For instances the Consumer Disclosure Form is given to you and reviewed at warp speed. At no time during or after the form was signed did they make it clear in layman's term that I could not get my money back if I cancelled at a later date. Upon questioning by me the representative stated then that I could cancelled if I was not happy with the package.In reference to the call initiated to Sundance on October 6th, I did not agree to have them keep any funds associated with services I did not use (please review the phone call). A review of the letter that was also sent will show that I requested and demanded that Sundance return the full total of my $1,300.00. I also stated that as a fiduciary responsibility the company contract should have consideration for both parities and not just a written document that suits only the sellerSundance has a legal responsible to myself to return funds not used or for services not rendered. In addition, the respondent referenced a promotional gift (cruise) that was free, however, at no time during the presentation did they say cruise it was a airline flight to Montego Bay, Jamaica.In closing I would like to say that no company should be able to bind a person to a one-sided illegal agreement. If a person chooses to cancel the agreement prior to using any of the services where is the justification or argument in keeping the fundsThe mere fact that you wrote a contract that favors you does not make it legal or binding when no consideration is given to the buyer.*** ***

October 21, 2016Thank you for your letter dated October 14, regarding *** ***I was sorry to hear that *** *** felt that the details of her Vacation Program were not adequately disclosedIt is never our intention to mislead clients, but rather one of our main priorities to ensure that
all information is fully disclosed prior to any purchase taking placeWe strive to communicate, both verbally and in writing, all information in a manner that is easy to understand.Regarding *** ***’s insinuation that the fees associated with the Vacation Program were not covered adequately, we feel that this is a complete misrepresentation of the efforts made by our Sales staffThe fees that *** *** takes issue with were covered in her Vacation Program Agreement purchased on February 20, I have provided your office with copies of her Agreement, which I will excerpt below for your easy referenceThere are only three fees that are associated with *** ***’s Agreement that are in addition to the base price of her vacation weeksThe first of these fees is the Annual Service Charge, which is covered in two different places in the Vacation Program Agreement, and I have copied both of these sections for your reference below.The Annual Service Charge is also clearly covered in the Consumer Disclosure Acknowledgment, a portion of our Agreement that asks our customers to respond to a series of “Yes” or “No” questions by initialing in the appropriate columnWe ask that you note *** ***’s initials in the “Yes” column for question number below, signifying that she was aware of the fact that there was a Service Charge due annually.In addition to the Annual Service Charge there are only two other fees that *** *** can be claiming were not disclosed: the Unit Size and Unit Upgrade Fee and the Prime Season UpgradeIn the Terms and Conditions of the Vacation Program Agreement there are multiple references to these fees, as outlined in the sections copied below.These fees are also covered in the Consumer Disclosure Acknowledgment, and I have copied questions number 8, and below, which shows *** *** initialing in the “Yes” column, indicating that she was aware of the upgrade fees associated with the Vacation Program.To ensure that these fees were imparted to *** *** she was also provided with a Seasonality Guide, which uses an easy-to-understand chart as a means of ensuring that all details are clearly coveredI have enclosed a copy of this form for your reference, and we ask that you notice that *** *** signed the form signifying that she understood its contentsWe also ask that you note that *** ***’s signature is just beneath a portion of the form that clearly states the fees associated with travel during different times of the year.Regardless of these facts, when we received your letter we had a representative from our Customer Service team contact *** *** in order to see if we could reach some sort of amicable resolution to this matterOur records indicate that after discussing this matter with her on October 18, 2016, we agreed to cancel her Vacation Program Agreement and provide her with a refund that was both fair and equitableOur records indicate that she was pleased with this resolutionWe emailed our standard Termination Agreement to *** ***, and as soon as she returns the signed document to us her Vacation Program will be effectively cancelled and we will mail her the agreed upon refund.We trust this resolves the complaint and ask to be notified if it is not considered resolvedShould you have any questions regarding this or any other matter, please do not hesitate to contact this office at ***.Sincerely,Ed CSrManager, Customer Service

