receiving the documents from the creditor that validate this debt, TekCollect sent them to the consumer. The file attachment contains a copy of our letter to the consumer, including those documents: a truth in lending disclosure, appointment policy, notice of items charged back to the consumer's account, a copy of a letter from the creditor's claims department to the consumer, insurance company dental report plan form along with copies of the ledger statements. If the consumer will contact our  Collections Department and make reasonable arrangements to repay this outstanding debt, then TekCollect would be willing to make an accommodation with the consumer concerning the reports to the credit bureaus, once the debt is paid in full. The creditor, [redacted], placed the consumer's past due account with TekCollect on 07/21/2016. The service date on the account was 03/01/2016. We sent the consumer 4 letters to the [redacted] address on 07/21/2016, 08/20/2016, 09/04/2016 and on 10/04/2016. On 02/15/2017, [redacted]...

[redacted]'s Office notified TekCollect that the consumer had paid this account. At that time, we reported to Equifax, Experian and Transunion that this account was paid in full. Today, our agent contacted Equifax, Experian and Transunion to see how this was reported. Equifax is showing the account reported twice. One is showing paid and the other is showing an open account. We sent letters to the consumer at [redacted] Ave., Latrobe PA 15650 on these dates: 09/20/2013, 10/20/2013, 11/04/2013 & 12/04/2013. The creditor, [redacted] placed this account for the consumer with TekCollect on March 6, 2015. On September 28, 2015, the consumer called our office and informed us that she had filed for bankruptcy but that she had not included this debt in that bankruptcy filing...

and that she would not pay it. The consumer then demanded that TekCollect delete the account from her credit files. The consumer went on to state that she  would be filing a complaints against TekCollect. Shortly after receiving this call from the consumer, we received a second call from the consumer. This call was transferred to the Collection Manager. The consumer stated on this call that she had not taken an animal to the creditor and therefore she had not liability. The consumer informed us that she had filed bankruptcy and she gave us the case number, [redacted]. She also advise us that she had called the creditor. At this point, the Manager went to the Federal Court database and looked up this bankruptcy case number. Attached is a list of the creditors from that bankruptcy filing. Please go to the bottom of the second page. There you will see the creditor, [redacted]. The consumer included the creditor;s claim  in this bankruptcy filing on 09/01/2015.  TekCollect has reported this account to the credit bureaus as included in the consumer's bankruptcy, as required by Federal Law, the Fair Credit Reporting Act. TekCollect has noted the account in our database with bankrupt status and removed this account from collections in keeping with the Automatic Stay requirement of the Federal Bankruptcy Code. Today, our agent notified Experian, Equifax and Transunion to delete our report concerning this account from Ms. [redacted]s credit files. This should be completely removed within 4 to 5 business days. We have removed Ms. [redacted]s name and points of contact from the account and replaced it with the patient's information. with [redacted] of [redacted]. After carefully examining each claim, we reinstated both accounts. What happened was the result of a misunderstanding on the part of the person, who first responded to Ms. [redacted]. Going forward Ms. [redacted] now has our Manager’s points of contact. I have attached the validation of the debt as provided by the creditor, [redacted] Credit Union. The creditor has expressed a willingness to settle the debt for $183.71. We will forward this on to the consumer via USPS.

As per our conversation, I do not wish the case be closed as I have not received a plan for resolution on the matter. I requested the account be closed and that receive a refund in full minus the 1 or 2 accounts they collected on. They have refused to even answer my emails or calls, much less my request to close the account. Your assistance in keeping the complaint open is greatly appreciated. [redacted]

The consumer is mistaken. Alabama does not require a collection agency license for foreign (not based in Alabama) agencies who only send letters and make calls there. When we searched out database, we found two accounts for the consumer. One of these we show reported paid in full by the creditor, Dr. [redacted] M. [redacted] DDS, on June 20, 2016 in the amount of $860.00. We will call Experian, Equifax and Transunion to confirm what they show for...

this account. If they still show it as an unpaid collection, we will make the correction online and report that it is paid-in-full. It should be noted that Dr. [redacted]'s office placed this account with TekCollect on 01/30/2014. The date of service on this account was 10/09/2013. Our search of the database turned up a second record for the consumer. This account is in the amount of $221.70 and it is owed to [redacted] Dental Arts Center PC of Hillsville, VA. The Dental Practice placed this account with  TekCollect on 06/13/2016. We will call the Dental Practice to confirm the account balance and status. Also, we will obtain from the Dental Practice the validation of this debt, which we will forward to the consumer. I told to the office manager at the office. They stated that they already had talked to you and requested the account to be recalled. They were calling back today after I told them your company marked the collection as paid and closed. The office manager, [redacted] called again today to have you deleted off my credit report.
