Problem: This is my 2nd complaint. The 1st one was never resolved .For 7 months it PNC Mortgage refuse e my mortgage payments. I constantly called atleast once a month to see if My modifications...

processed they would still say they are working on it . I did not sign my last document with my modification documents until late September early October. Each time I spoke with someone they told me that I didn't owe that amount they were saying and their will be matainence done on my account. On several occasions I have contacted people. I now have sale date for April 3. They want mepay all the back money includ9ng attny fees for there mistake. There audtior messed up the numbers on the final modification they took my 1st payment in December and then stopped say9ng that the couldn't because the numbers were wrong. Now because it took them.u til October to get all the documents corrected they want to hit me with a bill of almost 130000, Because now I am be requested to the reinstatement of the loan they wrote up incorrectly and atrorney fees. I was told that I had an advocate nothing came with that. I have been told many things and my son is hanocapp I am making the home handicap accessible for him... to now not have a home on something that PNC messed up on! I make good money to pay my mortgage for 2017. But can not afford all the attorney fees too, nor do I feel it's fair to ask me to pay that when it was there mistake. I have made several complaints. And everytime someone states they will call me back have not received a call back. The one call 8ndid rec8ve back I call her 10 mins later (MS. HERNANDEZ) ABOUT 3 WEEKS AGO AND HAVE CALLED AND LEFT MESSGARS AND STILL HAVE NOT RECIEVED A CALL BACK YET. EMAILS WERE SENT TO HER SUPERVISOR AND HER SUPERVISOR SUPERVISOR... STILL NOTHING 3 WEEKS LATER. UNACCEPTABLEPay the 7200.00 and all legal fees and late fees dropped as it is not my fault that continue customer service rep and loss mitigation reps told me the wrong information consistently. I would like to pay my 1 year of rent for 2016 along with 3 month for 2018 by April 1. But I should not be responsble for any attorney fees or late fees. So I can have my mortgage and home back. I would a letter regarding my delinquency as my payments were refused month after month.

I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.April 12, 2016We absolutely reject and dispute PNCs response.They continue to tell us that our appraisal is not satisfactory to PNC.As we have stated and included documentation to prove, our appraisal was conducted by a [redacted] State licensed appraiser and in addition our appraisal was an FHA appraisal which as everyone knows, including PNC, is a much more detailed and thorough appraisal process. Furthermore, we have NEVER signed ANY contract with PNC mortgage. Our original mortgage was with [redacted] mortgage. PNC bought our mortgage from [redacted]. I have included (page 2 attachment) our original signed contract with [redacted] mortgage.We were told that as soon as the value of our property reached the required amount our PMI would be automatically terminated. This is exactly how we understood the contract.Since we never signed anything with PNC, how can they now say we don’t meet “their” requirements? If that was the case they could say any absurd thing they want to about any part of our mortgage.In addition I have included (page one attachment) a letter from PNC with states “we may request an appraisal through PNC mortgage”. It does not say we are “required to” it says “may”.PNC can and should accept our appraisal. PNC has the ability to simply include our appraiser in their so called “approved appraisers” list. Why can’t they do that? Why won’t they do that?This is absolutely ridiculous…anybody…any realtor, any assessor, any banker… anybody with a computer can confirm that our property’s value has reached the required 80% home to loan-to-value ratio.This is not the intent of the The Homeowners Protection Act. I am prepared to take legal action against PNC. I will let the court decide whether or not the intent of the The Homeowners Protection Act  is to make the homeowner jump through hoops of fire and spend thousands of dollars in order to stop being overcharged for useless and illegal PMI.Below is an excerpt from the Board of Governors of the Federal Reserve:The Homeowners Protection Act of 1998 (the Act) was signed into law on July 29, 1998, and became effective on July 29, 1999. The Act, also known as the “PMI Cancellation Act,” addresses homeowners’ difficulties in canceling private mortgage insurance (PMI) 1 coverage. It establishes provisions for canceling and terminating PMI, establishes disclosure and notification requirements, and requires the return of unearned premiums. Excessive PMI coverage provides little extra protection for a lender and does not benefit the borrower. In some instances, homeowners have experienced problems in canceling PMI. At other times, lenders may have agreed to terminate coverage when the borrower’s equity reached 20 percent, but the policies and procedures used for canceling or terminating PMI coverage varied widely among lenders.I believe PNC is in violation of The Homeowners Protection Act of 1998. I believe they are required to, and in fact a long time ago they were required to automatically terminate our PMI. I believe they can, but refuse to accept our appraisal.Regards,[redacted]
