We have spoken to Mr. [redacted] previously.  A member of our management team acknowledged that we were speaking to the wrong [redacted], and informed him that we would remove the incorrect information.  We have done so.  This should be considered our statement in writing, stating that...

Thank you for your inquiry.  We did call and speak with the consumer regarding the account.  She advised that she had [redacted] coverage for the account.  We have not yet received the notification of eligibility paperwork from the consumer, so the account has been placed on hold and...

marked for credit report deletion with all three bureaus.  The deletion confirmation is [redacted]. She called a couplemonths later stating it was someone pretending to be her and she never spoke with us. Thank you, I am not clear from the notes who was to send the EOB to us.   However, the resolution is that the dispute has been sent to both the client and the physician office that bills and applies payments to decide whether to pull the account or apply an adjustment, etc.  This has already been completed, we are just waiting on their determination as to how the account should be handled.  You will be notified of their resolution promptly once received. Kimberly E[redacted]Phoenix Financial Services LLC

Services to provide validation of this debt and have failed to respond and provide such documents in accordance with Fair Debt Collection Practices Act (FDCPA). I have attached a statement that Phoenix Financial Services dated March 2, 2017 of a balance I owe with a discounted settlement but have failed to provide such documents to validate this debt to me. This debt doesn't belong to me and under the FDCPA, Phoenix Financial Services had failed to provide documents and I am requesting they remove this collection to all 3 credit reporting agencies (TransUnion, Experian, Equifax) I have attached the document I received from Phoenix Financial Services dated after I made this complaint. This account was deleted from my credit report with another collection agency, Phoenix did buy this debt as the original creditor sold to them.  Medical information is protected under the HIPPA law, how are you able to verify when you do not have the right to medical records. Also the debt is not [redacted] DEBT Delete from my report or I will be contacting my lawyer!! This hindered my closing date for my home that I worked hard to get. YOU ARE IN VIOLATION!!!

1/8/15.  I sent the complaint to the creditor to review for prior agency disputes or requests.
In response to this complaint, I have requested a statement be sent from the creditor for the consumer's review.  I have also placed the account in a cease communication status with no further communications from this agency.

The verification of debt was received from the creditor on 8/7/2017.  It was mailed to the consumer on that same date.  It was mailed to the address that consumer has provided.  Information has been provided to the creditor and this account has been determined eligible to remain open in our offices.  We look forward to communicating with consumer in an effort to reach resolution on this account.