I am rejecting this response because:On January 4, after speaking on the phone with MrRichard M*** at Sundance (he called me following my last refute of how Sundance was handling my concerns/denying full refund and Sundance receiving further communication from the Revdex.com that I was refuting), MrM*** agreed to give me a full refund, but said I must sign a "Confidential Termination, Release, and Refund agreement" and that he would send to me via e-mailWhen I asked why I could not have my full refund without signing this document, he insisted that it just must be signedHe e-mailed me a copy of this agreement and upon my review, the agreement was dated incorrectly (as Dec22, when it should have been created and dated per our conversation on January 4, 2016)This agreement also mentioned a girl I originally spoke with who I had requested a full refund from (named Jessica in the letter, but her last name was conveniently omitted from the letter)Please see MrM***'s response when I asked him why the agreement was not dated accurately and did not state who Jessica was:"*** ***, You initially spoke with Jessica A*** on 12/22/requesting cancellation, she prepared all of your paperwork in the event that you would come to the mutual decision to cancel your account. However, at the end of your conversation, you accepted her offer to amend your agreement to weeks Paid in Full. Your paperwork was already saved in our system, and unfortunately the old paperwork was generated and sent to you. I apologize for the error and any confusion. Please find attached the new paperwork with the correct date and name information. As we discussed, my last name is M***. Sincerely, Rich M***New Client ServicesSundance Vacations###-###-####"*It is important to note that this Jessica A*** woman refused to give me a full refund (was trying to stick me with an open account/vacation package by making me use 2, 7-day vacations and pay a $30/month service charge to keep the account open) and also insisted I sign a document for this to happen (otherwise the vacation package would continue "as is" and I would continue to be charged monthly until the package was completely paid off)Why then if she said she absolutely could not give me a full refund would she have drafted paperwork on Dec22, for me to sign for a full refund? Something doesn't add up, right? After I questioned the incorrect date on paperwork and mention of "Jessica" instead of "Rich M***", on January 5, a revised "contract" was e-mailed to me by the alleged MrRichard M*** at Sundance with a revised date of when I spoke with MrM*** and he included his name on the paperwork instead of this vague "Jessica"MrM*** did say that Sundance would issue me a full refund (downpayment I made would be credited back to my credit card and a check would be made out and sent to me for the monthly payments made from my bank account), but stated that in order to receive my full refund this contract must be signedPlease see the language of the exact contract copied and pasted below:"Re: Confidential Termination, Release and Refund Agreement

Phone: ###-###-####"Sundance is claiming (not just verbally any more, but in this written agreement) that this vacation package "is noncancelable" and "not subject to any period of rescission in the governing state" even in this termination agreement.This is a question to the Revdex.com-How can Sundance Vacations try to force someone to sign a document to cancel a vacation package/agreement that has been falsely advertised (critical details of the vacation packages are omitted during sales such as how very limited the vacation options are for dates and venues to stay at in addition to upcharges and other cleverly "omitted" details/caveats)? Then when I review this termination agreement Sundance wants to force you to sign, it is essentially a "gag order" trying to deny my First Amendment right to freedom of speechA key sentence in the agreement is "Traveler agrees not to disclose, reveal, publicize, post or convey the terms of this agreement or any of the facts forming the subject matter of your claims to anyone other than your professional advisors, except as may be required by law." Sundance Vacations does not want people to know what kind of business they are operatingThat is quite clear at this point! I would also like to point this out as a clear example of "blackmail"-Sundance says we'll give you your full refund if you shut up and don't tell anyone about your honest experiences with the company. My interactions with Sundance Vacations have set off many red flags for me (the more I have to interact with them)I strongly suspect based on my experiences and hearing of others' experiences that they are likely to commit fraud/criminal acts to make a profit from honest, hard working peopleI do not trust who I am speaking with when talking to these various folks at Sundance VacationsPrior to speaking with MrRichard M*** (one "n" in his last name he told me), the other women (Jessica and Sandra "Sandy") supposedly in corporate office who I spoke with would not give me their last names and did not include their last name on the agreements sent to me via e-mailIt is quite likely that some of these names may not even be real names-this is something that needs further investigation by Revdex.com if it hasn't occurred alreadyIf Sundance Vacations lies about so many other things and is deceitful to customers, why would proper identification of who you are speaking with be valued to them? Sundance Vacations has had many complaints brought against them (Revdex.com documented and otherwiseAt least people on social media against their practices) in the past and I want to know how they have gotten away with it as long as they have! Sundance Vacations, *** *** *** (***) Inc., and the financial institution affiliated (*** financial) are likely all one companyI do know that Sundance Vacations and *** Financial have the same ownershipWhen something goes wrong (Example A: Customers are upset and want to cancel), they all claim you have to talk to someone in the "other office"By the time you get passed off and put on hold by them several times, you come to realize that something is upGocrv.com is another website to investigateSundance vacations gives away "promo vacations" (that they promote as free cruise or trip) to get people to come in to their regional offices and listen to their long speech on how great Sundance is and how their vacations are like "the Sam's club of vacations" and you get such a great deal getting the vacations at wholesale cost***.com says on its website that it specializes in "promotional certificate fulfillment processing"To process and schedule your "free" vacation, you have to complete several steps online and wait until you receive an e-mail with additional steps and send them a $booking fee that they say goes toward taxes and feesThen when