Ms. [redacted] placed also an order with Montgomery Ward in July and received the same message. There is no indication Ms. [redacted] contacted either company to resolve the fraud alert. When Ms. [redacted] placed orders with Swiss Colony in December, the fraud alert remained in effect and she received the same message she had received previously. The letter specifically asks that she personally contact the company to resolve the consumer alert so that her order can be released. Ms. [redacted] did not contact Swiss Colony and the orders have not been released. Ms. [redacted]'s accounts have been closed in accordance with her request.

To reiterate: Mr. [redacted] does not have a credit account with Seventh Avenue, nor was he pre-screened for a credit offer. Mr. [redacted]'s request for credit was not granted due to a lack of information from the consumer reporting agencies regarding his creditworthiness.

call has been reviewed and we believe the call was disconnected due to a malfunction. We apologize for any inconvenience experienced as a result.
Our guarantee, which can be found on the back of the center order form as well as on our website, states: “If any item, for any reason, does not meet your expectations, just return it to us within 60 days. Simply tell us your preference, and we'll gladly refund your merchandise amount, credit your account or issue a replacement. If your item is damaged, contact us at 800-727-9496.” Shipping and processing is not automatically credited which is a common practice in the catalog industry when a customer returns an item because it did not fit, was not as expected, or the customer changed his or her mind. More importantly, the same provision is included in the terms and conditions disclosed to Ms. [redacted] online when she placed her second order on July 30, 2016. Consumer's are required to agree to the terms and conditions of the account in order to complete their transaction using a Seventh Avenue credit account. Thus, Ms. [redacted] consented to the credit inquiry.
Finally, the Fair Credit Reporting Act allows a creditor to request a consumer credit report for the purpose of opening, maintaining or collecting on a credit account. Even without the specific consent, Seventh Avenue had a permissible purpose for requesting a consumer credit report in conjunction with Ms. [redacted]' request for an extension of credit.
