October 21, 2016Thank you for your letter dated October 3, regarding *** ***I was sorry to hear that *** *** felt that her Vacation Program Agreement was not satisfactorily fulfilling her vacation needsIt is never our intention to displease our clients, and it is always disheartening
to learn that a valued customer might be dissatisfied.In her letter to your office *** *** claims that Sundance Vacations “make(s) it impossible for you to utilize their services,” and continues to assert that “this company does not honor its promises.” While it is true that *** *** has not used any of the vacation weeks that she purchased through her Vacation Program Agreement, we take great exception to this inaccurate portrayal of her experiences with our services.After reviewing the records of *** ***’s interactions with Sundance Vacations, we see that on two separate occasions she contacted our reservations staff to inquire about possible availabilityOn September 22, *** *** discussed a trip to somewhere with an indoor water park, and was offered a reservation at the *** *** *** Resort in upstate New York ??" a property that has an indoor water park on siteOur records indicate that she said that she would call us back to finalize the booking, but never did soA similar scenario took place on February 4, 2016, when *** *** was offered reservations at several different resort properties, told our reservations staff that she would call back to finalize the arrangements, and never did.When we received your letter, we had a representative from our Customer Service team contact *** *** in order to see if we could reach some sort of amicable resolution to this matterOur records indicate that after discussing this matter with *** *** on October 10, 2016, we agreed to cancel her Vacation Program Agreement and provide her with a full refund of the principle paid towards the AgreementOur records indicate that she was pleased with this resolution.We trust this resolves the complaint and ask to be notified if it is not considered resolvedShould you have any questions regarding this or any other matter, please do not hesitate to contact this office at ###-###-####.Sincerely,Ed CSrManager, Customer Service

ensure that all information is fully disclosed prior to any purchase taking placeWe strive to communicate, both verbally and in writing, all information in a manner that is easy to understand.In reference to *** ***’ assertion that she was not provided with all of the details regarding the fees associated with her Vacation Program, we feel that all such fees were well-covered within the AgreementWe have included copies of the pertinent pages of the Agreement for your reference, and we ask that you notice that *** *** signed/initialed all of them to indicate that she understood their contentsThe most clearly-defined portion of the Agreement is the Consumer Disclosure Acknowledgment, a document that has our clients answer a series of easy-to-understand questions by initialing either “Yes” or “No.” The portions of this form that address the fees are copied below, and we ask that you notice *** *** initialing in the affirmative in every case

March 17, 2017Thank you for your letter dated March 9, regarding *** ***I was sorry to hear that *** *** felt that we had not addressed the concerns that she had expressed in her original letter of complaint to your officeWhile *** *** disagrees that we are at an “impasse,” we have no other term for the situation that we currently find ourselves in*** *** insists that all of the terms and conditions of the Vacation Program Agreement were misrepresented and presented as part of some “deception.” To the contrary, we have provided signed documents from over four years ago that show, in great detail, how all of the fees associated with *** ***’s Vacation Program were covered adequately.Although we have multiple signed documents that counter all the assertions of malfeasance put forth by *** ***, it is becoming increasingly apparent that pursuing any future relationship with her would prove to be imprudentWhile she has not used any of the vacation weeks that she purchased, she also had several vacation weeks on hold in 2013, only to change her mind and decide not to use them(To reiterate, these are vacation weeks that we made available for her use only to have her decide that she didn’t want to use them.)In order to reach an amicable resolution to this matter, Sundance Vacations would be willing to refund *** *** 50% of the principal paid towards her Vacation Program and cancel the Agreement, also relieving her of responsibility for the $6,still owed on the contractTo date, *** *** has paid $5,towards the Vacation Program, so our refund offer would be for $2,If this is acceptable, we ask that *** *** contact us so that we can provide her with the appropriate paperwork to sever our relationship.We trust this resolves *** ***’s complaint, and we ask that you notify us if it is not resolvedShould you have any questions regarding this or any other matter, please do not hesitate to contact this office at ***.Sincerely,Ed CSrManager, Customer Service

Consumer Protection Laws and the efforts our sales staff undertakes to ensure
that all details are disclosed.? The fact
of the matter is not that *** ***’s
right to rescission was revoked, but that it never existed in the first place,
in part because he entered into this Agreement in our permanent place of
business, and not in his residence or over the telephone.? This is information that is well covered in