you go to try to book the "free" vacation, they require you to select dates (must be at least days apart from one another) and they send you an e-mail when it is within days of the 1st date to call them and bookWhen you try to book they give you the run around (there is nothing available on these dates or your flight for people must leave from the same exact airport even if you don't live in the same area)So many stipulations that they know you will likely give up due to frustration! Here is info about of the owners of Sundance:"Tina D*** co-founded Sundance Vacations in with her partner and husband John D***In her years with the company, Tina grew Sundance Vacations from a small statelemarketing office to a leading provider of affordable wholesale vacations, with over employees and over 80,travelers nationwideTina's award winning vision has guided the growth of the company straight to the Inc500/Fastest Growing Companies List."*It is interesting to note that Sundance Vacations started off as a telemarketing officeHow does a telemarketing office morph into a vacation company that is supposedly out to help people purchase affordable vacations? All about selling things to people and calling people to rope them into buying something.Supposedly Gocrv.com started in There are clearly connections between Sundance and addresses in Florida (FtLauderdale-gocrv.com has address listed there).I am again demanding a full refund from Sundance Vacations (with no strings attached!-no agreement to sign that is signing away my freedom to speech and dignity) due to all of these reasonsIt has taken talking to people (person allegedly in customer dispute office and alleged managers) at Sundance Vacations with some conversations up to hour in length and numerous requests to give me my full refund) plus getting the Revdex.com involved to get to this pointI have repeatedly stated to Sundance Vacations that I do not want any further affiliation with this company and will not be coerced into electronically signing a document that is on their terms ONLY.

February 16, 2018Thank you for your letter dated February 6, regarding *** ***I was sorry to hear that *** *** is further insisting that the details of his Vacation Program Agreement were not adequately disclosed, in spite of the numerous signed/initialed segments of his Agreement that we referenced in our prior communication.*** *** seems to have now shifted his contention from the earlier argument that the fees associated with the Vacation Program were “misrepresented.” In his most recent response *** *** now states that there were “constant distractions...which did not allow [them] to fully absorb” the costs detailed in the AgreementWe feel that this assertion is completely without merit, and we feel that the multiple instances that were provided in excerpts from the Agreement more than support our contention that they were adequately disclosed.When reading *** ***’s letter to your office, I was also concerned about the level of confusion he expressed regarding the financing arrangement he entered in to on February 8, When purchasing his Vacation Program Agreement, *** *** was provided with several forms describing in great detail how the financing of the package was going to be handled: a Truth-in-Lending Disclosure Statement, a Retail Installment Contract Addendum, and a Promissory NoteI have provided copies of these forms for your reference, and we ask that you notice that *** *** initialed and signed all of them, signifying that he understood their contentsTriState Financial is the “Seller’s servicing agent” that manages the payments made for the Vacation Program Agreements sold by Sundance Vacations, as detailed in the Truth-in-Lending Disclosure StatementThis is also detailed in the Agreement itself, which clearly allows for the monthly installments to be collected by the “Seller’s designee/assignee,” as shown below

March 25, 2016Thank you for your letter dated March 17, regarding *** ***I was sorry to learn about *** ***’s dissatisfaction with her Vacation Program Agreement purchased on September 14, In particular, I was sorry to learn that she claimed that she had “not been able to
use” our services because of a lack of available properties, and that she wanted to be “out of this relationship.”*** *** claims that she has made “exhausting effort[s]” to make a reservation on her own, presumably by booking online at Travel Advantage Network’s websiteWhile she claims that she made attempts to book vacations “a year in advance,” there is no record of her doing so available to usThis is not in any way an allegation that she did not attempt to do so, but simply an acknowledgment that there are no records kept of general searches for availability made on that website (www.planwithtan.com)What is certain, however, is that we have no records of *** *** attempting to make any reservations by speaking to any of our reservationists by phone.It is also apparent that much of *** ***’s complaints were fueled by her involvement with the Boycott Sundance Vacations page on ***This page has a well-documented history of dispensing “legal” advice to consumers that are looking to get out of their contractual obligations with Sundance Vacations, regardless of the pertinence or accuracy of that adviceWe monitor the Boycott Sundance Vacations *** page in an effort to address any issues that our customers might be having, and we noticed instances of *** *** seeking advice on what best strategies could be employed to cancel a Sundance Vacations AgreementOn March 17, (the same day that *** *** filed her complaint with your office) we noted that she posted on that page that she had “read your cancellation article,” and was hopeful that these strategies would work for her.Upon receiving your letter our Customer Service team immediately began attempts to contact *** *** to see what could be done to remedy the situationAccording to our records we have left voicemail messages for *** *** on multiple occasions (March 18, March 22, March and