[redacted] I do not agree with you stance on this matter.  This truck has cost me a lot of money and as I explained to the various managers I do not have 20% down payment which is $10 000 to fund the engine repair. If the truck had been profitable I would have had the money for sure. The next alternative that you have offered is to have the truck repossessed which will damage my credit.  So again you really did not offer any real solution for my situation.  This unit was terrible from day one.  Freightliner and Daimler truck all made their money and continues to take money for a truck that is not worth what I paid for it. On the 5th of this month I made a $1660 payment for a truck that is sitting in a repair shop just because I do not want Daimler truck financial to ruin my credit.

Although Mercedes Benz representative attempts to justifiy the charge of $7,365.24 in this letter, they still are being less than disingenuous with their responses. MB indicates the charge for the contractual obligation is $24,365.24. What they fail to provide is the breakdown of this number... What are we supposed to accept this number because they are Mercedes Benz? If [redacted] wants a resolution, which at this point is not going to happen, he would be truthful with his responses. Therefore, provide the breakdown of this number.What is most concerning is the $17,000.00 sale of the vehicle? A copy of the bill of sale should be provided, not just [redacted]'s providing in a letter. Oblivious, the attempt is to now justify this trump up charge of $7,365.24. [redacted] mentioned in his letter to contact Mercedes Benz to make plans for payment, this will not happen. It is very unfortunate that MB is now trying to cover this up. In addition, [redacted] indicated his engineers were out of the office until next week, but suddenly they returned to the office on the last day of the year. Clearly, this is suspect and given the inadequate responses and lack of providing information that is truthful. The sections stated in our response do apply. The MB dealer indicated where it was within a six month period, we would only be accountable for the remaining payments due, and I did not need to purchase another vehicle. If MB is truthful they want to resolve this amicably, they would accept the offer in the original correspondence, and move on... In regard to the additional mileage I purchases, [redacted] indicated that the base mileage is 15,000 on a lease. [redacted] may want to review this statement. The mileage allowed on a lease is 10,000. See MB advertisement for leasing a new MB C300. Therefore, we are accepting his statement and trying to justify not providing a refund for the unused mileage.

determined that this does not resolve my dispute.It has come to my knowledge that the truck needs an engine job costing about 50 thousand dollars.  Freightliner is refusing to cover the cost under the warranty.  Daimler truck financial resolution to this issue is doing an engine rewrite for 80% of the cost which will not work  I DONT HAVE THE OTHER 20%.  I asked if they can please roll the total cost of the engine repair on to the the loan and the manager [redacted] said "thats not their policy"; he said "can you obtain a loan for the other 20%" well if I cant get it from the finance company who is financing the truck where else can I get it.  So I guess Daimler truck financial prefers the truck to stay off the road not making any money for anybody that to finance the repairs.  The only solution to this issue is for Daimler Truck Financial to agree to finance 100% of the repairs at a resonable interest rate. I am willing to work 24-7 and pay back the loan and make this work.

I am rejecting this response because: It DOES NOT address the myriad of issues, but instead glosses over  I was, firstly, HARASSED to “give all 10's” by the Hartford, CT New Country Motors once I concluded the lease for second vehicle I took after concluding the first lease.I was called every single day at least twice, and [redacted], who facilitated the lease, was very pushy and aggressive to please complete the survey. With what I now know, I would have given all Zeros, not 10’s. The Dealership left me in the lurch after the survey was concluded and I was abandoned to handle all matters by myself DESPITE having acquired a brand NEW LEASE of a 2017 GLA vehicle. Here is the Solution I would like to see happen: All I received was a letter that indicates safe lease owes $1000 for each incident, but they have not adjusted the amount as should in light of the HARROWING circumstances brought about. 5 months of chasing Mercedes Benz to PAY THEM is sincerely the worst business practice to DATE I've seen. I can understand why [redacted] harassed and urged me REPEATEDLY and calling ME SEVERAL TIMES AT WORK for all 10's on the SURVEY when the second lease was opened. I am interested in the option to Re-negotiate the SECOND LEASE in light of this SHADY BUSINESS PRACTICE at a DIFFERENT MERCEDES DEALERSHIP and/or adjusted lease terms with renewed Lease Payment in light of circumstance explained. I have evidence of repeated EMAILS with $350 as the monthly lease amount for a GLA250 and I'm paying $750!!??I ended the Lease with 3 months left on Nov. 5th and was told the last 3 payments would be "waived" by Cherif and [redacted] at New Country Motors who facilitated the transaction, yet the Final Bill has no such waiver. Bill shows $3065.00 in unpaid lease payments remaining. The Dealership (Mr. Cherif, Manager of Hartford New Country Motors) has suckered their Customers in every way possible and this bait-and-switch method has been a very sore and frustrating resting point. I am in receipt of several emails I've attached advertising the promo allowing me to get into a new Lease 3 months SOONER (as I did), yet I wasn't given anywhere NEAR what the advertised amount was despite my sharing the promotion that Mercedes sent. I am horridly overpaying for the lease AND classically being nickel-and-dimed, as they say. This is a business practice I would expect and look out for, even, from any other small time-y used car dealerships, but NOT Mercedes. They have truly disappointed in EVERY WAY. I've attached the Promotional Emails I have received to get into a new lease.

