I contracted Marketplace Homes to manage my property in Indiana. They advertised as being able to find good tenants and maintain the property. After having to repeatedly hound them about missed/late rental payments and still missing late payments I decided to let them go after the lease was terminated. This came sooner than expected. The tenant complained that the air conditioner was no longer working. The technician that Marketplace Homes selected reported that the blower on the 6-8 year old AC/Heating unit was out because of a lack of maintenance. Maintenance was the responsibility of Marketplace homes, which has necessitated a $5,500 repair to make the house habitable again. This repair necessitated by Marketplace Homes is a impossible burden at this time.

The lease had a clause that it terminates if the home becomes uninhabitable. Having no air conditioning in Souther Indiana for June July and August qualifies as making the dwelling uninhabitable. Because of Marketplace Homes abysmal performance and the resulting termination of the lease, I told Marketplace Homes that they would no longer be managing the property. I have since mailed a notice to the tenant that the lease is terminated, and gave them 90 days (rent-free) to vacate. I also informed Marketplace Homes that they would no longer be managing the property. They still owe me $675 for this month's rent which has already been collected. Marketplace Homes also owes me a $1500 deposit that I plan to return to the tenants on moving out. They tried to extort an agreement to pay all of their legal fees and to "indemnify" them for any loses that they incur because of THEIR negligence. This is a ridiculous and unethical attempt to withhold money that rightfully belongs to me and the tenant.

Good Afternoon ***,I am writing you regarding your home at ***. There are a few emails that have been forwarded to me and I apologize, but I have to be honest that for whatever frustration you have towards Marketplace Homes right now, it goes both ways. Under normal circumstances we jump through hoops to find ways to back our Owners whenever possible, but you seem to want everything and zero liability right now, which is crazy. Here's some bullet points on recent events at your home from my interpretation. I do ask that if you feel I am wrong in any of this that you please let me know so that I can get your side of the story here too :-There is quoted needed service with the biggest ticket item being the A/C for your home. You told Debi Evans on our Property Management Team that you were not going to do this, and to give the Tenants a 90 day Notice to Terminate the Lease as you were having the home uninhabitable-You have demanded the Tenant's Security Deposit sent to you-You refuse to sign the Owner Take Back with Resident Form, as you do not agree to indemnify our CompanyI have a couple of questions :1) If you want to give the Tenants 90 days to vacate, but want to terminate your Lease with Marketplace immediately, how do you expect us to just hand over the Tenant's Security Deposit to you when you will not sign our Take Back ? 2) Please be honest. If you were in my shoes, and standing in front of a Judge who knows that the Lease was terminated early due to the Owner of the Property's decision not to address a mechanical service in the home, would you guess that the Judge would favor for you as the Owner to get the Security Deposit Money, or to the Tenant who was forced to Leave because their A/C can't be fixed and the Owner told them to ? If you think the Judge would favor towards you, please explain your thought process. If you think the Judge would favor towards the Tenant, please explain why Marketplace Homes should knowingly do something to put ourselves in a compromising decision down the line, not to mention the fact that it's the right thing to do in reimbursing them. If you sign the Owner Take Back with Resident Form, we will release the Security Deposit to you, and you can handle the move out and if you decide to just keep the SD, that's your decision. If you refuse to sign the Document, I will wait to hear from your Attorney as you suggested, and I'm confident that Marketplace is doing the right thing.Please let me know.Thanks,***Marketplace Homes

I own a house in Georgia that I rented with Marketplace Homes for two years while I was working in California. Overall, they did a very good job. They handled all the paperwork, and dealt with the tenants when the rent was late, and kept me informed during the entire process. The only real problem I had with them was they never sent anybody out to do annual inspections, similar to how most apartment complexes do.

Sadly, when I returned to Georgia, I discovered the tenants weren't taking care of my house properly, e.g. the grass was two feet tall, the interior was fifty with mold and mildew in the bathrooms, the walls were nasty, with crayon writing on every single wall and door, etc.... My two year old washing machine and dryer weren't working correctly, my three year old refrigerator was broken, and semi-gloss paint was used to cover up spots on walls that were originally painted with eggshell paint.

