I don't fully agree with the statement because in Nov during the Thanks Giving promotion I was told to get free lines not just once or twice but many timesRegardless of what plan I had, they always told me I will get free lines and my bill wont change from $including taxes. Then the second promotion came in March in which I again wanted to avail the promotion for more free lineI asked the customer service and added another line on my account for freeSo I total free lines I have on the account according to what I was always told rates for the plan was$for lines +$for each new added lineThose numbers are; *** * *** * *** * ***Plus free lines and $for unlimited internet on line ending in 9895so my total bills comes up to $135+taxesSecondly, I received call in Feb to upgrade my plan to all unlimited line for the same rate plan and made sure my bill will not go up at all and it will stay same at $for lines including taxesBefore changing the plan I made sure of this many many many times because I wouldn't have made changes if my rate plan will go up even $I can provide some dates so you can go back and hear the call records for march 4th and March 7th and on March 10thI was told over and over again that my rate plan will not change at all and the bill I received in April and for may was for $and $340M third concern is upgrading my phones to Iphoneon the store I was told that you will have to pay an upfront fee and then each month I will be charged $till months. But in my March and April bill I was charged $$and $for my devices and the person I spoke to was saying I will have to make more payments for the same amounts. I was told $will be charged for each device but now these $payment will make $in total for each device. Complaint: ***

Complaint: ***Please receive my greetings,
I am rejecting this response because: The FCC doesn't make any distinction in regards of the status of the account in their policies which are ruling law in this matter and on the other hand they are very clear when they say that "the old carrier may not delay or refuse to port a number even if that individual owes money for an outstanding balance or termination fee" (Please see https://www.fcc.gov/general/wireless-local-number-portability-wlnp#earlyfee for more information)I'm aware that T-Mobile have their own policies to deal with this kind of situations, however the Federal Communications Commission which is the governing entity in this matter dictate that there's no reason on "outstanding balance" to deny or delay the porting.I'm committed to honor my debt with T-Mobile as soon as I possible but that doesn't represent an obstacle for T-Mobile to release the numbers to my new carrier in anyway.I'll really appreciate if T-Mobile have the courtesy of release my numbers to porting and in that order I will gladly take back the claim I filed in the FCC. I hope we can find a way to work this out and I'm grateful that the company at least have my numbers on hold waiting for payment but I don't have have amount of money I owed them to pay them currently and believe me, I tried to get it in anyway possible. Sincerely,

in receipt of your correspondence dated December 9, 2016, regarding the above-referenced accountT-Mobile regrets any concerns to Ms*** with regards to her T-Mobile billOn November 5, 2016, T-Mobile issued a billing statement with the due date of November 25, 2016, in the amount of $which included Equipment Installment Plan (“EIP”) charges, monthly access charges, taxes and fees from November 5, 2016, to December 4, On November 22, 2016, Ms*** opted to pay off the remaining balance of her handset EIP on My T-Mobile.com and as such she remitted a payment in the amount of $In order to avoid billing confusion, it is important to note that when a handset EIP is paid off online, T-Mobile recommends that the account balance be at zero because the remaining EIP handset payoff balance is charged on the very next bill and any payment that is remitted that day, will go towards any balance that is dueAccordingly, as Ms*** remitted a payment in the amount of $256.77, and did not remit a payment for the balance of $prior to paying off her handset EIP, her balance was updated to a credit balance of $and the balance of $carried over to her next billing statementOn December 5, 2016, T-Mobile issued a billing statement with the due date of December 25, 2016, in the amount of $which included the carried over balance in the amount of $and monthly access charges, taxes and fees from December 5, 2016, to January 4, in the amount of $In an effort to amicably resolve this matter, T-Mobile has processed a bill credit in the amount of $98.10, updating Ms***’s balance with the due date of December 25, 2016, to $Based on the foregoing, we respectfully request that this complaint against T-Mobile be closedThank you for bringing this matter to our attentionShould you have any further questions, please feel free to contact me at 877-290-ext***Very truly yours, T-MOBILE USA, INCCesar R*** Executive Response
Revdex.com:Although I am accepting the response from T-Mobile and am agreeable to accept full refund for the iPhone plus as settlement I want to add a few things for the record so there no misunderstanding latter. In her response Diana states that we are eligible to get a replacement from T-Mobile or the manufacturer which is AppleThis does not accurately address the nature of the complaint and shifts burden back to meWe in fact did try to exchange the defective iPhone plus last November through T-Mobile but the exchange was refused by T-Mobile due to a slight bend in the phoneMy complaint also notes the two terms, "Bend-gate" and Touch Disease" which are cause and effect to a phone manufactured with a latent defect by AppleThe iPhone plus is razor thin, made with cheap aluminum and is highly prone to bending from everyday useThe effect of bend-gate is touch disease which is what happens when micro chips separate from the main board rendering the phones touch screen dead and useless. When T-Mobile refused to accept the phone back on a warranty exchange we tried to go to Apple direct, as Diana states in her responseApple told me that the phone we presented for service to them had been repaired prior using non Apple parts and was in a effect a "counterfeit" phoneThis was the last phone T-Mobile sent to us on our last warranty exchangeFailure to get satisfaction from both T-Mobile and Apple resulted in my complaint to the Revdex.com.So as of today I am waiting for the gift card I was promised in the amount of $When I have the card and when T-Mobile accepts the aforementioned "defective/counterfeit" phone back with no attempt to claw-back money or complain to me about the state of the phone which has been well documented, then I will consider this case closedIn the meantime I ask that the case remain open until I get the money and T-Mobile signs off on receipt and acceptance of the phone I will be sending back to them.*** ***
