my company would not be advertised on the front page of google I started requesting my money $1695.00 be returned. It wasn't long before I realized that this to was not going to happen.I noticed that it was becoming very hard for them to pull up my account and they would pass me from person to person before I was hung up on. I finally reached a manager ( or so I was told) by the name of [redacted] at extension **He told me that he could not find me in the system by my client ID number [redacted] and in and out of putting me on hold he came back and said that the reason that I was forgotten about was because I was left in a system that they were not using anymore. He then told me that he would put me in for my full refund and told me if I didn't receive it within a week or so that I could call [redacted]. After one week I called the number and have never gotten an answer. I receive mail from Google like they are advertising for me but every number I call on those pages people tell me they are unable to help me.Desired Settlement: Would like my full refund $1695.00 Would like my compensation for the time past my 60 days.Would like to be paid back the time I have spent on the phone and typing emails and complaints trying to retrieve my money.

continuously improve our client care. Upon signing up for our services, Ms. [redacted] received, signed and sent back our terms and conditions (please refer to attached

terms and conditions) that is signed by all clients of Internet Local Listings so that a

completely transparent business agreement can be entered into by both parties.

These terms and conditions guarantee that the client will be ranking on the front page of

Google Local within 59 days of signing up for services for at least 2 keywords.

Ms. [redacted] signed up for services on July 18, 2014 and is currently ranking

for the promised 2 keywords on the front page of Google (please refer to the attached

screen shots). The months in between that the business listing could not be found on the front page of Google are guaranteed to be added to the end of the year long commitment that was agreed upon when the client signed up at no additional cost. The account was noted to add one month of additional services at no cost at the end of the year long agreement as the business listing was not found on the front page for the month following the first 59 days of the account.

At this point, our billing department has already issued a refund to Ms. [redacted] and we politely ask that Ms. [redacted] stop posting negative comments on our Facebook as we are doing our best to handle the situation in accordance with the signed and agreed upon Terms and Conditions that our company abides by. Thank you.

Constant Robo Calls. They don't seem to stop even when you ask them not to call you. Misrepresenting their company as Google and themselves as Google specialists. I would never do business with them.

I RECOMEND ALL CUSTOMERS WHO IS GOING TO GET A CALL FROM THIS COMPANY TO STAY AWAYYYYYY BECAUSE I HAVE A SUCH BAD EXPERINCE WITH THEM, THEY ARE NOT HONEST 100%. TAKING MONEY IS THEIR JOB ONLY.

We take all comments and concerns very seriously and thoroughly investigate everything so that we may continuously improve our client care. Upon signing up for our services, Mr. [redacted] received, signed and sent back our contract (please refer to attached contract) that is signed by all clients of Internet Local Listings so that a completely transparent business agreement can be entered into by both parties. This contract guarantees that the client will be ranking on the front page of Google Local within 59 days of signing up for services for at least 2 keywords. Mr. [redacted] signed up for services on January 7, 2015 and is currently ranking for 6 keywords on the front page of Google and Google Local (Google Maps) sections (please refer to the attached screen shots).

Review: On 1/13/15 salesman of Internet local listings called us and offered help getting our company on the top of google and other browsers search engines. They promised that within 3-4 weeks we will see our companys website on the top of selected search engines in the selected areas (zip codes). I told them specifically that our business address ([redacted]) doesn't need to be pushed since the main service area is about 15 miles south of that address and until now I always had problems with internet marketing targeting the areas where we actually the business. He said that we can either do radius or hand pick the zip codes for this marketing campaign. They asked me to provide zip codes for this project. I gave them 15-16 zip codes of the towns where we serve our customers and also told them to use our website, where service area is clearly stated. They promised to start right away and charge us $220 for the set up fee. Now over a month later when I saw no improvements on the search engines I called them to find out what's going on. The technical support guy told me that our selected area of [redacted] is being pushed on all engines. When I asked him about other zip codes, he replied that I only signed up for 1 zip code ([redacted]) and unless i'm willing to pay more that will be the only zip code pushed.

We spoke with [redacted] on February 13, one month after signing up, and he requested information about his account to which we provided him with knowledge that he was already ranking for one keyword at that time. We also informed him that this was a great position for the business to hold on the front page so quickly and that there should be further improvement by the time the account reached the 59 day guarantee. We also offered to provide [redacted] with the log in information so that he could check out his business rankings personally.