MBFS regrets to learn the confusion surrounding the end of [redacted]e's payoff process.  We are committed to conduct a thorough investigation and can confirm the information provided is accurate.  In regards to the difference in the payoff amounts (original payoff $54,500.10 / second...

payoff $53,631.88) this is due the monthly payment being due on December 13, 2015.  MBFS attempted to collect the missing document (odometer statement) from the dealership on several occasions in order to complete the payoff and close the account.  Due to this delay and to prevent [redacted]e from delinquency on his December payment, MBFS applied 12/13 payment towards his account from the payoff amount.  This was to the customer's benefit and MBFS honored the original quote.  In regards to the maintenance refund, although MBFS cannot respond on behalf of any warranty providers, we contacted MBUSA on behalf of [redacted]e.  MBUSA informed the customer would need to initiate the cancellation at the dealership where the maintenance was purchased (Mercedes-Benz of Pleasanton).  Based on the information above, we respectfully decline the request to refund the amount of $868.22 and suggest [redacted]e contacts Mercedes-Benz of Pleasanton for the cancellation of the warranty  We will share the information to our Dealer Relationships Manager regarding his experience at both Walnut Creek and Pleasanton stores.  Please feel free to contact me directly if you should have any questions or concerns.

Since we are not present at the time of sale, we must accept all signed contracts as being read, understood, and agreed to by the customer upon execution. I am rejecting this response because: Once again they are not addressing the issue.  I voluntarily surrendered the car at the direction of a MBZ Financial representative who signed a document stating the amount I owed.  I have several unsigned documents that they provided where they say I owe substantially more. I have never asked for "financial relief", only to pay the amount that I was told I owed.  MBZ Financial has changed their story so many times since the first correspondence, it is scary. Note that they want me to only contact the law firm at the bottom of their letter.  They have actually filed a lawsuit against me that is factually baseless.  To make matters worse, the contract specifically states in section 37 that any dispute will be handled through arbitration, not a lawsuit!  They are again not following the terms of their own document! I am truly disgusted with MBZ Financial!

Please be aware that MBFS is an indirect lender, which means we purchase contracts that fit our credit and program criteria from independently owned and operated dealerships.  As an indirect lender, MBFS is not present at the time of sale and we must accept all signed contracts as being read, understood, and agreed to by the lessee upon execution.Regarding your claim that you were overcharged by 50% with a higher down payment and higher monthly payments than the average market rate, consumers are encouraged to  shop for  rates  and  contract terms that are acceptable to them. With your signature on the MVLA, we can only assume the contract terms were acceptable to you at the time you executed the agreement on June 20, 2013.Regarding your claim that equity was not disclosed at lease termination, please note this vehicle was leased. You have no equity in the vehicle. With a lease, you rent the vehicle for a specified amount of time with the option to either return or purchase the vehicle at the end of the agreed upon term.Regarding your claim that you paid nearly $30,000 during the 27 months you had the lease, when it was supposed to be $30,000 over 36 months, please read section 4 of the  MVLA; which discloses you will have paid a total of $32,704.20 by the end of the 36 month term.

The lease renewed with the new owner without my permission ( with my name on it). I am not responsible for my name on lease in the RMV. Also the refund is not being provided to me even the new owner is ok with it.
