misstated income, and was qualified for $500,The customer selected a home with a base price of $479,990, and selected a premium lot ($22,000)The customer then attended an initial design center appointment, however did not finalize selectionsThe customer optioned above their loan amount, then did not accept placing more down payment toward their purchaseWe extended the final design selection sign-off several times, delaying the start of the homeThe customer was always allowed to rebase their options, however approached Meritage with offering further discounts, which was refusedAfter failing to complete the contract requirement to finalize selections, and with continued delays in starting the home, we had no alternative but to default. The customer was unable to qualify for the loan amount required or provide sufficient cash to make up the difference; therefore we did cancel the contract in accordance with the purchase agreement and retain the earnest deposit We were looking forward to building Ms*** a new home Best regards, Meritage Homes Corporation

We allow homeowners to submit request for service when it is convenient for them within these guidelinesThe complainant can have a representative present during repairs if they are unable to be home due to their work schedule. To my knowledge I did respond to this request and we did meet with the homeowner on February 1st at 3pm with the window manufactureFurther, we did agree to adjust some windowsWe did deny the drainage claim as it is the result of the neighbors, they have been watering their yard 3x a day causing the overflow of water to the complainants yard. I believe this may be a case where I did not see this claim on my portal after our initial response Sometimes that happens and is a technical error that I have no control over. For your reference, details of the offer I reviewed appear below.?Dear ***,I tried to send my response through the Revdex.com website but the message had errors so I will resend to your email.I reject the response from Meritage Homes:I reject the response from Meritage Homes because it shows that they are still not compromising and have some of their facts wrong regarding our disputeMeritage Homes refuses to refund any of our earnest money in light of misrepresentation and construction issues on their partTheir idea of compromising is to force us to buy another home from them in the form of a credit and refusing any form of earnest money refund which is what we are seeking.First of all, Meritage was only willing to change the tiny windows in the front of the house but not willing to make any changes to the uneven brick (shoddy workmanship) or tacky design of the front elevation which we brought to their attention as a big problemIn doing a retrofit of the windows, we still had concerns about whether it would even look right as an after thought repair due to the design of the house with the bathrooms in the front.Secondly, our attorney, *** ***, never agreed that Meritage's offer was "fair and beyond courteous and recommended that his client accept one our our three offers." He is a real estate attorney and advised us that we have legal recourse to litigate against Meritage Homes if we choose to not accept their credit optionMy husband and I would prefer to not enter into litigation and try to resolve our dispute in a more amicable way if possibleI expressed this to *** *** in my email when I requested that they meet us halfway and return 50% of our $10,earnest money but she shot that idea down immediatelyI spoke to my attorney yesterday and he is quite disappointed in how Meritage is handling our dispute and advised one of his other clients to not buy a home from Meritage Homes as a result of how we have been treatedMeritage knows that they have been pressuring us to buy a home from them despite our issues with them and even gave us a deadline at the end of the month to sign a new contract or else they would not honor the original pricing promise. In my original letter to Meritage requesting to cancel our contract, I expressed our concerns regarding the workmanship and misrepresentation of the design of the front elevation of our home as well as our concern about my husband's employment situation due to the drop in oil marketI never said that he has lost his job yet, I just mentioned it as a concern in addition to the construction and design issues*** *** responded that it would be our tough luck if he lost his job and there would be no refund of earnest moneyMy husband luckily got a promotion instead of a furlough recently but now we know that Meritage would sadly not be of any help if he had lost his jobOur realtor has even advised us to not buy a home from Meritage in light of how they have treated us in this dispute.We are only cancelling a second contract with Meritage Homes because they refused to return any of our earnest money thereby pressuring us to buy a new home from themUnder pressure, we were trying to be cooperative in working with them and stay open minded to the idea of selecting a new Meritage home and transferring our credit but we cannot find the right home for us because Meritage has such limited inventory of home sites and options in ***The new saleslady felt bad for us that we were being forced to "fit a square into a circle" and reluctantly going to pay over $400,for a home that we really did not wantWe don't even trust Meritage Homes to build our house properly and dread dealing with them if any home issues arise after we close on our home.We have spent countless hours and money in this home buying process and all of its problemsIt has consumed so much of our time in driving to *** from downtown Houston for all the inspections and all the emails in addition to paying for the inspections and our attorney to try to resolve the problemsWe have spent so much time trying to search for a new Meritage home because we were sincerely trying to find the right house and use our creditMeritage is holding our willingness to work with them and keep an open mind against us nowWe would not be cancelling a second contract if they had just compromised and given us a partial refund! it is true that one of my multiple reps has left the company, but the issues persisted for the better part of the year before he eventually left the company I have been assigned a new rep who is much better at communicating, but several of our issues remain unresolved There is progress and I am happy about that, but the matter is not resolvedAlso, no one has reached out to me regarding compensation for the excessive water bills etc

