Ashro is puzzled by a number of aspects of Ms [redacted] accountMs [redacted] did not provide a credit card number when she placed her order on August 23, Ashro sent the first account statement to Ms [redacted] on August 27, Finance charges were not assessed on the account, however, until the next closing, on September 28, Ms [redacted] could have called and used her Visa card to pay the entire balance on her Ashro account at any time before September 28, and been charged $in finance chargesInstead Ms [redacted] waited until November 23, to make a payment on her account – three months after the account was opened and more than a month after the replacement dress was shipped to her home Ms [redacted] was clearly aware of the account before November of 2015, as she state in a telephone conversation on October 14, that she would “check what she ordered before making a payment.” Ashro spoke with Ms [redacted] again on November 10, November of and January of In all, Ashro spoke with Ms [redacted] on five separate occasions before she decided in February of that she had intended to pay for this order with her Visa card In the interest of resolving this complaint - and solely in the interest of resolving this complaint – Ashro has credited MsMartin’s account for the late fees and finance charges assessed since she made the one payment on her accountThese adjustments will appear on her next monthly billing statementMs [redacted] may then either pay the remaining balance in full or pay the account in accordance with the terms and conditions of the account agreement, including the assessment of finance charges and late fees

Someone who has obtained Ms [redacted] personal information has used it on two occasions to attempt to open an account in her name with Montgomery WardMontgomery Ward does not have the ability to prevent this person from visiting its web site, entering Ms [redacted] information and using it to place an orderWard's does have the ability to prevent an account from being opened when such an attempt is madeIt is worth noting that neither attempt resulted in the shipment of merchandise or the opening of an account in Ms [redacted] nameFinally, the individual placing these orders is not using information obtained from Montgomery Ward, he or she is using information they already have to attempt to open an account in Ms [redacted] nameRemoving the information regarding previous attempts will not prevent the individual from making another attemptMore to the point, information from the first attempt helped to identify the second attempt as fraudulent more quickly

A request to delete the inquiry was sent to the consumer reporting agencies on 9/18/Please note that this is a request - Home at five does not have the ability to compel the agency to the comply

On June 20, an identity theft affidavit was mailed to Ms [redacted] attention at: [redacted] Montgomery Ward looks forward to receiving the completed affidavit and working with Ms [redacted] to resolve this issue

I will point out that the last name on the complaint is ***, not [redacted] The account at issue was coded as fraud on July 13, upon receipt of a dispute filed with ExperianThe deletion was confirmed in response to a second dispute received from Transunion on July 25,

Montgomery Ward has not prescreened Mr [redacted] for the purpose of extending an offer of creditMr [redacted] does not currently have a pre-approved credit limit with Montgomery WardAny order Mr [redacted] might place is subject to credit approval on an individual basisHe can check the status of an order at Wards.com

Seventh Avenue is unable to locate an account in Ms [redacted] 's name at the address she providedSeventh Avenue requests additional information from Ms [redacted] to allow it to locate the account at issue, which may include the full or partial account number, previous addresses and/or previous names

The disclosures included in the catalog sent to Ms [redacted] in the spring of included the following: TERMS: Your ability to obtain a credit account (“Account”) is conditioned on your meeting certain creditworthiness requirements that we have established for the AccountYou authorize us to obtain a consumer report on youWe may not provide an Account to you, or we may limit the amount of credit initially available to you, if you do not meet our creditworthiness requirementsAccount not available if we cannot verify information about you or if you cannot enter into a binding contract More importantly, the same provision is included in the terms and conditions disclosed to Ms [redacted] online when she placed her second order on July 30, Consumer's are required to agree to the terms and conditions of the account in order to complete their transaction using a Seventh Avenue credit accountThus, Ms [redacted] consented to the credit inquiry Finally, the Fair Credit Reporting Act allows a creditor to request a consumer credit report for the purpose of opening, maintaining or collecting on a credit accountEven without the specific consent, Seventh Avenue had a permissible purpose for requesting a consumer credit report in conjunction with Ms [redacted] ' request for an extension of credit