When the contract ended, I didn't renew it because the tenants were not very clean, and didn't like doing basic yard maintenance,e.g. cutting grass and trimming hedges. To date, I've spent over $4,000 trying to restore the house from the damage left by my former tenants. If Marketplace would have simply sent somebody out to inspect the property, at least annually, I would have given them a solid "5" rating because they would have discovered, after only one year, the tenants needed to go.

I am sorry for the delay. These were going to the wrong email.  I have sent this onto the correct department and will get back with a response soon.

I'm familiar with the issue.  We're happy to break the lease but would simply ask 2 things;1)  you release the complaint as nearly everything in this complaint has been challenging due to the owner. 2)  cover rent until you're able to move out.Does that sound fair enough?

could not find any reason why we would have sent this notice to her, she had left in good standing. I asked [redacted] if she could send me a copy of the notice she received, she indicated she no longer had it, I also inquired as to any additional notifications or emails that had been received,[redacted] indicated that the notice that had arrived in early February was the only correspondence that she had received from Marketplace Homes. As the conversation progressed I  assured [redacted] that this had been an error or our part and if any additional notices were received please contact me immediately. I have not heard from [redacted] since our initial conversation. I am not aware of any reporting that has been done to any of the credit  agencies, I believe that the paperwork that was sent by Marketplace Homes  was a 7 day notice to vacate  not an actual you are being evicted notification, in other words a internal document that was sent by Marketplace Homes not something that was sent by the courts.If [redacted] has any additional  attempted communication from Marketplace Homes in reference to this issue I will be more than happy to further research and resolve as quickly as I can..

home and that is what they are chosing to do. What we can offer - as the owner wants to sell the home we would be happy to extend rent credits and the option fee towards the agreed upon price if you can agree to close in the next 30 days.  Again, our company is in the middle and must follow an owner's wishes as we manage the property, we don't own it. I can appreciate your disappointment when you didn't get the home. There is no bait and switch, the rental market is really strong. We often have multiple offers on a property. When that happens we provide everyone 24 hours to submit the highest and best and the owner decides what the want to...

Our team was being genuine in explaining that the owner was looking for a fast move in.  It costs us money and time to run applications and everyone knows there I'd a chance you don't get the home. Although we feel badly you didn't get the home, there is nothing that was intended to harm you or your family.

We are sorry for any inconvenience you have had.This is what we have in our records on the property.On February 22nd a No heat service ticket was called in and the owner elected to resolve the ticket. The owner sent out a trade and they diagnosed the unit needed to be replaced. The...

owner offered space heaters for the time being but this resolution did not suffice for the tenant and she called in stating she wanted to terminate her lease. We allowed her to do so without penalty but in return canceling the owner's rent out. Her move out was scheduled for 3/31 and she requested additional time in which we gave her and still did not charge her. She ended up vacating on 4/10. The home overall was left in good condition but it needed to be cleaned. My contractor quoted $325 to do so but she disputed. We then emailed back and forth trying to come to a fair resolution but she felt nothing except for $100 cleaning charge would be fair. I brought the charges from $325 to $175 and a request to reimburse the $150 has been submitted. Her dispute is that the home was not left in good condition when she first moved in however, her move in checklist was never returned. She feels that because she chose to vacate due to the no heat issue that her responsibilities as the tenant should be waived and she should not be held accountable for anything....

We're very sorry that the client feels this way.  The best we can offer is to waive the fee to move out of the property.  We don't own the home and can only fix what the homeowner approves. Regards, Marketplace Homes

I contacted a layer and he said that what you did is misleading. I was told we had 2 to 3 years before we had to buy ( with email to prove it ) you get away with this because it will cost me 1000.00 to get the layer and then all I will get back is 250.00. YOU BROKE THE CONTRACT NOT ME. So I should get my 1250.00 back. I will not let this drop. You did wrong.
