technical details of the closure, and the terms in the contract, National Fitness is not aware of any further closures. Cancellation was received on September 28, 2015, leaving, per the Renewal Terms, that as the final billing. The membership expires on Oct 28, 2015. For further complaints regarding closure and billing, the complainant should address these with management at the Alpharetta location, 11105 STATE BRIDGE ROAD, or the Revdex.com serving the local area. I trust this explanation helps to resolve this complaint against National Fitness as the billing company only, and that Ms. [redacted] will contact us to resolve the accounts. I apologize for the confusion.

I reviewed Ms. C[redacted]'s response with our club rep and our clients. We have verified numerous times that Grit classes are offered at PerforMax, are NOT a part of the normal club dues, and that the same trainers are available as were at Crossroads. There is no difference in the pricing. All of this was verified with management at PerforMax. Further complaints should be addressed with the club, as these changes are all supported by the contracts that were signed by Ms. C[redacted]. I apologize for the inconvenience, but National Fitness hasn't the authority to override the terms of the contracts signed by the complainant.

I have reviewed the cancellation, and confirmed it. Also issued is a refund for the 10/1/2015 $19.00 charge. Ms. [redacted] should see the refund on her card within 5-7 business days. I apologize for the delay, and trust this resolves this complaint against National Fitness as the billing company only.

This being said, we adhere strictly to the contracts that were signed by the F[redacted]. The Buyer's Rights section on page two complies fully with UT State Regulations. The club honoring the membership is located within 4.6 miles. The 5 mile requirement is that of the State of UT. Unfortunately because our client has complied with the contracts and UT state regulations, we do not have the authority to override the terms of the agreement that they signed. One is attached hereto for clarification. Additionally, the complainant noted 4 accounts, though I was only able to locate accounts for Sam and Josie. Either account numbers or names would be helpful so that I can set them to expire at the end of term - March 2016.I trust this explanation helps to resolve this complaint against National Fitness as the billing company ONLY, and apologize for any inconvenience that this has caused.

It is attached hereto for review. Cancellation was received on June 9, 2015, electronically through our website. Per the renewal terms on page one, this left the July 7, 2015 dues as the final, and Ms. S[redacted] has full access to the facility until August 7, 2015. National Fitness hasn't the authority to override the terms of the contract that she signed. I have reviewed the complaint with the department supervisor over which the representatives with whom Ms. S[redacted] spoke are employed. This being said, we must adhere strictly to the contract that Ms. [redacted] signed. The verification of disability form initially received did not include a duration. Because Ms. [redacted] signed a contract for a 2 year commitment, it must be verified as a permanent disability, or one that outlasts the term. We advised her of that requirement, and she had her doctor revise the form to include a duration of one year from the onset of December 2014. Per the contract terms, this would be a "hold", which would give her that much time free at the end. SFF did change the procedure to cancel with the honoring club, Infinity., she was referred there. As a courtesy, they have authorized the deletion of the account with no further billing. Because there has been no valid Cancellation documents received, there is no refund that National Fitness can authorize, and we were not advised to provide one. Further demands or requests for refund should be referred to the club, as National Fitness hasn't the authority to override the terms of the agreement that Ms. [redacted] signed. I trust the deletion of the account with no further billing, as authorized by our client, resolves this complaint against National Fitness as the billing company, and apologize for any inconvenience that this has caused.

I would be happy to investigate, for the sake of refund, Mr. [redacted]'s claim of prior cancellation, upon receipt of proof thereof. Such proof would include printout of website submission, fax transmittal confirmation, or certified return receipt from USPS. As a courtesy, I set the account to expire...

I have requested an investigation into the situation, and whether Anytime Fitness is receiving funds from Lady of America, and honor members. In the meantime, I have deleted this account with no balance due, and it will remain deleted given that no further disputed dues are received from Ms....

Complaint: Since I am not sure who I am corresponding with, want to make sure the whole issue is resolved before closing out. Thank you for removing all of the collection part; I am so glad that is finally done. After dealing with this for 5 months with hours spent on phone calls and emails, I just want to make sure everything is addressed in full. I would like to confirm which gym my daughter and I still have access to with full amenities including classes, bringing friends, and childcare. I am inquiring here because NFS is who collected a yearly fee (that was also a surprise but I paid it) and I just got a notice that my membership was being transferred. I would also like to confirm who my contact will be to use my 33 paid for personal training sessions without issue.  I am in zip code 32217.

I received the proof of cancellation, and have processed it. I deleted the account with no balance and no payment due. I appreciate the cooperation, and apologize for the inconvenience. I trust this issue is now resolved.

I am rejecting this response because: I was ultimately forced to sign the 60 day paper in order to cancel. I disputed this at the time of signing, in my original contract it never stated I needed a 60 day notice or to pay any other cancellation fees. However, I was told this was the ONLY way I could cancel my contract, this was after sending in a letter AND calling, in which this was not mentioned on the phone. Unfortunately it took me well over a month to find the time to get to the gym while somebody was actually working. I planned on disputing this with my credit card company and a copy of my contract, however after there was zero push back from Kinetix or National Fitness about my credit card dispute, I was under the impression the matter was resolved. You offer essentially is taking back a bogus charge. Even two months after cancellation at 10/28/15, that puts the end date at 12/28/15. The Annual Fee would post at 1/1/16. As we can both see, that charge should of never posted, even under your guidelines. As mentioned before, I would like all charges and fees cleared. I had not used the gym in the two months before cancelling, or after, and no where does the original contract state I need to pay cancellation fees or an extra sixty days. I was forced to sign a cancellation contract that was against the original contract guidelines. I would like this to be a simple a civil resolution and move on from this. However, if your company is unwilling to corporate, I will file a small claims case against National Fitness and Kinetix, as well as share my experience with as many outlets as I can. A quick google search brings up many people extremely dissatisfied with your company and the deceptive business practices conducted. As stated before, I would like this to be a simple resolution, and I would not like to go pursue those avenues. I look forward to your response and hope this matter can be resolved between us.

Both are attached hereto. The memberships are in the renewal period, which bills annually. Because the club has not breached the contract or TN state law, and National Fitness hasn't the authority to override the terms of the contracts, the memberships have been set to expire April 27, 2016 - at the end of the renewal term, with their cancellation requests. They have full access to the YMCA facilities until that date. I trust this explanation helps to resolve the complaint against National Fitness as the billing company ONLY, and apologize for any inconvenience or confusion as we follow the terms of the agreements.

We have no indication from our client that this membership and balance is not valid, nor have they contacted us to authorize cancellation. The membership expired based upon the membership default, and the balance is final. Members who were on a month to month agreement, or who were in the renewal period are allowed to cancel with a 30-day agreement, per contract terms. Ms. D[redacted] is in term until December 2015.The contract, and TN regulations, both state that the contract may be canceled if the health club closes and fails to offer an alternate facility within 15 miles. The YMCA, where all memberships are being honored, is located within 2 miles. This fully complies with the contract terms. Because National Fitness hasn't the authority to override the terms of the contract, it has not been canceled. Ms. D[redacted] was sent an offer to resolve the account via email yesterday, we would be happy to follow our client's guidelines in negotiation of payment on the full balance of the account. I trust this explanation resolves the complaint against National Fitness as the billing company, and apologize for any confusion or inconvenience that this has caused.