March 24, 2016), all requesting that she contact us by phone so that we can discuss her account and reach an amicable resolutionThe only responses that we have received thus far (other than a brief phone call on March 23, to say she couldn’t talk because she was at work) have been emails from *** ***, mostly reiterating her version of the facts stated in her complaint.As of the writing of this letter we have not been able to converse with *** ***, and as a result we are not able to offer a resolution to this complaint at this timeI remain confident that if given the opportunity we could resolve *** ***’s concernsIf *** *** continues to be an active participant in the resolution of her complaint I am certain this matter will be resolved satisfactorilyI would encourage *** *** to contact our Customer Service department at her earliest convenience.We trust this resolves the complaint and ask to be notified if it is not considered resolvedShould you have any questions regarding this or any other matter, please do not hesitate to contact this office at ###-###-####.Sincerely,Ed C.SrManager, Customer Service

In his complaint to your office Mr*** states that there was a “booking fee” of $99, as well as a “peak rate” of $30/night that were not covered by our Sales staff, claiming that these details were “hidden” or “misrepresented.” It is the position of Sundance Vacations that such claims are entirely unfounded and without merit, and not at all a reflection of the efforts our staff undertakes to ensure that all details of the Agreement are covered extensivelyAs a point of reference I have included several pages of Mr***’s Agreement for you to considerPlease note that in sections Eand Fof the Agreement the fees in question are clearly addressed. In addition to addressing these issues in the body of the Agreement, we also provide all of our clients with a Consumer Disclosure Acknowledgment, which outlines the important details of the Agreement through a series of easy-to-understand questions which our clients answer by initialing either “YES” or “NO.” In the sections of the Acknowledgment that I’ve included below, you can clearly see that Mr*** initialed “YES,” signifying that he was aware of these details. To further ensure that our clients understand the Seasonality of our inventory we provide a Seasonality Guide, which clearly defines which resort areas incur peak season upgrades for the different months of the yearI have enclosed a copy of this form for your reference, and ask that you notice that Mr*** signed the form to signify that he understood its contentsThis signature, shown below, is within a fraction of an inch of the bold-typed statement that there are $per night fees associated with travelling during Prime seasons. I am sending you this in response to the correspondence I was copied on from Ed C***, Senior Manager of Customer Service, Sundance Vacations, dated June 20, 2016.I would like to first address MrC***'s statement regarding his company's sales processCan only speak to my personal experience, and as stated in my prior Complaint information, the process was hurried, details were not clearly explained to me and I felt extremely pressured into signing Same, never denied that my signature, or initials, were on the documents, but instead, stated that I did not have a full understanding of what I was purchasing at the time and all of the details in those numerous documentsAs MrC*** was not there, nor did he participate in any part of this process, think his opinion in this regard is based on what he believe his safes team should embody as professional conduct, but has no personal knowledge of this exact exchangeI did not have adequate time to review the documents, nor have a full understanding of what was involved and after months of paying for a "vacation package" was not going to be able to use, NOR could afford and would never collect on, attempted to dissolve this agreement.As explained previously, paid monthly payments on this "vacation package" since June I never attempted to utilize this package, don't want it, didn't need it and could no longer afford the payments as wellindicated this to the Sundance Vacation representatives who began harassing me by telephone, and correspondence, once stopped the monthly authorized payment for sameAT NO TIME DID ANY OF THOSE SUNDANCE EMPLOYEES try to discuss this issue, recommend a refund or try to resolve this in any way, other than to insist pay what was owed and continue to do so, because this was a legally binding agreement and had to repay the "loan" had taken.Further investigation on my part revealed that there was no "loan" involved in my purchase and that DID have the right to dissolve this agreement at any time was not satisfied or willing to stay in SameMy attempts were ignored, which is why I have contacted your office.I also want to say that take offense at MrC***'s insinuation that somehow decided to do all this because of some *** page that was created against his company?? I am the one who contacted them on the 7th (they did not contact me) In fact, I called them twice that day, and when they told me that the person of whom I have been playing phone tag with was not available, I asked to speak to another representative. At that time they told me that there was no one there that could help meNone the less, with persistance in wanting to resolve this issue, I said that I would like to get this resolved at that present time, and that too much of my time and Sundance Vacations time has been wasted to continue the phone messages etc. I believe the gentlemans name was Bob and he asked me to hold at which time he got Jessica on the phone. Within several minutes of speaking to her, my issue was resolved. She is the one who should be patted on the back. Give her the credit for resolving the issue.I would recommend that Sundance spend less time on orchestrating their letters to make them look like they go over board for their clients, and spend more time on getting their facts straight.