For your reference, details of the offer I reviewed appear below.This matter is not resolvedFrom my experience with Meritage Homes so far, I can assure you that customer satisfaction is not a priority, they prefer to deliver quantity homes rather than quality, a advertisement home businessThere are many unresolved issues with the house itself that if I had the time I would send for each single one of them a separate complaint letter, but the presence of the man hole is a major one to meIt was never there, it does not show on the house survey, and after installing French drains it appeared, therefore, I hold Mertage Homes responsible for misleading and providing us with information when they told us that there was no manhole in that specific locationI also hold them accountable for failing to verify locations of the manholes in the area and misleading its clients, because I believe that every resident has the right to be aware of what falls in their front yards, backyards as well as any lot they purchaseAnd YES the manhole was covered by landscaping(Dirt and Grass) when I complained about it, I was told that they will cover it the same way it was before and this should "make me happy" as the manager said! but after couple of days a city crew comes and put a bigger and higher lid! I also declined the offer of flower bed, because it will not cover up the smell from sewer or keep the bugs away, it will attract more bugs! I also understand that we paid extra because the lot premium is based on the square footage, but I would've saved my money and picked a different location if I knew that a sewer hole is covered and Meritage failed to discover and survey it at the time!

[ Meritage representative and two of their concrete guys accepted that concrete needs to replace or rebuild asap, Meritage people from last months telling me that they will rebuild my driveway and sidewalk & now suddenly after follow up by Revdex.com they change their statement & now they are telling me they can do patching and surface coating the driveway onlyI didn't accepted that because I want meritage to rebuild my driveway and sidewalk as they promised]

The response that was submitted does not reflect everything that has occurred. Even though both Meritage and I had to make changes to the contract because of outstanding issue regarding additional options (appliances, extra windows, and larger patio) Meritage charged me the standard $change fee I am not satisfied with that response. I have asked to change the house and keep the same lot. To which the sales staff replied no because they already paid for a permit to build the house. Then I asked if I could pay to change the permit to a different house. The sales staff replied that Meritage does not want to do that. I am not satisfied with that response. The sales staff did inform that I could forfeit a $deposit, forfeit the $bonus for upgrades, choose a different lot, and give another $deposit if I really wanted to build the other house. I am not satisfied with that response. They recently informed that it would cost $to change from a gas stove to and electric stove. I am not satisfied with that response. Since filing the complaint, Meritage has agreed not to charge me for the changes to the front of the house and they also have been more responsive to completing the contracts. Although I am satisfied with that, they act as if they are doing me a favor by clearing up their mistakes. I am not satisfied with that. I am giving in and moving forward with this process because my family needs a homeLike I said before; “To sum this up, if you can get something completed, Meritage Homes Lakeside Preserve community offers nice houses, in a nice location, at a nice price, but the buying experience is miserable.”

The deposit was only a fraction of the issues Meritage's lying to us from the beginning cost us. We lost our lease at a place within walking distance to our daughters school (we would have stayed there until we found a house or waited for them to get FHA approval), we would have had to spend thousands of dollars on hotel for a month, money on moving trucks and storage, not to mention vacation days we had to use to do all of this. Had we been told upfront that they Modena was not FHA approved our story would have turned out a lot different and we would have been in a new home right nowand not have gone through everything we had to go throughMaybe it's just time to look at our legal options

it will fade varies by region and even the color itselfOur robust warranty provides that we will touch up paint one time within the first year As noted within the complaint, Meritage did perform this service.We even as a courtesy painted a second time within the first two years after the complainant closed on his homeWe did inspect the paint to provide assurance to the complainant that his homes paint is not defective, but rather performing as paint doesAt no time did our team agree to perform any additional repairs related to his paint outside of his warrantyDuring the testing process we did cut out a portion of the homes stuccoWe completely take responsibility to make that repair and of course, touch up the paint in that area only. We understand the complainant is selling his home and would like to avoid out of pocket expense, however paint is a homeowner maintenance responsibility as clearly outlined in our new home manual that includes the warrantyThis manual is provided to every Meritage homeowner at the time they purchase a home with us. A digital copy of the manual has been sent to the complainant in the event he has misplaced it or would like to provide to his realtor or the family that purchases his homeOur warranty is transferrable and therefore the manual would be useful to future homeowners No further action, with the exception of the pending stucco repair will be taken in this matter by Meritage Homes Best regards, Meritage Homes Corporation

I am requesting a Legendary representative reply to this complaint to get this resolved. I am also requesting *** or Legendary provide the contact name, address, and phone number of the sub-contractor who did the siding for my house. Can *** also provide legal documentation showing the terms of the acquisition of Legendary Community. I don't feel their response is adequate without the documentation to back their words.
