I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
This is simple. 1) We are requesting the soils test sample results, the structural plans, proof of proper tensioning, and copies of any documents we signed related to our home prior to closing FOR arbitration, and we are asking for your assistance through this complaint process, Revdex.com. We are not being treated with basic consumer respectMeritage is making it very difficult to arrive at a resolution and their accusation of us being at fault for that is downright silly. We have one home, want this resolved, and have fully cooperated every step of the wayMeritage, on the other hand, has many unhappy customers and a history of avoiding customer service. This response appears to be a way of doing just thatAll we are asking for is that paperwork, so that we may proceed with arbitrationAdditionally, there are a few problems with the business's response. A) *** never conducted any inspectionB) We have not refused arbitrators. We were only offered one so far, and as a courtesy to Meritage, we notified *** (the arbitration service) that we have worked with this firm, citing a conflict of interest. Either Meritage does not know the facts or they are trying to smear the customer, and neither one is acceptable business practiceIt is standard for the arbitration service to seek an impartial arbitrator and I have included *** last email in this response for your review. *** *** ***
***,As you know, I have had a problem trying to find an arbitrator for your case. I notified ***a *** at *** of this problem. She told me that she was going to check with you to see if you want to withdraw your request for arbitration with *** * *** *** and try another arbitration service *** *** said she has not heard back from you as to how you wish to proceed. I did have someone who was interested, but was very busy and wasn’t able to get back to me in a timely manner. I could try again, but I can’t make any guaranteesPlease let us know what you would like to do.Thank you, *** *** & *** *** *** *** ***Either way, that is not why we asked for your intervention. As mentioned in the original complaint, these documents are not available from any other entity.

the Builder never resolved this we do not receive any credit for energy that is produced from or solar panels APS just keeps the energy produced since april 2017 APS Hasn't given us any Credit since april No credit for Kilowatts is received do to no one managing solar produced See Attached

Revdex.com, Meritage Homes did meet with the complainant and inspect their shower concerns both before and AFTER they tore it all outPrior to the complainants tearing out their shower, Meritage Homes visually inspected and advised the complainants that the showers grout and caulking
lacked in routine maintenance such as caulking, sealing of the grout and repair of minor grout cracksWe are unaware if the complainants took the necessary action to perform these homeowner repairs we do have photos that show the condition of the shower at that timeWe also inspected AFTER they tore out their showerNo mold was noted, some moisture was similar to that of a recently wet wood, another words exposure was noted as being consistent with a lack of maintenance and not a failure of the showers installationThe shower pan was completely intact with no breaks, gauges or cracks that would lead to the need to tear it out. We do have photos to show the condition of the shower after they tore it out as wellWe stand by our decision that this is not a warrantable matter. Meritage did verbally discuss this matter in detail with the Mrsand sent correspondence to both the Mrand MrsTheir home remaining warranty is structural onlyThis is not a structural matter, Meritage did not tear out the shower and therefore has no warrantable obligation to rebuild itWe do consider this issues resolved Best regards, Meritage Homes Corporation

third party inspection report to the complainant as evidence that Meritage properly flashed his home, reviewed that the intent of the code is to ensure that water does not infiltrate the home and verified that no water had infiltrated his home at the time of his initial complaintRevdex.com we further explained to the complainant that wood and caulking require maintenance and as a homeowner he should perform necessary maintenance as needed to ensure water does not penetrate his homeWe respectfully declined his request that we alter his homes construction. time we delivered the home in Meritage does not warrant the home sites drainage or grading beyond the first year of the original owners ownership.As a courtesy we did pressure wash his walkway and driveway and in both and we made alterations to his home site to slow the flow of water during such heavy rainsMeritage does not have any active construction activity in the community, therefore we reject the complainants claims that our trade partners damaged his driveway We respectfully decline the complainants request as it is not a part of their remaining warranty coverageThe homes remaining warranty is structural in nature and expires in No further action will be taken by Meritage HomesBest regards,Meritage Homes Corporation

The issue as described is not that the item was discontinuedIf the item was discontinued and we were notified within a reasonable time period of days after the design center appointment, that would be acceptableThe issue is that it took months to notify us that it was discontinued during which time we have been purchasing and choosing coordinating materials. There is an expectation for Meritage to do their due diligence after the design center to lock down availability of the product and confirm it within a reasonable timespan, which they failed in this instance

Where I go the impression that the work would NOT be completed was from *** ***, and I have the emails to prove itShe was adamant that my home was no longer under warranty, and told me a couple of different things: The truss in the attic fell under the year warranty, and therefore would NOT be coveredI told her that the truss in the attic is structural in nature and covered under the year structural warrantyShe proceeded to tell me that my home's warranty was EXPIREDI said no, the Home is years oldShe did not respond until I told her I'd have my attorney call herThe last email she sent she accused me on not bothering to check my messages and insisted they called me twiceThey didn't call me, they had the phone number of the previous ownerShe was extremely uninterested in helping me, only interested in being argumentativeI have never in my life filed a report against any business as I've been fortunate up to the point in receiving courteous customer serviceShe treated me as if I was an uniformed iShe really needs some etiquette training in regards to business email responses, as well as warranty training; otherwise, you will continue to receive complaints

Meritage Homes did in fact share timelines and set the proper expectation in regards to the utility commissioning process both verbally and in writingThe commissioning process is outside the control of the builder but rather overseen by the utility
provider themselvesThe expected time to complete the process is business days; however the customer must enter into an agreement directly with their utility company. Therefore the solar system while functional is not connected to the utility provider’s grid until their required paperwork has been completed by the homeowner and after close of escrow
In this particular case, our team communicated with him on a regular basisOur sales associate has answered text messages from him late into the evening and our solar provider spoke with him directly on February 11, the same day he closed escrow On February 23rd, our team reached out to the complainant asking that he remove the lock from his utility panel in order for the utility provider to install the meterIf our team had not called, this matter would have been delayed
The fence the complainant refers to is a common area fence, not the complainant’s personal propertyThe fence was not painted prior as it was not a part of the community scopeThe decision to paint the fence was made in partnership with the community HOA after the complainant closed

I reject Meritage' response because it is obvious that the damage was not caused by the weather conditions or chemicalsAny reasonable person can see thatThe poor workmanship is the root cause and the conditions accelerated the detoriationNone of my neighbors have damage to the same extent as mine yet their concrete is exposed to the same conditionsSeveral contractors have analyzed the pictures and stated to me the detoriation was caused by poorly mixed concrete. Moreover, Dan D*** did not initially inspect the damage but lied and said he didAfter pressing him for details he conceded he did not and then proceeded to my house and conducted a cursory and pefunctory inspection with no meaningful analysisEssentially their mind was made up and their decision was predetermined. in fact, Dan D*** offered me a small sum of $for repairsI declined the offer because it is not sufficient to cover the repair costs and the offer was patronizingI don't want money, I want the damage repaired and Meritage to have some accountability! Meritage DOES not stand by their work! They readily took my money after performing shoddy work and their warranty is crafted in such a way that the homeowner has little or no recourse. What else can I do?
