I am rejecting this response because:
Although I am grateful for the reply, it is not truthfulThe club manager (Sonya) that attempted to process the refund was not able to do so because of the way their software system is set up with National FitnessShe was very helpful and also extremely frustrated with National, but after several phone calls, she was able to process the refund for the feesUnfortunately, not before I was sent to their collections department for non-payment. In addition, throughout this interim, I showed up in their system as inactive and in collections, so each time I went to work out there, I had to explain the situation with the staff member before they would let me inThis was pretty humiliating, since it seemed like National Fitness' error was actually me just not paying my gym bill. Again, I appreciate that the fees were finally waived, but this was not handled very professionallyThe agent (Cetiva) that I spoke to in the collections department, was extremely rude stating "it's not my fault the other agent made an error" and "there is no way for me to remove these fees". My 24-month membership agreement through Crossroads Fitness/National Fitness is finally ending this month and I will never again sign up with a gym that uses National Fitness for their billing.

said, we adhere strictly to the contract that the complainant signedIt is attached hereto for review. Our records show no indication of club delay in service that would be considered a breach of contractMs*** should contact the corporate offices in NC at *** *** *** ** ***, Raleigh, NC This information is also listed on the agreementUnfortunately, because National Fitness hasn't the authority to override the terms of the contract that Ms*** signed with Professional Fitness, we cannot cancel the membership agreement earlyIt is set to expire at the end of the term, 3/5/2016, with 1/5/as the final billingShe should contact us to resolve the account. I first must advise that National Fitness handles administration and billing on contracts initiated by our client, Lady of America, and their members, in this case - Ms***We are in no other way affiliated with Lady of AmericaAdditionally, we are not privy to any conversation had at, or
with any representative of, the clubThis being said, we adhere strictly to the contract that Ms*** signed. According to information provided by our client, the original facility did close, and all memberships were transferred to Anytime FitnessBecause the alternate facility is within miles of the original this is allowable by TX lawHowever the club has advised National Fitness that members may cancel the membership over the phone, and will still have 30+-days to use the new facility for freeNo refunds have been authorized. Because the transfer of memberships is supported by the contract, National Fitness hasn't the authority to override any terms of the agreement, however our client has generously offered cancellation over the phone, outside of contract guidelines, and provided 30-days free, National Fitness cannot authorize any refunds of duesThe membership expires on December and there is no future billing scheduledI trust this explanation helps to resolve the complaint against National Fitness, and apologize for the inconvenience

I am rejecting this response because: Since the client agreed to cancel the contract without a fee and I canceled prior to my billing date of November 8th I should not have been charged the maintenance fee for When I called and talked to Jamie originally in October I was told that if I cancelled before the 8th of November, when my bill generates, there would be no feesAccording to what I was told I should not have been charged the maintenance feeI am willing to pay the monthly fee for October but I should be reimbursed for the gym maintenance fee for in the amount of $29.95.

I first must advise that National Fitness handles administration and billing on contracts initiated by our client, Omni of TN, and their members, in this case MrH***We are in no other way affiliated with Omni of TN or YMCAAdditionally, we are not privy to any conversation had at, or with any
representative of, the clubThis being said, we must adhere strictly to the contract that the complainant signedIt is attached hereto.Our records indicate that Omni of TN did not breach any portion of the contract, or TN State Law, in the closure of facility and transfer to the YMCA facility, as it is within milesThe entire balance is due because of default, as outlined on page oneI am unaware of any certain or special circumstances by which in term members were simply allowed to cancel, unless such cancellation was authorized by Omni of TN or YMCA directly, as National Fitness hasn't the authorization to override the terms of the contract that MrH*** signed. As a courtesy to MrH***, and in an effort to resolve this complaint, I waived 1/of the fees on the accountI trust that this explanation and waiver of fees helps to resolve this complaint against National Fitness as the billing company ONLY, and apologize for any inconvenience that this has caused

I am rejecting this response because:Aside from the supposed non receipt of cancellationTotal fitness has advised me they discontinued thier business relationship with National Fitness in the spring of this year and does not honor memberships from national fitnessI also have made contact with national fitness in the meantimeI understand that national fitness is simply a billing company and request a refund from them of the charges to my account after June when even if not cancelled my membership was no longer honored at the club per total fitness

Upon receiving the information from Ms***, our representative advised that we would set up a follow up for management to reviewOn that same day, 1/19/15, the membership was then deleted by National Fitness, upon investigation, and a $refund was issued to Ms***'s card on file for
the 1/billingThis complaint should be closed, as it was resolved as soon as National Fitness was made aware of the issueI trust this is now resolved

The processing of the original correspondence received in February was not completed through all steps, which resulted in the account billing another monthOnce the error was caught, it was sent to the supervisor of the processor for verification of the error, and to ensure the military orders were
validIt was verified on 4/22, and the refund was requested for processingIt should appear on Ms***'s MC within 5-business days of that date (at the most)It hasn't been a refusal by any means, of refundIt was a human error in the first place, and a "workload" issue during the verification processI trust this confirmation of refund helps to resolve this complaint against National Fitness, and very much apologize for the delay and inconvenience
