A Credit Specialist attempted to reach Whitney Stapp 9/14/2016 via phone. A message and phone number were left for Whitney to return the call; as additional information was needed to investigate her concern. As soon as information is received we will review further. Montgomery Ward

Mr. [redacted]'s rebuttal does not appear to address the points raised in Seventh Avenue's previous response. To reiterate: Mr. [redacted] does not have a credit account with Seventh Avenue, nor was he pre-screened for a credit offer. Mr. [redacted]'s request for credit was not granted due to a lack of information from the consumer reporting agencies regarding his creditworthiness.

The merchant states they never approved the order.As mentioned in the complaint, I was informed verbally by their CSR that it was originally cancelled by Midnight Velvet due to a system error.This was never cancelled by myself contrary to the their statement. Can they produce evidence I cancelled?Furthermore, when I called after not receiving my order and learned of the order status I asked the CSR to reinstate it she did and then emailed me confirming credit approval. (See attached)A demand is made for a thorough explanation by the business why they have given me outright blatantly contradicting information and misreprented a prior approval.A cal back from an exective in their office is requested M-F after 1 pm CT.

Why is your company not reporting out the last 5 years  of payment history on my account, and just 3 months of it. this is false credit reporting and I am getting other asgencyies involved remove the account or report out the last 5 years of my perfect payment history.

The section of the Fair Debt Collection Practices Act Ms. [redacted] refers to governs the activities of third party debt collectors - Monroe & Main is the original creditor and the issuer of Ms. [redacted]'s account. Monroe & Main provided Ms. [redacted] with verification of her debt every...

month from February of 2012 through July of 2013 in the form of monthly billing statements. Monroe & Main has no record of a dispute from Ms. [redacted] during the time the account was open and active. More to the point, Ms. [redacted] made multiple payments on her account while it was open, signifying her acceptance of the account balance as accurate and correct. Finally, Monroe & Main has responded to the automated disputes Ms. [redacted] has filed with the various credit reporting agencies in accordance with the requirements of the Fair Credit Reporting Act. It is Monroe & Main's position that Ms. [redacted] is the owner of the account and that she is responsible for payment of the balance.

Ginny's has removed Ms. [redacted] from its mailing list in accordance with her request. Please also note that Ginny's did not obtain a copy of Ms. [redacted] consumer credit report. nor has it furnished any information regarding the account to the consumer reporting agencies. As a result, this matter...

has had no impact on Ms. [redacted] credit score. Ms. [redacted] request for credit was denied when Ginny's initial processing revealed a previously charged off account with a related company.

Ms.[redacted] has established accounts with Swiss Colony affiliates Ginny's and Montgomery Ward. Ms. [redacted] placed an order with Ginny's in July that exceeded her available credit limit. Ginny's requested a copy of her consumer credit report to determine if additional credit could be extended to her. In...

response, Ginny's received the following:FRAUD VICTIM EXTENDED FRAUD ALERT: ACTION MAY BE REQUIRED UNDER FCRAGinny's informed Ms. [redacted] by mail that additional credit could not be extended unless she contacted the company regarding the order. Ms. [redacted] placed also an order with Montgomery Ward in July and received the same message. There is no indication Ms. [redacted] contacted either company to resolve the fraud alert. When Ms. [redacted] placed orders with Swiss Colony in December, the fraud alert remained in effect and she received the same message she had received previously. The letter specifically asks that she personally contact the company to resolve the consumer alert so that her order can be released. Ms. [redacted] did not contact Swiss Colony and the orders have not been released. Ms. [redacted]'s accounts have been closed in accordance with her request.

I went ahead and paid this debt even though I disagree that is belongs to me. I would like it removed from my credit report completely.

Seventh Avenue has credited the account to remove two late payment fees and associated finance charges as a courtesy to Mr./Ms. Sanders. The account now has a zero balance. Seventh Avenue's records indicate all payments made on a card ending in 2731 were refused beginning on September 5, 2015....

Payments made on other cards were accepted and posted to the account. Seventh Avenue notes that these were internet payments, made without intervention by any agent or representative of Seventh Avenue. Payments made online are submitted for processing automatically at or shortly after 5:00 p.m. each business day.

My name at the time was [redacted].  I have faxed documentation to them four times. The accounts were with Monroe & Main and Seventh Avenue.  Colony Brands is the parent corporation for those entities.   I spoke with yet another  person, [redacted] who served as the go-between for a Ms [redacted] (At Monroe & Main) and was told flat out, they would NOT be correcting this.  That it was reported correctly and I should contact the credit bureaus.  The credit bureaus cannot place information on your credit report unless a creditor advises or instructs them to do so.   When I asked to speak with Ms [redacted], conveniently, she had left for the day.  I asked that she call me today and no call has been made.  The documentation clearly shows their reporting error and violation of bankruptcy discharge injunction.  They have no intention of clearing this up.  I then investigated on my own and was able to reach the General Counsel for Colony Brands, who I had also sent a complete packet of documentation to, and just in our conversation, he agreed that the delinquencies should not have been reported.   This is not settled and I risk losing the loan approval for my home because of their years of inaccurate reporting.  This company is in violation of Federal Bankruptcy Law and The Fair Credit Reporting Act for failing to correct information that is in error.

Monroe and Main has also verified that the collection agency handling her account has the correct address on its file.

Mr. [redacted] order history indicates he placed an order with Midnight Velvet in December of 2013 that was shipped to a gift recipient. Midnight Velvet has no record of receiving a return on the order, nor does Midnight Velvet have a record of speaking with Mr. [redacted] about an anticipated return or...
